I know I was not smart when I purchased this car. And most likely wont be able to do anything about it. I had purchased a car I was not happy with so I looked online and found that the Mazda CX5 was rated to be one of the top 10 best on gas mileage crossover SUV on the market so I wanted to check it out. I inquired and was contacted by Joe, he told me to come down and he will show me what they have. Well, we found one that looked like a nice car. I had purcahsed my car I was trading in with a trade in so I owed almost 30000 with the extended premium warranty I had purchased. Anyway , this new 2016 CX5 had a sticker price of 31000 , Jow and I had worked out a deal where they would take in my car in trade and give me 20000 for my car and then sell me the CX5 for 28000 and of course put the rest of the money I owerd in the loan for a total owed out the door of just over 37000. That sounded like a reasonable deal and he also said he would throw in the cross bars for the luggage rack since I had just purchased them for the Ford Escape I was trading in. He said they would requre a check for downpayment for $8500.00 so I told them I would not have my money until the end of Sept and they said they would hold the check so I figured it would not be a problem. I gave them the check.  In finance i saw the total for the car but didnt notice that they did not subtract the check from the deal so it ended up I was paying 46000 for this car!??!  I asked during the signing to be sure that down pament was included in the total of the 37000 i was paying and the finance  guy Isaac said it was and not to worry.  Well, I went over the docs after I got home and it became clear what had happened and went back to talk to Joe about it and he said it didnt sound right and told me to talk to Isaac in finance about it. I went in and basically he said that is the deal and I owe 8500 in addition to the 37000 I just financed for the car. I am sick about this but of course it is my own foolish stupidity that I believed and did not read to be sure I understood it at signing. But that does not make it right! I wonder how many people they do this to? I know there is no excuse for my actions but I was extremely tired that night and I really thought Joey was a upfront guy, he seemed so darn nice. Very stupd on my part!! I just hope this does not happen to others and wish there was recourse for me to get my 8500 back.

You might be able to fix this or at least make the dealership "pay"

First: I don't work for this dealership or any other dealership. I am somewhat familiar with dealership contracts though and have a couple of consumer suggestions.

Take a look at your contract today right away to see if there is any period for you to unwind the deal. There usually is NOT such a clause, but a few auto dealerships have a written policy to unwind within 3 to 5 days.  Carmax comes to mind.

If there is no such clause to allow you the opportunity to unwind the deal, then do these three steps next:

  • Report the dealership to the CFPB (Consumer Financial Protection Bureau). They have teeth and can do something about many consumer financial inequities. Not always, but it is well worth making the complaint.
  • REFINANCE your vehicle as soon as you can.  This week if possible. I say this because it takes away all the financial benefits that the dealership will get as a result of their deception with you.  Plus you have the very real chance to save big bucks.  The timing is critical on this. The finance office loses their commission if you refi right away.
  • Remove the GAP and the extended warranty before you refinance. You can get a better, less expensive GAP policy with your new lender or your insurance company. You don't need an extended warranty on a new vehicle. These two actions can potentially save you thousands of dollars (plus take away large commissions from the dealers' finance person).

I understand that you are the final authority when you sign the contract and the dealership does their best to get you to not read the contract through distraction and other methods.

That is why it is so important that everyone double and triple check the contract by reading every word before signing. I catch many dealers with "errors" in their math. The error is always to the dealers favor and not to the consumers' favor. The dealership finance person gets a larger commission by making these "errors" - they get a commission on all those add on products and the commission percentage of the add on price is huge.

Your revenge against the dealership will be hitting them in the wallet when you remove the add on products (GAP and extended warranty) and complete the refinance right away. Plus it will save you thousands. :)

All THEIR Fault, Right?

WHO signed the paperwork and obligated themselves to the terms contained therein?  Who did that?  YOU DID THAT!  I guess you didn't take your common sense pills that day, did you?  The time to READ the contract is BEFORE you sign it!  In other words, YOU signed the papers and had absolutely ZERO CLUE what you were obligating yourself to!  Did they pull a fast one?  Of course they did and why?  The answer to "why" is because they know there are tons of people who would do exactly as you did...not even reading what you were signing BEFORE you signed it.  Want blame somebody?  Blame YOU.  YOU could have avoided this by using the rules of common sense!

Let me save you the time and trouble...don't bother writing back with even more nonsense like, "You must work for them", because I don't nor any other dealership.

I totally agree that I am to blame for not reading and understanding what I signed. I totally agree that I am the Stupid a*s that signed the document without making sure I understood what I was signing. I did ask Isaac when I was signing if that 8500 was included in the 37000 purchase price and not in addition to and he said it is and not to worry. When I went back to talk to him about it he said it is in addition to and did not remember telling me that whhich is exactly what you would expect him to say. I would like to know what happened to the deal that I made with the sales person. Whoever you are that filed that rebuttal , I think you may be working there too. Its not right to take advantage of people.

And I am paying for it dearly. and I guess you think that is a good thing?  YES! I am at fault for signing and what a price to pay. Still does not make it right.
