 In 2007 after my house burnt down i saw an advert for Sears. I filled it out knowing i wouldnt be approved for a credit card. Well low and behold i was approved. My first and last credit card ever. I used it to buy $30 in products. When the bill came in i paid in full so i wouldnt have a balance. Then i threw the card away. Since it was my first time having a credit card i didnt know i had to call them and cancel the card. Well so after that never heard from them ever again. The SOL(statute of limitations) in my state is 6 yrs. 10 yrs later. Monday i got a letter in the mail. It wasnt delivered by a sheriff. It wasnt on any special letterhead paper. It looked like a zerox copy of a letter. On top it says Pressler & Pressler. And in the beginning says subpoena questionnaire. Its made to look like a court paper. And it was addressed to my old last name. It basically said i have 14 days to answer the questions like what is the total amount of my assets? How much do i have in my bank accounts? What is my vehicle worth? If the sol is 6 yrs to collect on credit card debt. How is it that i get this letter of judgement 10 yrs later. Also i have access to my credit report all the time. This isnt even on it. Which is weird right? If i owed on this it would be on it. The Sears card was paid in full. The letter says i owed $736 plus fees come to $988. Also said if i didnt send them back the questionnaire answered truthfully that they will prosecute me and put me in jail. Of all the people i know none of them has ever gone to jail for credit card debt. I was told to not fill it out and send it. Coz once you sign it and date it and put your personal info that they have power to freeze your accounts. So i threw the paper away. The next day the mail lady tried getting me to sign for it. I told her nope. Im not signing anything. So shes like you refuse? I said yeah. And she left with the letter. I told her if anymore from this name comes send it back to them and she said ok.

 So ive recently called Sears and spoke to a woman in collections. She was able to check yrs ago when i had a sears credit card. I asked her if there was ever a balance and she said that it was paid by me and closed by me. So this debt that Pressler and Pressler has on me no longer exists. They also havent sent me the original form that i signed when i first got that credit card. I want to see proof that i owe this.

A judgment may or may not show up on your credit report.  Check your public records. Sears is known for getting judgments against any amount of debt no matter how small. The judgment period is usually 20 years and can be renewed another 20 years if unpaid.  Some jurisdictions have a 10-year jurisdiction with unlimited 10-year renewals until paid.  Even if Sears goes out of business, the money for the judgment is still owed and can be collected. Looks like someone hired a collections agency to collect on your judgment. First thing to do: check your public records to see if there is one.
