Started this process in 2009..went to Palm Harbors Homes to try a nd buy a new home.  After they showed us some homes they informed us that we would have to go through a credit counseling service and they knew one would could go to which cost us even more money at their request. 

Scott then informed us that we could qualify for a used mobile home and gave us a list we could go and see the homes.  We finally found one and noticed that there were several issues that needed to be addressed.  There was no air conditioner, no electricity hooked up to the home,no septic hooked up, etc. We addressed the issues and Palm Harbor assured us that they would fix the problems. 

We assumed they would so we went ahead with the purchase of the house.  An inspection got scheduled and we informed Palm Harbor we wanted to be there when it happened.  It happened but they never contacted us to be there.  We are not sure how they did it since there was still no power or water going to the house  for the inspector to check everything. We never even got an inspection report to know what was wrong with the home.

So far and we have only had the home for 2 years we have had to replace the septic pump twice since the company they hired put in used septic pumps.  The windows leak and we informed Palm Harbor about it and they said they would fix it but never sent anyone to do it.  The roof is starting to bow down which means the roof is going bad. The nails on the front porch and back porch are lifting showing and stairs are coming loose which meant that it is old and needed to be replaced. 

We have had to rewire the entire kitchen for faulty wiring, not one of the smoke detectors is in working condition, and the exhaust fan in the main bathroom turns off the electric in the living room if it is turned on.  Not one of these issues were brought to our attention before the house was purchased which also tells us that a inspection from Palm Harbor was not conducted correctly since there was no power or water to the house at the time.

The person that wrote this report bought a HUD foreclosure. 

The person that wrote this report chose to purchase a HUD foreclosure because he could buy a land/home combination for about $50000 less than if her were to buy the home new with land and improvements.

We did not build the house.  We did not install the septic or any of the other utilities.  At no point did we represent that we built the home or installed any of the utilities. 

The home and utilities, when purchased, passed an independent FHA inspection. The independent FHA inspection report is available to the buyer any time they wish to see it, as disclosed to them in their FHA closing documents. 

The FHA inspection took place after all applicances and air conditioning were installed in the home, and water and power were turned on.

HUD foreclosure homes are bought and sold in "as-is" condition, and are written as such in the purchase contract.

The seller of a HUD foreclosure home is not the builder of that home, and there is therefore no warranty expressed or implied.  No builder of homes, that I'm aware of, offers warranties on septic systems.

At Palm Harbor Homes in Tomball, we specialize in the sales of new, high-end, luxury manufacured and modular housing.  Unfortunately, not everyone can afford, or does not want to pay for, a brand new home with land.  We try to accommodate customers who choose to spend less by making HUD foreclosures available.  These are generally a great value, and of the 30 or so we have sold, this is the only one I'm aware of with these types of issues.  The fact that these homes must pass an independent inspecton, makes them a relatively safe investment for homebuyers.
