After the drought last summer, we were considering some foundation work to stabilize one side of our home. An engineer had been brought out during the option period in April, and his measurements indicated foundation work wasnt immediately necessary.

Nowhere in our contract is foundation work mentioned. There are phrases such as "normal wear and use" and "consequential or secondary damage," but since these are open-ended, we called ORHPC for clarification. We didnt want to do any kind of house maintenance that would affect our home warranty coverage, and we knew the foundation work could wait, if our home warranty would be affected. 

We were assured, without question, by ORHPC warranty representatives, that foundation work would in no way affect our warranty. Specifically, two different representatives assured us, both before and after we decided to have foundation maintenance done, that if we had any leak issues, before or after work on the foundation, they would be completely covered for the cost of a service call ($60).

With this assurance, we decided to have the foundation work done. After the work was done, we called Old Republic to request a service call for a leak check. With full knowledge that wed had foundation work done, they sent out a technician, who didnt even look at our system. The technician stepped through our front door, spoke with us briefly, and returned to his truck to call ORHPC. At this point, we received a call from an Old Republic representative that they rescinded their representatives earlier statements, and unapologetically informed us that our elective foundation work had voided our coverage for leak detection and repair.

We understand that home warranties need to have limits, and even that foundation work might void coverage of a home warranty, but we would have waited to have any foundation maintenance done, if Old Republic had informed us from the beginning that it would affect our coverage.

We tried to reach resolution both through ORHPC and the Better Business Bureau, but they have refused to work with us.
