A 7 month investigation by the badbusinessbureau.com has revealed the following information on the Pizza Hut restaurant located at 495 W.Apache Trail, Apache Junction, Arizona. Sworn Affidavits along with recorded conversations collected from both existing and former employees, of Pizza Hut, allege the following:
Sworn Affidavits and recorded testimony reveal that Crystal Methamphetamine sales have been a continuing practice at the Pizza Hut in Apache Junction, Arizona. For years the Management has attempted to use different pizza delivery drivers against their will or without their knowledge to deliver drugs. When it was finally discovered by one employee, he insisted that it be stopped. When management would be confronted about not wanting to make drug deliveries, pickups, and money transfers, drivers would be threatened with the loss of their delivery job or find their scheduled hours cut and changed to working days, which basically means the employee would be the "dishwasher," until a real dishwasher came in at 4 or 5:00pm. Night pizza delivery drivers normally make between $70 to $100 a night or more. Day delivery drivers average about $6 an hour, and are dishwashers. When drivers would refuse to deliver drugs themselves, they would be forced to then take the manager to his drug deliveries, and either wait outside for him to come back, or pick him up later. This would not only cause the driver to miss his delivery tips for that part of the night, but much more importantly, they were risking their lives. Imagine, if they had been stopped by police, the driver's life would have been changed forever. One witness affidavit claims that the Pizza Hut manager was manufacturing the drugs in his bathtub at home. Several employees have witnessed three different Apache Junction PIZZA HUT managers (all of the Betty Carter family) dealing and smoking crack, and Crystal Methamphetamine on the PIZZA HUT of Apache Junction premises. One victimized employee informed the Area Supervisor, BETTY CARTER, many times about the managers' illegal practices, including how it was commonplace for Methamphetamine users to come to the PIZZA HUT in Apache Junction and go to the back office area or to the back shed to get high or purchase drugs. This victimized employee warned Betty on numerous occasions that this behavior was endangering the employees and customers alike, and this was definitely jeopardizing her job. The employee told Betty to notify authorities and threatened legal action if this illegal activity did not cease.
THREATS FROM THE AREA SUPERVISOR/OWNER POLICE CONNECTIONS..
Betty, the area supervisor, also claimed to many employees who signed sworn affidavits that she (Betty Carter) was in fact the owner or part owner of this franchise, and was one of at least eleven PIZZA HUTS in which Betty had an ownership interest. Betty also bragged to many of her employees that she has ties with the Apache Junction Police Department and has been quoted that she, Betty, "owns the whole town," due to her police connections. Betty would use these alleged ties with the Apache Junction Police Department to threaten employees. Sworn testimony by drivers, cooks, and waitresses reveal that it was an instructed policy that the Apache Junction Police not pay for their food. Delivery drivers have also testified that pizza deliveries to the APACHE JUNCTION Police Station and to the homes of the officers were to be at "no charge" ... a clear violation of the APACHE JUNCTION Police Department Policy.
FALSE IMPRISONMENT OF MALE DEFENDANT......................
According to managers and an alleged co-conspirator, there is a fabricated rape testimony that led to the trial and imprisonment of a young male defendant. The alleged victim and co-conspirator, Melissa Carter, apparently feeling guilty, disclosed the scheme to several employees over the last year regarding her involvement. Many times she was in tears. Melissa is the granddaughter of BETTY CARTER PIZZA HUT AREA SUPERVISOR and OWNER of at least ELEVEN PIZZA HUTS in Arizona. Betty Carter is also the mother of PIZZA HUT manager Rick Carter, the alleged drug dealing, child molesting, former PIZZA HUT manager of Apache Junction AZ. and now PRESENT manager of the PIZZA HUT in Winslow AZ. It is important to note that Rick Carter was never charged by police for child molestation or drugs as far as we know. In one meeting with a sergeant at the Apache Junction Police Department, the sergeant stated that Rick Carter was under suspicion for a long time, but he would not elaborate any further.
CARTER FAMILY FABRICATES RAPE CHARGES....................
