I was recently contacted by portfolio recovery out of the blue concerning an account which was discharged the bankruptcy in 1998. This is the third time I have had to deal with a collection agency trying to collect on this discharged debt. The credit was established in my name back in 1994 prior to me being 18 years by my parents. Because they were paying the bill, using the account, they filed it through their chapter 7 bankruptcy case. The debt was discharged as was all other debt listed on their claim. The company who originally owned the debt, jcpenny sold it to arrow head financial who often being notified of the bankruptcy never contacted me again and I assumed this was over this had to have been in early 2000. I was contacted by another collection agency in 2003 about this same account, again they were provided with the information and I was never contacted again. Now its 2007 and portfolio decides they are going to try to collect on this debt.

I have asked verbally and also in writing twice that this company prove to me that they one own the debt, that they provide me with original documents from jcpenny showing my signature(which they won't have because I never signed any contract for this account). I am being harrassed by these people for an account I never signed up for or used. It is my understanding that it is a violation of federal law for them to try and collect on this debt. What are my options. I have excellent credit and have worked hard to keep it this way. I had to fight with the credit bureaus to get the information concerning arrow financial off my reports. I need to know what are my options.

I will be writing my state attorney general and providing them with this information.
