Pacific Honda - Dottie Dahlin Submitted capital one auto finance loan without my approval. i had a blank check with capital one auto finance (both our names) when i walked into the dealership San Diego California

got a auto financing with capital one. got 5000 cash from bank. 1/4/2009 went to pacific honda here in san diego to buy a honda fit for my wife. told the dealership that i had a blank check and downpayment. told them that i did now want a loan or any extras. settled on a price. had to fill out a application because of the "patriot act". 4 hours later got the car. had to keep telling them i did not want any extra anything and not to run my credit application since i had a blank check.
feb 19, 2009 got a letter from capital one auto finance. said a auto dealer submitted a application on your behalf and they were unable to approve the loan.??????????
i called capital one and they told me that on 1/4/2009 pacific honda submitted this application.
i called pacific honda and got the run around. fianally got the general manger and he told me that he would get a letter to me.
i got the letter:

to whom it may concern at equifax bureau service.
please remove the inquiry initiated by pacific honda on brians credit beureau. the bureau was pull on 1/04 by mistake. the customer info as follows;
my info
he had his own financing in place before coming into pacific honda nd requested thhat we not pull his credit file. unfortunately his information was attached to a co buyer on the file that we needed to run credit on. his file was attached to hers and ran at the same time . please remove our inquiry from his credit file as it was a mistate to run it. the customer has requested this be removed from his bureau as it was his request fro the initial transaction and not to have his credit pulled.
this loan we had the blank check had my name and my wife name on it. two names. this was a joint application. there was no reason to run either of our names. we were lied to and defrauded. i would like to take this dealership to small claims court. what can i do? we both, both of us told them the same thing. we have our own financing.
i called the manager of the dealeship after i got this letter. i told him that it was completely incorrect and i need a new one showing that both of us never wanted anything submitted or a credit run! that was month ago. the guy Eric nelson the manager never called me back!

You really need to go back and read the posters comments The complaint isn't about the loan, but over an additional credit check. It's obvious that you think you're all that by you posts in other complaints reguarding Capital One. But really all your doing is making yourself look like a total fool. The dealer did what you asked and informed equifax to remove the inquiry.
Since your and your wife's credit files are separate have her call and request they remove her inquiry.
Even though you are married and it was a joint application you cannot request that your wife's credit file be modified.
So relax take a deep breath and have your wife call the dealer.

It sounds like to me that you need to calm down a little. the dealership corrected there action by sending a letter to the credit bureau. They then in turn sent a copy to you. It would only be a rip off if they didnt comply. . however it sounds like he ran it on yours not your wife's they did what they were supposed to do. If you guys have joint credit then it will be placed in hers as well i believe. I know it sucks that they did it any was, but at least they rectified it.

So they ran your credit? I guess I"m not seeing where you are out any money. You got your loan, and your car. They just did an extra credit check? What would you take them to small claims court over, where have they taken money from you?
