In June 2006 I purchased a used truck from Pondella Auto Mall.  I got a great truck and at the time was treated rather well, however, I have since learned that they, Tom Fendick the owner clearly has no understanding of how financing works.  Requests five different times for five different payoffs, and Tom Fendick wants the "FULL" contract price, not wanting to give proper credit for payments made ahead, posting those payments when the month came due instead of crediting anywhere between $4200 and $7000 dollars on the principle reducing the interest therefore reducing the actual amount owed on the vehicle. 

I am concerned that this man, being a former attorney from New York is ripping people off then repossessing their vehicle citing monies still owed but in reality the vehicle was paid off.  Which is exactly what I am going through right now with the dealership.

The state says "Buyer Beware" however, the buyer should be aware that the highest interest rate allowed by Federal law is 24%, Pondella charges 29.9%, he will give a song and a dance, act like he is your friend, when he is not.  Also let all buyers know this, if your vehicle is up for repossession, there are strict laws as to how and when a repossessor can get the vehicle.  Florida is a "Peaceful Repossession State", that means that the repossessor cannot breach the peace, if you tell them to leave they must leave immediately.  Repossession is a civil action not criminal therefore your sheriff's department legally cannot get involved.  If a confrontation escalates it is trespassing and local law enforcement needs to immediately arrest the repossessors.

Stand your ground as consumers.  You have rights too.  Repossessors cannot enter onto property that is fenced/gated/locked.  Although some law enforcement will cite that they are acting as an agent for the lienholder, they cannot enter your property illegally.  However, they can get it without circumstance or complaint from a public place.  Search your state's repossession laws.  You would be amazed at how well they will take care of you.  Read your contract thoroughly there are only certain things that the repossessors can do and that the lienholder can do as well.