Rick and Tim Carter, (both managers at the PIZZA HUT in Apache Junction,) also spoke about their mother Betty allegedly putting their former close friend in prison on a false rape / child molestation charge. Betty Carter obusively coerced her granddaughter Melissa Carter to lie and testify that he molested her. Betty devised this scheme because her son Rick Carter owed three thousand dollars to his former best friend for his Methamphetamine habit, and the friend was demanding the money. In another interview with police, when questioned about this possible false testimony and imprisonment, an officer stated that the convicted man was possibly an uncle who was put away. The officer then said he could not comment further. If these allegations are true, the consequences of this fabrication, where an innocent man is doing years of time in prison for rape, is an extraordinary miscarriage of justice. This is quite ironic, considering that Betty Carter, and practically every Pizza Hut employee is well aware that both of her Pizza Hut manager sons, Rick and Tim Carter, have had sex with many 15 and 16 year old girls, and that sex with minors has been a common practice in the Carter family for many years. Interviews with employees reveal that Rick Carter at the of age 35 was having sex with young girls over twenty years his junior. Sworn affidavits state that they have heard Rick brag about this exact behavior, stating right in front of his mother Betty Carter, the area supervisor / owner of Pizza Hut, that the best sex he ever had was with a 15 year old girl.
PINAL COUNTY POLICE KEPT COPY OF INCOMPLETE REPORT............
The badbusinessbureau.com tried to go through the Pinal County Sheriffs Department regarding the criminal activity that was going on at Pizza Hut. Because of the alleged ties between the Apache Junction Police Department and the Apache Junction Pizza Hut involving the use of Apache Junction Police officers to intimidate its employees, we thought it was necessary to use an outside agency. Inadvertently, we submitted to the Pinal County Sheriff's Department an incomplete written complaint about Pizza Hut over 2 months ago, which related many of the claims contained in this report. Several days later, the Pinal County Sheriff's Department stated that they could not get involved with this case. They said that we would have to make an application to Sheriff Reyes himself for them to get involved or it would be better if we contacted DPS or the FBI. They also said that we could pick up the submitted complaint, that they did not need a copy. We also wanted it back because the complaint was incomplete. The Sheriff's Department said they were not going to keep a copy of this complaint, which is not true. The complaint was not in the same condition as it was when it was originally dropped off with them. It was obvious that the incomplete complaint that was submitted to them had been taken apart and copied by the Pinal County Sheriff's Department. There were extra holes where the staple was, and the staple the Sheriffs Department used was a bigger and a thicker staple than the one we used. Again we notified the Pinal County Sheriff's Department that the copy of the report they had was incorrect and missing many paragraphs, etc., and that we had mistakenly printed out an incomplete report.
According to our sources, the information in this complaint was given to or discussed with a local APACHE JUNCTION Police officer. Then the APACHE JUNCTION police officer went to the Pizza Hut and stayed for two hours, revealing sensitive information to the area supervisor / owner Betty Carter at Pizza Hut. Employees at the Pizza Hut later confirmed this information and stated that the officer left with 2 free pizzas after the two hour meeting. For several reasons, including the obvious conflict of interest issue, the badbusinessbureau.com wanted the County Sheriff's Department or another outside agency to handle this problem . Free food was being given to the local APACHE JUNCTION Police Department on a regular basis. An officer of the Apache Junction Police Department came into Pizza Hut and intimidated an employee in a show of force, apparently as a favor for Betty Carter. The Apache Junction police officer helped Betty scare an already victimized employee who was rebelling against Betty about the illegal activities contained in the complaint and many other illegal practices that take place through the Betty Carter mis-management.
THREATS BY AN APACHE JUNCTION POLICE OFFICER...............
One night the area supervisor Betty Carter called the police, allegedly on a false claim that an employee walked out with $100 cash and the keys to the safe. Employees say this was probably a lie (as done in the past ), so Betty Carter could just pocket the hundred dollars, and also put in a police report against this employee, who by then already knew he wasn't getting paid minimum wage for his work . On this particular occasion, for unknown reasons, Betty asked the same employee who was rebelling against her to stay with her after he had already clocked out while she called the Apache Junction Police for help. When the officer came into the restaurant, he immediately pointed out the very employee that was being threatened by the management. His tone was intimidating and threatening. It appeared as though the officer was prematurely assuming that this employee was the person who Betty was calling about. This is not acceptable behavior of a police officer according to the Apache Junction Police Department, who we spoke to about this strange behavior of the officer. Betty Carter used this opportunity to deliberately hurt this employee's character in front of the officer, scaring the employee for no reason at all. The employee that was threatened during this process was described by all employees in their affidavits, as a model employee. After the officer left, Betty Carter the area supervisor / owner turned to the employee that had just been victimized by Betty and at the same time intimidated by the police and said, "See how much power I have with the Apache Junction Police Department." The employee who had allegedly ripped off the $100.00 and left with the keys was a 300 lb. Hispanic with tattoos all over his body. The employee intimidated by the officer is a thin white male approximately 140 lbs., no tattoos, and does not look Hispanic! This was an obvious set up and police harassment.
