The law allows for Credit/Debtor agencies to give the name of their employer freely to anyone who requests it. In fact, the current law states that they must give the name of their employer if it is requested. I have requested the name from creditors calling my line and have been notified that since I am not the person in debt, they are not allowed to tell me it. Thats right, I'm not the person in debt, I'm just the person to call. I have informed them that in no uncertain terms the law requires them to inform me of their employer, and still they deny any responsibility. I have spoken to the supervisors at Portfolio Recovery and received the same result. So I took the next step, which was requesting they not contact me again. I have made it a point to let them know that it is the law that they not contact me again unless they believe I erred in giving information regarding the person they are trying to collect against's whereabouts. They claim that there is no such law, and that they only have to wait ten days before calling me again. At which point they said that they will be giving me a ring. So I said to hell with that, I actually went online and spent a few minutes looking up the law, called them back and told them in no uncertain terms not to call my line again. They said that they underwent 7 days of training... Sad that 7 days of training did not cover information that is so readily available, information that was obtained within moments of a search online.

So I have taken to a new tactic, I have written up a little script to use when dealing with them, and made copies of the law that states they cannot keep calling me and calling me when I am unaware of the location of the person they are looking for. Part of my script is informing them that for customer service purposes the call may be recorded. They might think it is a bluff, but I have the recorder ready. Sure, I might not get anywhere at first, but I'm fairly confident that if I send enough complaints to the right places, they will quit calling me. And if that fails to work, I know I have other legal rights.
