Complaint: My name is Kimber Roseberry and I read on your bio that you focus on investigative and consumer reporting. I'm not sure if this is in your area but I have an issue with Sensation Spas of Nevada.

On 9/9/2006 I purchased a spa from them at a purchase price of $4,243 which I paid for up front. The spa was delivered on 9/18/2006 and it was supposed to be brand new however it arrived with water leaking out from the jets and the bottom was scratched up and dirty. The cover for the spa did not fit and it was a used cover.

The owner's manual was 5 pages of stapled together hand written instructions on how to work the spa. I refused delievery of the spa but the delivery company left it and told me I needed to speak with the company directly. The spa arrived at 9:30am and I called Sensations Spas in Nevada at (702) 396-9093 and there was no answer or voice mail system.

I called their corporate office in California to only be sent to a technician who told me to fill the spa. After filling the spa I discovered that the jets did not work, the heater did not work and the jets only had one setting of low and loff when the sales person (Cindy) and the owner's manual said there should be a setting of high and low and off.

Upon filling the spa, the technican told us ways in which to make the jets work and nothing was successful. After 5 hours of being plugged in the heater read 99 degress but still felt like 65 degrees. Around 3:30pm I received a call from Tammy in corporate and she only wanted to repair the spa and not return it. I told her that I purchased it brand new; and this spa was broken and not brand new and frankly looked extremely horrible. The underneath had cardboard protecting the motor and sides and the entire bottom of the wood paneling had writing and scratches all over it. I wanted a new spa or my money back and she refused and only offered to fix it.

I decided to get my lawyer's office involved and we decided that I wanted my money back as this company was not customer friendly or compliable with my requests. On 9/19/2006 my phone rang and I received a call from Michelle at the spa company and she said they were going to pick my spa up at 1:30pm and my card was going to be credited the money that I paid for the spa. By 1:45pm the spa was gone and I called the corporate office to speak with Tammy to see about my credit for the spa that was now out of my possession.

Aproximately around 4pm I had not received a phone call from Tammy and so I called her. She told me that she did not have confimation of the spa arrival to their factory and therefore she would not credit my account until the next day. I told her they took the spa and I was entitled to my credit. She said she did not care if I ever got my money back and that she would do it when she felt like it and that I could file a police report for theft as she did not give a sh** about me or returning my money. She then hung up on me.

On 9/21/06 there was a credit to my account of 3,394.40. I called Tammy in corporate (805)343-9904 to see why I had not been credited back the full 4,243.00 and she informed me that there is a 20% restocking fee and she would not speak with me anymore.