BOGUS SPEEDING TICKET DISMISSED.....................
In the following week or so, this same officer pulled over the same harassed and threatened employee and gave him a fabricated speeding ticket. The officer began the conversation by threatening, "Give me one good reason why I should not arrest you?" The officer ended the conversation by again threatening the employee, "You better just pay the ticket as soon as possible if you know what's good for you!" When we called and talked to this officer's supervisor, we were told in a terse manner that the Apache Junction Police Department would sue the employee of Pizza Hut if we put in a complaint against the officer. badbusinesbureau.com researched the laws and assisted the victim to fight the ticket that was wrongfully issued to this defendant. The ticket was dismissed by the judge after thoroughly cross examining the officer.
POLICE VIOLATE DEPARTMENT POLICY...................... AGAIN, ...
Most employees testify that the Apache Junction Police would come in to the restaurant and eat for free almost on a daily basis. Delivery drivers made deliveries to police officers homes and to the Apache Junction Police Department itself, at NO CHARGE! AS stated above, this is a clear violation of the Apache Junction Police Department Policy and most likely violates other laws as well. Betty Carter would always brag and threaten on many occasions to many employees that, "I'm in so good with the police in Apache Junction, they will do anything for me." It was also Betty Carter's policy that granddaughter Melissa Carter was the only one to wait on the officers. Melissa was also only 16 years old and has been seen serving beer many times.
SEXUAL HARASSMENT COMMON PLACE OVER THE YEARS..........
Young women under the age of 18 would be hired to answer the phones. The young employees would go home to their parents telling of sexual advances by the Manager Rick Carter. Many times this would happen right in front of the Area Supervisor/ Owner Betty Carter and the mother of this manager Rick Carter. Testimony reveals also that young underage women would get their butts pinched and breasts fondled by the Manager Rick Carter who would openly offer them drugs for sex. As stated before, sworn testimony revealed that Rick bragged about having sex with a 15 year old, saying it was the best sex he ever had. This was said right in front of his mother / area supervisor / owner of Pizza Hut Betty Carter. According to several witnesses, the Apache Junction Police Department was notified several times over the years by victimized employees about the sexual harassment that they were receiving from PIZZA HUT Manager Rick Carter. There was no one in the company to go to but Betty Carter who only protected her manager son Rick who was the harasser, molester and drug dealer in all of these cases. This has been happening for many years to many young underage girls and boys. Testimony reveals that on several occasions parents of underage employees came into Pizza Hut to confront Betty Carter, complaining of sexual misconduct by Rick Carter.
Sworn testimony reveals that one dedicated male employee who worked at Pizza Hut for over a year was sexually harassed by being called a f****t. This was not the first employee to suffer such harassment. One employee was threatened that he was going to get beat up, kicked in the back, hung out to dry on a barbed wire fence to die, and one day he will go on a delivery and will never return again.
EMPLOYEE TRIES TO STOP ILLEGAL ACTIVITY.................
Testimony reveals that one employee tried, time and time again, to put a stop to the drug dealing, serious sexual harassment and molestation's, threats of beatings, pay check shortages, time cards and schedules being written in pencil, and to stop the forcing of employees to sign many pages of documents that they were not allowed to have copies of (rules and regulations which were never taught by management.) According to other employees, all pleas to Betty Carter to make changes only caused more problems for this dedicated employee. The employee (now advocate) had also tried to stop the illegal practice of management forcing employees to work after an employee was already clocked out. The employees were intimidated by management by being told that they would get day hours or by threats of losing their jobs if they did not stay without pay. (as in the instances when employees refused to deliver drugs.) When this victimized employee/advocate finally told Betty Carter that he would go to authorities if she did not do something about the manager's illegal activities, Betty told the victimized employee the next day that she had already fired her son. This was not true. We later found out through witnesses that Rick Carter was actually never fired. Rick was actually put on paid sick leave after the employee had confronted Betty, and unbeknownst to the employee who confronted Betty, Rick Carter had to go to prison again anyway within a week for not paying any child support to his children for well over a decade. We suspect that Betty made sure that Rick Carter remained on sick leave while in prison. It was also known that Betty would never document any complaints against her son, ever. This would be the duty of the area supervisor in any company like Pizza Hut. No documentation was ever made, even when parents came into Pizza Hut in a rage confronting Betty about sexual advances and harassment and drugs.
