After calling a phone number that was on an infomercial on TV two Sunday's ago, called Crazy 88, I was contacted by several dealerships. My credit was really bad, but had a large down payment since I had just received my tax return money. I received a call from Chris Micheal at Premier Auto Group in Beaverton. He stated that they were part of the Joessayyes.com and that he could definitely help me get into a vehicle. I told him I wanted to be sure because I didn't want to waste my time. He assured me that they would be able to get me financed with the $2500 down that I said I had.

So, Sunday afternoon, we went to the dealership. We looked at a couple of minivans that he thought he could get me financed for. We settled on the one with fewer miles, but not as many extras. I figured that this was sufficient, there was no need for any 'extras'.

After several hours there we were told that they were unable to finance that vehicle, but there was one other one that they could do. So, they brought this van around and we agreed that this would work for us.

So, I told them that I could put $2500 down and they said that would be fine and then they asked for an additional $500. I told them that I couldn't do that right now. They said, if we have it due in 2 weeks could you do it? I thought about it and said, yes. They said my payment would be $359.00 for 60 months. I signed all of the papers and gave proof of insurance and drove off.

The next couple of days I received several phone calls from Finance companies asking me questions. One of the questions was were I got the money for the down payment. I said that I got it from my tax return. When the second person asked me that same question I told them where I got it from and then asked why that mattered. She stated that it was just a question that they asked.

On Friday, almost two weeks later, I received a phone call from David DeLay, Finance Manager of Premier Auto Group. He told me that they were able to talk the last bank into financing me and that they had denied it originally and had to pay them $1600 in order for them to approve my loan and that I needed to call Paul at Credit Concepts right now. My husband took the phone number since I was driving at the time and I called Paul right away. He asked me a bunch of questions, one being "Have you ever contacted an Attorney?" I stated yes. He asked me when and what for. I stated that I had looked into filing bankruptcy about a year ago but found out that I couldn't since I have student loans and would have to set up a repayment plan. We spoke a little more and then we ended the conversation.

Saturday morning we left for a spontaneous trip to Newport. As I was driving I noticed that I didn't have any service on my cell phone. I have cricket wireles and after you go so far away from the metro area, you don't get any service. With all of the excitement with my 3 children (one of who's was the first trip to the beach) I forgot to call in from my husbands cell phone to check my messages but I wasn't expecting any important phone calls. So on Sunday morning I called in a checked them. David DeLay had called 3 times asking me to call him right away that they had secure the loan and got a lowe payment for me. I called him right back and he was not in yet. I left a message with Brian. I then received another phone call from him stating that I needed to call him right away and that it was "good news". I called again Monday (today) morning and ended up having to leave a message on his voicemail since he was in a meeting. I told him that I had tried to call him on Sunday morning and left a message.

I finally received a phone call back from him Monday afternoon and made arrangements to come to the dealership between 5 and 6 p.m. When I arrived, I left my 13 year old in the car and went in to sign the new papers. He started by asking me if I had mentioned filing bankruptcy to the financing company. I told him what I had said about looking into it over a year ago. He said, well they decided not to finance the vehicle and that he was going to "unwind" my deal.

I asked him why he lied to me on the phone to get me down there and that I had my child with me and how was I supposed to get home now. He said, well we will arrange a ride for you. Then I asked about my $2500 down payment and he said that I would get it back MINUS the 'rental fee'. He said I signed a paper stating that I would pay this amount of $25.00 per day and .35 per mile if they were able to get me financed. I asked to see the paper that I signed regarding this. He handed me a blank copy of one and I told him that I wanted to see the one that I actually signed. I told him that I don't doubt that I signed it, since I signed a lot of papers that day, but I would still like to see it with my signature. He took it out of my file and held it up so I could see it and stated "I can't let you have it because you could just take it and then I wouldn't have any proof" I scoffed and stated that I wasn't that kind of person and then he put it back into my file.

After calling a friend for a ride, since I decided that I didn't want to accept a ride from them, I went in and asked if I could please have copies of all of the papers that I signed. He stated that he already sent them over to the Business Office. I told him that I wasn't leaving until I had the copies of the papers. I waited for about 1 hour and then I went back into his office and stated that I felt I had been very patient and that I wanted to have the papers. He stated that he had 4 deals backed up and he was the only one there. I told him that I was the first one there and have been treated very unfairly. As he was calling someone for assistance he stated, Mandy is in my office and wants her papers. I thought to myself and stated to my friend that I was suprised I was know on a first name basis with everyone there. I asked him for his business card and for his supervisors name. He gave me the name of Brian Johnston. Then he stated that Shawn would be with me in a few minutes and that this was his boss. So I asked him was Brian his boss or was Shawn. He said that Brian was the GM but that he was off today and that Shawn was the next in line.

Within minutes, Shawn walked past me and came back with my file and handed to David. He took some papers out and I asked him to give me the copy of my debit card that they had since they were going to take out the $500 from it. He gave it to me and then went to make some copies. When he returned he handed me 5 copies. I looked and them and stated that I knew I had signed more than that. He stated that I should have all of the OTHER copies in the envelop that he had given me the day I purchased the vehicle. Knowing that the law is that they must give you a copy of EVERYTHING that you sign I looked through them and saw the one about the rental fees. My friend held up the paper and asked him if he just stated that he didn't give me a copy of that paper when I signed it and he stated 'no'.

I am not upset that they couldn't finance me, I understood that part of because my credit is really bad, but what makes me furious is that he lied to me to get me down there and then they took $636 for rental fees. I just want my money back and to move on from this experience.

The only form that he explained to me while I was filling them out was one that stated if I was not able to get financing based on a false application that I would forfeit my $2500 down payment. I asked him specifically what would happen if I couldn't get financed for reasons other than falsification of my application and he shrugged his shoulders and said that I would get my money back. Not one time did I get the rule about rental fees, etc. This is, in my opinion, very bad business. I had originally referred a couple of friends there but immediately called them and told them what happened to make sure that they don't go there. I never once received an apology. I don't understand how it took 15 days to find out they couldn't finance me. I took a long trip over the weekend 100 miles each way that has now cost me .35 cents per mile. If I would have know that this was a possibility I would not have driven on this trip.

Bottom line is that I just want my $636.00 back and all will be well. They don't need that money. They are just going to turn around and sell that van to someone else for more money....it just doesn't make sense.

I would love to hear back from them....as a matter of fact I DARE them to respond.

After sending a letter with a ton of supporting documentation, the GM contact me and refunded my money that was taken.
