filed chapter 7 in may was discharged in august still have'nt got a reaffirmation agreement - they wont talk to my lawyer wont talk to me about it - payment for october was 235 according to the coupon and the website(and still is on the website as that amount) called them took 5 times before i could understand the person since they outsource coustomer relations over seas. i was told the 300 payment i had sent in for october had been put in suspense since my regular mortgage payment was 389. i told them that it wasnt for october that i had acctually paid more that month. he argued with me -i told him that my coupon and the website showed 235 he said he would need to talk with his supervisor- when he came back he told me that i owed 175 in late charges and wouldnt comment about 235 due for october. i would be interested to hear from other people in missouri that has had ocwen as their mortgage company leighton1975@hotmail.com

QCWEN and Dovenmuehle Mortgage are in the same can of worms!

In dealing with QCWEN, their reputation and business practices are corrupt and dirty. I was also having to deal with another one of their fraud fronts, Dovenmuehle Mortgage, located in Lake Zurich, Illinois. These two firms work out of the same can of worms.

QCWEN will transfer your loan to Dovenmuehle Mortgage, then the three ring circus begins. They play this paper shuffle and in the midst of all the confusion, the customer gets the shaft. These two crooked firms are in business to steal your money, then your property.

My best advice is : start right now in finding a reputable lender to service your loan. These two companies are the clowns at and during the circus.

QCWEN & Dovenmuehle Mortgage is in the financial fraud business

I have dealt with this slimy and corrupt firm myself. Their name had appeared on my credit report as a false foreclosure, and the information was being reported by another slimy and corrupt company called Dovenmuehle Mortgage located in Lake Zurich, Illinois.

In trying to deal with Dovenmuehle Mortgage, they just lie to you and switch you from department to department. They never would connect me to their President William Mynatt though, for I was going to tell him that his whole operation is dysfunctional, and he is in charge of one huge circus at Dovenmuehle Mortgage. They screen his calls fearing it may be some federal regulator.

Both companies have been indicted for fraud and unethical business practices in Chicago, in the past. Still today, both firms are poorly managed and continue to operate in unfair and unethical ways. They will not return telephone calls and refuse to answer letters. I have to guess its because they are bombarded with angry customers, and hate mail.

I for one tell everybody that QCWEN and Dovenmuehle Mortgage is a big rip-off, and they will cheat you as well as treat you like crap. Do business elsewhere.

AG office just as bad

i contacted the AG's office after the initial lies made by ocwen claiming never to have had correspondence with my lawyer or the court on my chapter 7. and then ocwen telling me that as long as i make payments on the discharged loans that they wont forclose. but then tells me that i need to reopen the case to fill a reaffirmation agreement on something that legally belongs to me since it was discharged and they didnt make a move to take the house back or have me reaffirm on the loans during the procedings. but wont send me the deed either. i send the AG's office a revised letter with my lawyer's info and the address to this site they tell me this.

after completion of the mediation process, a determination has been made that further state action is not appropriate at this time. this determination does not mean your claim is without merit. since we have been unsuccessful in our attempts to resolve your complaint through our informal procedures, we suggest you consult a private attorney or consider an action in the small claims court.

what good did that do. i already have an attorney that they wont answer to and the bankruptcy court they continually ignore. and as far as small claims court when did a mortgage deed fall under small claims which they wouldnt show up to either and then cant only a federal court rule on this? just geos to show who works for us and who works for the money

Courtney,
Make sure you have the canceled checks you send in to Sebrink or since we now have Check 21 get copies showing that they were received and cashed.

Never throw away anything. When you get correspondence also keep the envelope. You might be surprised to see the discrepancies between the mailing date stamped and the date on the letter.

I kept all the certified/return receipts and stapled them together with the check images and filed them in a folder for easy access.

Ocwen buys the servicing rights to mortgages. Your Note may still be with Sebrink. It will state on your mortgage papers who is the owner of the Note and who is the Trustee.

Per Respa, when a loan is transfered to another servicer, you have to be notified by both the old and new servicer. For the next 60 days you have a grace period if your old servicer received your payments, and the new servicer cannot claim that you didn't pay if you have proof. However this is the area were they have perfected their scam.

The new Servicer buys the servicing rights, makes a deal with previous servicer as to what date the transfer took place and then may claim that you are two payments behind. You made your payments to the old servicer but because of the transfer date they agreed on behind your back and without your knowledge, you are past this 60 day grace period and delinquent (although it's a manufactured delinquency)The old servicer will claim they no longer have your info and the new servicer will claim they don't know anything about your payments to the old servicer.

Don't believe it when they claim they make no money on foreclosures. HA!

The loans are insured. They make money coming and going. When they sell at auction for less, they come after you for the deficiency!
Then they buy it themselves and sell it for market value.

Homeownership has become an illusion! You are owned by the Servicer!

Elvera - Thank you for the information. I mailed 2 checks to Sebring, no receipt, just regular mail. Luckily, they WERE credited, but from now on, I'll be sure to mail both payments certified to Ocwen. It's sad that we have to go to such lengths to mail our mortgage payment, just so we don't get screwed. Luckily, our insurance agent is a neighbor and friend of ours, so she will let us know ASAP if there's something fishy there. I can't believe my loan was sold a little over 30 days past closing, but I guess the thing to do is just make my payments on time and keep immaculate records to protect myself.

This is just to clarify.
Your Loan is being serviced by a predatory mortgage SERVICER (this is different from a lender) A loan servicer only collects your payments and is supposed to credit your account in a timely manner. If you have escrow, then they also have to collect the escrow payment and pay the entities when it's due.
Since most Servicers are not part of a lending institution, they have virtually no regulation or oversight by any gov. agency. Does that tell you something?
Ok, here's what you can do.
Send all your payments via US Postal mail, certified with return receipt. If you have 2 mortgages, don't put them in the same envelope. Send the payments in separate envelopes and pay the fees for certified/return receipt mail.
If you send them together in the same envelope, they will credit only one account and plead 'error' but will not fix it, and then after 2 months, foreclose on your home.
If you pay your own taxes and insurance, watch it like a hawk. Make sure that somehow your insurance wasn't canceled mysteriously. You will not get a notification, because there is somehow a reason why you didn't get it. This has happened to me, so believe me, it is being done to people. You may need to call your insurance co. occasionally and ask if your insurance is ok etc.
If they escrow your account, then still call the insurance co. to find out if payment has been made. Don't wait to be notified that it expired due to non-payment.
It is a total nightmare to reinstate insurance, and the predatory servicer will put force-placed insurance on top of it too.
Check if your payment has been credited to your account. If not, find out why and don't let up.

My husband and I just bought a house November 30, to be financed through Sebring Capital. First payment was due January 1, we sent it, they got it, no problem. Today I got a letter from Sebring saying that my loan had been purchased by Ocwen. Now that I'm reading all of this, I'm getting a little nervous. Is there anything I need to know in advance that can help me when dealing with these people? If anyone can offer me some suggestions, I'd be thankful.

You did the thing by reporting them to your state's AG office. You may also want to put a fraud report on your credit report and provide the credit bureaus with a consumer statement. Also, do a web search and check out the other websites that are posted. That will give you a heads up on what has been going on. You will be surpised! Because believe me, you are not alone. We are just 2 of many. Stay strong and keep your head up because I think that 2006 is going to be our year! Because Ocwen truly sucks!!!!!

ocwen is a nightmare

tried refinancing my loan on the invertor login it tells other loan places that i have never made a payment. and that the account is closed. and since they have ruined my credit report my score is currently 510 isnt that nice. ive contact jo ann emerson about it and the missouri attorney general so we will see what happens.