CHEATING EMPLOYEES OUT OF THEIR PAY..............
As stated in sworn affidavits by many employees, it was directed by Betty that time cards would be written by the management in pencil. Most employees interviewed claimed their paychecks were shorted on an average of 5 to 15 hours a week, some being shorted hundreds of hours in total over the years since they have been employed. Making employees work after they already had clocked out and as they were walking out the door was an everyday occurrence. Employees have witnessed Betty Carter erasing and changing the hours on their time cards. More and more employees have been coming forward recently with the same kinds of stories. (Watch for updates as more witnesses come forward.) It is important to note that most of the witnesses who have been interviewed do not even know each other or have never even met, and they even worked years apart.
HEALTH CODE VIOLATIONS NOTICED BY ALL EMPLOYEES BUT NOT THE COUNTY?............
The County always gave a clean bill of health to this Pizza Hut, according to claims by area supervisor/owner Betty Carter.
1... Affidavits allege that the place has been filthy for years and there were many times that customers called in to complain, stating that their whole family is sick from the food.
2... There was never any soap or paper towels in the public restrooms.
3.. The employees' sink was unusable and was frequently filled with either dirty dishes or reeking and filthy rags. Also, the sink was usually inaccessible due to clutter stored in front of it which made it impossible for employees to wash their hands anywhere. There was no soap -or paper towels there either. Management does not bother to have employees refill the containers, although there was always a full stock of these supplies in the back shed which was ignored.
4.. Employees were never told once, or trained by the Betty Carter or management to wash their hands. Testimony reveals that Betty Carter ordered an employee to go directly from picking up pizza boxes off the floor to putting his hands directly into the pizza dough without washing his hands. Cooks would go directly from collecting money at the register to making pizzas just a few feet away. There is no sink for them to wash their hands between collecting money and handling food at the "make table" where food is prepared. Sanitary gloves were never used. The gloves, along with all the other sanitary supplies, sit collecting dust inside the stock room with everything else unused.
5.. Mice droppings and urine were commonly in the pizza boxes and all around the floor.
6.. Cockroaches were in pizza boxes, food and everywhere.
7... Pizza boxes would be kicked to knock out the roaches and the mice droppings before being used for a delivery.
8... One affidavit claims that a dead mouse was found in the pizza dough and just picked out and that the dough was then still used to make pizzas.
9...Numerous testimonies reveal that two mice were killed when they were rolled through the dough roller.
10..Nothing was ever cleaned unless an inspection was scheduled by the Pinal County Health Department, who gave ample warning that they were coming.
11...Employees walked on open pizza boxes and still used them. On several occasions pizzas had to be retrieved by delivery drivers because customers who discovered a shoe print under the pizza after eating a few slices.
12...Management instructed waitresses to save and use outdated food, complaining of food costs.
13...Meat and other toppings would sit out all day in filth with flies all over it, only to be put back in the cooler at the end of the night.
14, Toilets were always leaking at the base. Sewage would be leaking constantly on to the floor, leaving a puddle which leads to the drain located in the middle of the floor.
15. The plumbing under the sink in the men's restroom was continuously leaking. A bucket was placed under the sink, which would overflow and also leave a puddle leading to the drain in the middle of the floor. This has remained in the same condition for over a year and a half, and the filthy bucket under the sink still remains there as of August 5, 2000 and is most likely still there to this day, along with all of the other violations in this report..
16, 17, 18........We have so many health code violations to list, including ones that were created deliberately by the management where the management purposefully vandalized Pizza Hut, forcing it to be temporarily closed for three weeks in order to acquire days off with pay for the management only.
