Oregon State Bar Fraud, Extrinsic Fraud Tigard, Oregon

My name is Darryl. I live in Portland, Oregon. I filed a federal law suite in May 2009, case no: CV09-704. This case was a pro-bono case. I asked for and after some time was granted an attorney on another law suite I had filed against a federal court judge, and a VA attorney. However, although this attorney was assigned to my case 3:10CV-00236 case, he quickly asked Judge Garr M King of the U.S. District court, Portland, Oregon Division to combine the two cases! 

Immediately Judge King agreed, and then David H. Madden (my new lawyer), refused to represent me in the complaint he was assigned to! He very quickly, changed the language of my complaint to something that is more difficult to win! 

Although I repeatedly asked him to meet with me or answer my phone calls, he only responded on "his" occasions! I sent him over 80 e-mails to which he only responded to about 10! He told me he had a doctor we could use but even though I asked him  several times when he would, he never sent me to him! Therefore, I couldn't use that expert testimony!

Then, he withdrew from my second case! 

I then contacted the Oregon State Bar. I told them in writing what rules under The Oregon Rules of Professional Conduct that David H. Madden had broken! Madden broke rules 1.1, 1.2, 1.3, and 1.4! 

I then requested the Judge (Garr M. King) grant me a new pro-bono attorney based on the fact David H. Madden had not followed the Oregon Rules of Professional Conduct. But the Judge has refused. His reason was simply that I was simply "Dissatisfied" with my lawyers performance! I filed a motion for a new pro-bono attorney and submitted the supporting documentation, and this Judge still says the same thing! He has shown bias, extrinsic fraud, and or outright racism towards my case and me!

I have attempted to file an amended complaint which would allow all the defendants who assaulted or harassed and assaulted me during my job at the Portland VA Medical Center to be named as defendants in crimes against me and I pointed out that these were crimes! Yet the Judge won't allow me to assert the crimes! I was thrown against a concrete wall face first and striking my nose, lip, and teeth! The white man said to another white man, "Hit him, he needs to be hurt!" I simply went into the rest room and washed my face. That was in May 2005. The man's name is Rod Winters! Joe Swietzer was the only witness!

I reported the assault to my supervisor, but he did nothing! In fact, when my Mother had a major stroke, I asked him (Ed Lyman) for some leave time to go see her. He just looked at me and said, "Maybe Your Mother Should Just DIE!" Although I was crushed and mortified, I just left his area because at that point, it was obvious that he wanted to goad me into violence! That was in July 2004. He told me that I would never advance on his watch!

Then, on February 21st 2006, I was sitting at my work station doing my morning upload for my day's work. Then, also without provocation, another "white employee" named Troy Wilkendorf, snuck up behind me, grabbed me from behind by my neck, and began to squeeze! With great effort, I managed to pull from his grasp! I stood up, turned to face him, and I said, "What's wrong with you?" I'm a bad a*s martial artist and you hurt me! You'd better keep your hands to yourself!" He leaned forward to within 4 inches from my face, and growled,"LET'S SPAR!" Although I wanted to, I didn't engage him! I also reported this assault to the VA Police but they refused to arrest Troy Wilkendorf! Nor did the threat assessment team do anything! Dr Drummond, who was the head man of the threat team said to me, "We can't fire Troy, he might go postal!

I was assaulted again on October 24, 2007 by another "white co-worker" named David Deer! But this time, a metal cart was used as the weapon! He came at me from the right side, but I saw his approach and backpedaled across the walkway, But he pursued me until he was successful. This attack has impacted my walk!

There were also numerous "Death Threats made against me while at work!" Credit for one of my ideas was given to a white employee! I sent e-mails and filed EEO complaints. But the EEO is obviously as corrupt as is the Portland VA Medical Center, Judge Garr M. King, Judge Stephen A Gaffin, Judge Amy Dunning, my lawyer David Madden and finally "The Oregon State Bar!" Mr Scott A Morrill as well as his supervisor Cris L. Mullman! 

After the third physical assault, I was rendered on crutches. I hobbled into work and announced that, "If anyone else assaults me, I'll defend myself tenaciously!" I was then forced to undergo a psychological "Fitness for Duty Exam!" However, some of the answers on the MMPI 2 test were changed! At least 100 of them! Doctor David Corey administered the exam and committed purjury on the stand during an M.S.P.B. hearing!

I never had any write ups or even one letter of reprimand for any violation at work in five years I worked there! My performance appraisals were all fully successful or better! But because I filed EEO complaints, and stood up against my oppressors, I was fired! The whistle-blower protection doesn't work the same way for blacks as whites!

So I now have this lawsuit case no: CV09'704. But this judge, Garr M. King, will not acknowledge the hurt I've suffered! In fact, he is forcing the case in a direction where a victory has become almost unattainable because he has allowed my shod-die lawyer to withdraw from my case, and thereby leaving me shipwrecked! I have quoted the Oregon Rules of Professional Conduct that I have proved this lawyer violated to both Judge Garr M. King, and the Oregon State Bar!

Oh yeah, I forgot to mention that the union I joined and paid dues to for three years threw me to the dogs as well!

There is much more to tell. But its late and I'm getting tired!

I hope someone gets back to me soon! I'm running outta options!
