Dear Construction Industry Licensing Board,

The Dental Place of Jax, P.A. ("Office") entered into an Agreement ("Agreement") on April 16, 2013 with Oden and Odom Construction Group ("Contractor") based in Orlando, Florida for a build out and re-model construction work for the Office. However, without the Office’s knowledge or approval, the Contractor essentially delegated all of the duties for the build on the contract to Mr. Mike Jones d.b.a. Dajis Construction ("Subcontractor") based in Jacksonville, Florida. This is evidenced by the fact that the Contractor did not visit the construction site once, or, to the Office’s knowledge, ever actively manage the construction site at any time after the contract was signed. While the Contractor at the time of the Agreement assured the Office they had sufficient knowledge and experience on dental office renovation to professional dental standards and specifications, the Subcontractor subsequently admitted to me that he did not have the knowledge or experience for this type of job.

This lack of industry knowledge by the Subcontractor in renovating dental offices unfortunately led to numerous construction delays, with the Contractor subsequently failing to follow Agreement’s date and time of completion. The Office to date still has unfinished walls, and the Office had to subsequently pay all subcontractors and vendors because Contractor had failed to pay. The Office had to hire a separate A/C vendor to come in and completely rework the duct work that was installed improperly by the Contractor. The Office to date still has several walls that have cracks in them, and the Office failed to receive the dental cabinetry that was due in the contract price. In addition, the Contractor did not replace shut-off valves with new valves that under the Agreement. The Office ultimately settled with the Contractor, and the terms of the Agreement were completed in December 2013.

Unknown to the Office at the time, when Contractor entered into the Agreement, the Contractor was not incorporated at that date with the state of Florida, though it has since become incorporated according to the state Florida wesbsite. The Office entered into an Agreement with the

Contractor to receive the benefit of Contractor’s knowledge and experience with dental office renovation but subsequently received sub-standard work performed at the direction of the inexperienced Subcontractor.