ANOTHER CO-OWNER INFORMED OF SEXUAL HARASSMENT, ILLEGAL ACTIVITIES, THEFT OF FOOD AND MONEY .. CRY FOR HELP FALLS ON DEAF EARS.....................
In several taped phone conversations to another owner, "Doug," almost all of the information included in this reported was told to him. He was asked for his help. Doug became defensive and argumentative and didn't bother to return any calls. The main corporate offices and one of the franchise offices located in Panama City, Florida were also called for help. All pleas for help seemed to fall on deaf ears. The very day after the call to the main offices, and in an effort to reach even other owners, the situation got even worse for the threatened and sexually harassed employee. Other employees were scared for this victimized employee's life, and feared that his life was in danger. These other employees urged the victimized employee not to go back to work because they feared for his safety. The employee was subjected to harassing and life threatening remarks on a daily basis: Threats such as, "you're now dead, f****t your dead, you're a rat, no one rats on us and gets away with it." The manager stated that Doug (the other owner) is with us, he won't do anything, neither will the police. The victimized employee then called the badbusinessbureau.com again for assistance. They immediately sent civil & human rights activists to the Apache Junction Pizza Hut.
The activists sat down in the second booth from the door, right next to the booth full of employees where they witnessed other employees in the presence of the managers calling this young victimized employee a f****t and laughing about how they were making his work hard on him. Workers were using foul language and spitting toward the victimized employee. The employee then went out for a delivery and, as he was walking out the uncivilized employees began yelling, "f****t you're dead. We'll get you later." One employee spit on the door just after the young man closed the door to leave. The manager, Tim, then said as he was looking out the window, "f****t, you're a dead man." Later when the victimized employee walked into the back of the restaurant, one of the employees sitting at the booth again spit across the room to try and hit the victimized employee, but he missed. Some of the employees began talking about beating him up after work. "We'll just hang him on a fence in the desert like they all should be." badbusinessbureau.com representative met the employee outside and insisted that the employee go home.
The employee (concerned about losing his job,) asked if the AZ. Civil Rights representative would be willing to wait outside and provide video surveillance for his protection and possible intervention in case something did go down. We did provide this so he could finish working for the night. When he finally left Pizza Hut for the last time days later, he left under extremely threatening circumstances, where Rick Carter, the manager who had been hanging out for the past several days in the restaurant, let the victimized employee know that they will get him for "ratting them out" to the owner.
NOTE: The Apache Junction Police misinformed the badbusinessbureau.com, and for some reason stated that Rick Carter hadn't set foot in the Apache Junction Pizza Hut for over six months. ..How would they know this? This one employee, who was now a nervous wreck, called Pizza Hut for two days asking when he was scheduled, but there were only all new employees who were suddenly hired, all friends of Betty and Melissa Carter, who were also answering the phone. When the victimized employee called Pizza Hut, one of the very people who threatened him would answer the phone, and he was just put on hold for several minutes and then the phone would just hang up. Then, several threatening phone calls came from the Pizza Hut. According to the caller ID, the calls came from the Apache Junction Pizza Hut with a disguised voice saying, "you're a dead man .. you're a f****t," And "What happened to the f*g in Wyoming is exactly what will happen to you." Finally about three days later, one of the existing employees who was not new, nor friends with the Carter Family, answered the phone. The employee told the victimized employee that Tim Carter, (the Manager), said that he was fired.
VICTIMIZED EMPLOYEE PROMISED HIS OWN STORE...............
Why did this employee want to work there? Why didn't the employee get a job somewhere else, you ask? This one employee was promised his own store to manage and/or be the lead driver by the owner Betty Carter for almost a year. This would have meant more money and a much easier work schedule and a better work environment.
THE EMPLOYEE SCHEDULE, ANOTHER WAY TO GET RID OF UNWANTED EMPLOYEES THAT KNEW TOO MUCH........................
Another trick of this creative and vicious area supervisor/owner Betty Carter was to always write the work schedule in pencil. After an employee would leave for the day, the schedule would be changed, so when the employee did not show up the next morning on their day off , they were fired, even though they were unaware and were never informed of the schedule change that occurred between the time they had left the night before and the next morning when they were fired. Amongst the employees, this was a well known trick that the Pizza Hut management used frequently to get rid of those who were there long enough to see what was going on. Just ask Pizza Hut how many times they have paid for unemployment? They would always claim the employee did not show up for work and was fired for that reason, making the employee ineligible to collect unemployment.
