(6/2/04)Same old story, air conditioner stopped working. Contacted a company out of the Yellow Pages "Polar Refrigeration & Air Conditioning, LLC" in Tempe, AZ. Said it would be $69 to look at the unit. $69 would be put towards the repair if we decided to have the work done. Technician (found out later, also owner of company)showed up at the house and looked at the unit. Quote $550 flat fee. Asked what the flat fee included and was told whatever it took to fix the unit (wife called me at work).

Told the guy I wanted an itemized quote and he again stated the flat fee was $550. I told him to have my wife pay him the $69 and he could leave. Wife called back and said the price was now $98. He wanted to charge us an hourly fee. I told the guy that it wasn't quoted that way and both my wife and I called and neither one of us were told of an hourly fee.

I called their office and asked to speak to the person in charge. He wasn't around and I asked for him to give me a call as soon as possible. I called my wife back and told her to pay him and I would take care of it later. No one ever called me back.

(6/4/04) A friend of mine but me in contact with another AC repair company and after looking at the unit, it turned out to be a $35 part and $35 in labor to fix it. Big difference from $550.

(6/4/04) Sent compliant to the BBB. The responded by saying they don't handle monetary disputes.

(6/10/04) Contacted another company in AZ that has the same name as the company that worked on my unit. Individual said that he has had nothing but trouble with the other company and was going to the Arizona Registrar of Contractors to get his license revoked. He asked me to send him any info I had. I sent it on 6/16/04.

(1/15/05) 5 MONTHES LATER... I get a call at 9:30 PM from Polar Air threatening to sue me if I don't write a letter rescinding the information I sent to the gentleman going after his license. After various vulger comments and threats of taking my house, I told him I was going to contact a lawyer. Mr. Rousseau calls back and reads off mortgage information on a house we use to own and playing back recordings of our previous phone conversation. I hung up.

(1/28/05) Received a claim for $350,000 filed against me in Canada by Mr. Rousseau. It was also filed against 5 other people on the complaint filed with the Arizona Registrar of Contractors.

(6/2/05) To make a long story short, my lawyer in Canada got the "Frivolous Claim" thrown out. Mr. Rousseau tried to get the claim discontinued, but the Judge awarded me costs ($8,500 Canadian) which I haven't seen a penny of.

I filed a complaint with the Arizona Registrar of Contrators to make sure he couldn't get a license again in the State of Arizona, but the Arizona Registrar of Contractors are only interested in injury or cost due to damaged. The hearing results have not been sent out yet. It turns out that Mr. Rousseau has cancelled his license and bond in the state of Arizona, but still has businesses in Canada, Texas, California and starting one in Florida.

This is the same company that Amy filed a complaint against and I'm sure Misty rescinded her statements due to threats like I received.

Funny story coming across this. My Father is the man who ownsthe other and the original Polar. This Hugo person caused so many problems for so many years. My mother, brother and father would get all of the same harassing phone calls. Along with calls from angry customers that my father has never done work for! Hope Hugo never runs a company again.

Domesticating Judgment

Wells its been years since this judgment was awarded to me and I had changed my email a couple times since this original posting.  But there is some good news.  Since my lawyers in Canada couldn't find any of his money in Canada, the only way I was going to get this money out of Hugo Hector Rousseau Jr was to domesticate the judgment.  The problem with domesticating the judgment is that you have to know where the person is living in the United Sates.  Well, thanks to his exwife that I was told he left pennyless after inheriting over $400,000 from his father's estate, gave me a call and filled me in on his new residence.  I was able to hire a law firm in Texas and they have filed the papers in that county.  My lawyers have heard from him and he tried to tell them the judgment expired, but I had it renewed last year.  We are looking forward to him contesting it just so we can take this to court and get the interest and additional costs added to the judgment.  I would of loved to see the look on his face when the papers arrived telling him the judgment was being domesticated.  Once this is recorded, then the credit reports and credit checks begin to pay off.  Just when you thought it was over.

Please take note of the DATES on these posts. The original complaint was 09/20/2004 and my first response was on 09/28/2004; my second response was FOUR MONTHS LATER.....

I USED to work for a local HVAC company (I WAS NOT FIRED for this! I found better employment) and the owner of this company lives in CANADA. He called every AC company in town asking for "Misty" until he finally found me! He then began calling me at work and making threats, screaming at me that he was going to sue me personally for slander and then when that didn't get him anywhere, he began calling my EMPLOYER and threatening them!

I explained to my former employer that I had posted my completely legitimate coments on my OWN TIME and they agreed that it should not and would not affect my employment. They then proceeded to tell him they would be happy to get the company attorneys involved if that was what he wanted to do. I was forced by my company to post that retraction, just as a show of good faith on their part but all I did was simply advise the consumer to file a complaint with the REGISTRAR OF CONTRACTORS (which I encourage you to do as well!) and they, along with several other people, must have because back in Jan 2005 there were a couple of complaints pending at that time. According to the website of the REGISTRAR (azroc.gov/clsc/AZROCLicenseQuery and search their name, Polar Air, you will find FOUR LICENSES NO LONGER GOOD!!!) they were no longer licensed in the state of Arizona and if they are still operating, they are now doing it ILLEGALLY.

SCREW YOU POLAR AIR!! Harassing decent people, providing BAD SERVICE and giving other hard working companies a bad rep.. We're GLAD TO SEE YOU GONE FROM ARIZONA!!! HAHA!!! Threaten me again and I will personally see you in court! I don't work for that company anymore so calling them won't do you ONE BIT OF GOOD!!!

I'll be laughing for DAYS!!! Mike, YOU need to file a complaint with the registrar right away because the company you dealt with may have NO LICENSE.
