Official pest prevention Made promises. Cashed check early causing overdraft fee Elk Grove, California

 A guy came to house offering pest control. I have been looking around since i have a bad fly problem. I told him that was my main issue. I told him no matter What I do they won't go away and there are alway a ton from my front walk way to the door. I told him I pick up after the dogs everyday I've tried online remidies bleaching and fly traps. He told me it was no problem and they could take care of it and even wrote it on the contract. Next I told him I could pay the $72 til the second and he allowed me to post date a check which is also written on the contract. So they come out and spray the inside and outside. My roomate was home at the time.

When I got home there were still just as many flys if not more. So I called and spoke to the manager Jeff he then told me we Dont cover flies our contract state's what we do cover. He said give it a few days and when the flies sleep where we sprayed they will get the poisen and that should help. Ok fine. Few days later still a ton of flies. Next I go and look at my bank account and the cashed the check on the 26th and not the 2nd causing a $34 overdraft fee. Now I am done. I emailed Jeff telling him about the flies and the overdraft fee he responds like I said we Dont cover flies and that He will look into the overdraft fee. I told him I only want to comunicate by email So it's all in writing but of coarse he tries calling.

So I remind him again email only and I now want to cancel service. I've sent several emails with no response telling them they breached the contract and misrepresented them seleves. Still nothing. To day I get a reminder they are coming to spray tomorrow. I email them again saying I quit service and take me out of my contract and they still owe me $34 and not to call be email me. Of coarse they call but I just email them again saying the same thing. I also emailed them if I am charged again I will file with BBB and FTC. I have still heard nothing. I'm very upset and want this done and over.