MANAGEMENT STOLE MONEY........
Shortages in the register were always paid by all drivers whether they touched the register drawer or not. Most affidavits claim the only times the register was short (as much as $100 a night,) was when Rick Carter or his wife Vanessa worked there. According to employee testimonies, Rick Carter and the rest of the Carter family management would always make up receipts for items that were never bought. They would take the money out of the register and use it to buy lunches, cakes, pies, and of course, drugs. Pizza tickets would also be ripped up and thrown out, and Rick Carter would just take the money out of the register. There is much more information that we have. We are going through all of the testimony and re verifying what has been collected so far. We will edit and update this report shortly.
COMPENSATION SHOULD BE PAID ..............
These employees have been subjected to work under terrible and threatening conditions. Almost every employee who was interviewed, showed definite signs of stress, resulting in family problems caused by the working conditions at the Apache Junction Pizza Hut. If a police officer would have stopped an employee with the manager carrying drugs on his person in the driver's car, if the manager did stash the drugs off his person, which would be likely, the driver's life would have been changed forever! The owners of Pizza Hut should be made to pay damages to all the past employees of this Pizza Hut who were subjected to these wretched working conditions. At this time, Pizza Hut Inc. refuses to talk about or deal with the situation, forcing the victims to go to court. Typical of a Fortune 500 corporation. .......................

UPDATE: 9-6-00 PARENTS AND 16 YEAR OLD VICTIMS REVEAL........
More victims have been interviewed over the last 2 weeks. New statements reveal that 16 year old employees were sexually harassed, and improperly touched over and over again. The Pizza Hut owner and area supervisor did nothing. Parents of the victims went with their children to the Apache Junction Police on several occasions to file charges. No report would be taken and NO investigation was done to the best of their knowledge. FALSE IMPRISONMENT?......... More victims have confirmed that the Carters falsely accused and imprisoned a man falsely for rape to Betty Carters granddaughter just because a debt was owed by Betty Carters son Rick. They needed this man out of the way that they were accusing of the alleged rape. ** Prior to the rape charges being filed by the Carters, Apache Junction Police revealed the alleged rapist past record as a favor, giving the Carters the knowledge that was needed to get this man out of the way so a debt would not have to be paid by Rick Carter. EDITORS NOTE: The statements above we believe are true by the victims. We do believe that the many witnesses that have given statements were in fact told this by the Carters about the alleged false police report, resulting in a false imprisonment. What might not be true, is the story itself? Was this just bragging? This could have been a story to look like the Carters can do what ever they want, to whom ever they want, like most witnesses have testified, during our investigation. UPDATE 9-15-00 Further Investigation reveals that Rick Carter took employees time cards and threw them away in order to change hours on them. Rick Carter would try to borrow from almost every employee without any intention of ever paying it back. Many employees lost between $5 to $900 or possibly even more this way to Rick.
BEST PROFIT MARGIN AWARD PIZZA HUT???? We are told by many victims and witnesses that the Apache Junction Pizza Hut has been rated as the most cost efficient Pizza Hut in the whole chain. If this is actually true, this is only due to keeping outdated food, clocking people out, while keeping them working for hours without pay or not paying employees at all, never using the cleaning supplies that are in the outside shed, letting go employees and not giving them their last check ect.. It is rumored that Manager Rick Carter told people that he was to receive a large bonus check, (as high as $70,000.) This was to be awarded to him for being the most incentive manager on the west side of the Mississippi. We would like to review the policy's of Pizza Hut involving their "most incentive manager awards".
Is Pizza Hut promoting management to erase hours off of their employees time cards and other illegal forms of behavior in order to make it look like they can actually achieved goals that are impossible to reach? How does this benefit the employees? What are the means specified in the policy that management are to acquire these goals? It is the year 2000.. Why doesn't this Pizza Hut chain have a computer for proof of it's financial records? Why is everything written in pencil? How can Pizza Hut allow this to happen? We are asking lawyers to look into such bizarre practices for such a large chain to be involved with, and we will update this story in the near future.
