Planet Fitness-Austin, Texas (Slaughter Lane) allowed a minor to sign a contract and will not let them out of the contract even though a minor can not enter into a contract.




 They want a $58 buyout fee before canceling the contract. They have been charging him even though he only used the gym a few times. The keep charging his debit card each month.




 I have tried to get them to cancel the contract but they refuse even after I told them my son paid the $58 buyout fee in cash. They say that no buyout paperwork was completed by either my 17 year old son or the fitness club. So he lost the $58 buyout fee and keeps getting monthly charges.




Beware of Planet Fitness and their shady tactics. They have clubs all over the US. The best way to handle them is the file a dispute with the credit card company and hope for the best.

Planet Fitness answer to my email. They don't seem to want to follow their own policy.

Due to liability reasons, the minimum age requirement for membership is age 13.

 Ages 13-15 must be accompanied by a parent/guardian who is also a member

Ages 16-17 may attend the club alone however must have a signed waiver on file by a parent/guardian

Legal Age

If I'm not mistaken the legal age to sign contracts in TX is 17. 

I'm not a lawyer but I would think your son would be bound by the terms of the agreement he signed.

Check your state's statutes to see if your son is considered a minor.

I am not an attorney, but you might have the ability to get out of the contract if your son is considered a minor. Minor's can't legally enter into contracts. Either check your state's statutes or check with an attorney to see if you can cancel the contract and receive a refund because of your son's age. You may be able to accomplish this in small claims court without an attorney.
