Priced Right Tree & Lawn Service Jeffrey A. Diebold, Jeff Allen Diebold, Jeff Diebold. WARNING -PRICED RIGHT TREE & LAWN SERVICE JEFF DIEBOLD SUES PEOPLE AND KNOWS THE JUDGE AND HIS WIFE WORKS FOR SEDGWICK COUNTY. JUDGE LOOKED AT JEFF'S PAPERWORK BUT NOT MY PAPERWORK. I SIGNED WHAT I THOUGHT WAS AN ESTIMATE TO TAKE OUT A DISEASED TREE. CERTIFIED ARBORIST LOOKED AT TREE AND SAID IT WAS HEALTHY. WHEN I TRIED TO CANCEL THE JOB, JEFF SUCCESSFULLY SUED ME IN SMALL CLAIMS COURT FOR $719.50. AND HE DIDN'T DO ANYTHING. HE IS SUE CRAZY AND MAKES MOST OF HIS LIVING THIS WAY. ALL THE LAWSUITS AT THE COURTHOUSE HE INITIATED ARE OPEN TO THE PUBLIC TO READ.. Wichita Kansas

Jeff Dibold told me our maple tree was diseased with boars and there was no cure and the tree would come down one way or another. I thought I signed an estimate because he was so nice and said he was a "christian". I trusted Jeff because he sounded so certain about it. I had a certified arborist look at the tree and found it to be completely healthy. When I called to cancel the agreement, Jeff successfully sued me today in small claims court for $719.50 and he has many similar lawsuits and the judge knows him. The judge didn't look at my report from the arborist but only looked at Jeff's paperwork. Jeff Diebold makes most of his living suing people and there were at least a dozen lawsuits on file at the courthouse. I was wrong not to read the fine print but he held the clipboard in both his hands and asked me to sign and I should have taken the clipboard and read the fine print. Jeff Diebold told me his wife was waiting on him so I hurried and signed faster than I should have because I didn't want to keep his wife waiting.

I called you the night before because it took several days to get a certified arborist to look at the tree. My husband said we would go with what the certified arborist said on whether to go ahead and remove the tree. You said the tree would fall over in the next big wind. It is very close to the house and I was worried sick. You did work here before but both times I nver read the fine print because I truly trusted you and thought you were a good person. I asked you if you had another job you could move up and you said you had nothing scheduled for the rest of the week or anytime soon. You told me I would still have to pay all that money and you weren't going to even try to find another job to do the next day. You own your own trailer and use your own tools, I've noticed. It was after you said you were going to take me to court then told my husband how you won at least a dozen lawsuits that he hung up on you. I put him on the phone because I was to upset to talk to you after you let me know you were going to sue me.

Court was a very hard experience for me. I had a very dear friend die a week before the court date and I never got to the hospital to see her because I was trying to prepare for your lawsuit against me. And it was a waste of time anyway trying to prepare for a lawsuit against you because you do this all the time to people and you just have it all sewn up. It was my first time in court so I was anxious and wanted to have my husband beside me because I'm not a pro at this, like you are. Who makes a living doing tree work and doesn't have any other job scheduled for the rest of the week or ANYTHING scheduled in the future? Doctors' offices call and move up appointments when they receive a cancellation. It was Sunday afternoon and you couldn't call someone else needing work done and get started sooner? The certified arborist said he has people cancel once in a while and he doesn't go after them in court. He's the one I'll call next time. I hope you enjoyed all that money for nothing.

We had previously done work for this customer on the same tree, trimming branches that were hanging over the neighbors drive.  The same exact work agreement form was used on that job as was the one for this project, so she was well aware of the work agreement.  Customer called again to address same tree, stating the tree was a mess and low limbs hanging all over.  I went to look at the project while on my way to pick up my wife from work.  The customer stated the tree was a mess.  I showed her where there was eveidence of bore worm damage (so regardless of her claim anyone else told her the tree was healthy, I showed her where damage had occured).  She

asked if the tree needed to come out.  I told her I will never tell a customer a tree has to come out, only show them and explain what I see.  They are the ones that have to make that decision.  She stated well the tree is just a mess and I want it out.  She was given a price to remove the tree.  All customers are told before signing the work agreement that it is not just an estimate but a work agreement to do the work.   (to do wqork is even underlined on the agreement.  We turn down other customers for that time slot and thus if the agreement is cancelled payment is still due. (Please note: We are no different than a doctors office or hair stylist who charge for missed appointments).

  Customer stated: Oh I want the work done. Not only did she want that work done but after signing that work agreement stated she had work she wanted done in the back yard (which goes to show she had plenty of time to read the agreeement, beyond the above explanation).  A price was given for the work to be done in the back yard and a separate work agreement was filled out and signed.  The evening before work was to be done I was notified she didn't want the work done, claiming they had an arborist tell them the tree was healthy.  It appeared from the conversations with both her and her husband that she had not discussed taking out the tree with him before hand.  I

reminded her of the cancellation information plainly stated and addressed before signing.  During one phone conversation she stated she wanted to work thigns out, yet her husband grabbed the phone and stated we aren't paying you anything and hung up.  I still had to pay my help for the days work, as well as lost income. I filed action in small claims court.  Yes there have been others over the course of many years that presented a similar situation for which action had to be taken on those as well for the above stated reasons.  Every court action one may see in the court records are for the same issue of cancellation.  They have always been a hands down situation awarded in

favor of the company.  The judge presiding over this case had also presided over another similar case in times past so he was aware of my agreements.  It was not that he didn't want to see her information, but he kept trying to tell her it didn't make any difference.  She signed a work agreement that plainly stated as it did.  She tried claiming that she has anxiety or some issue and asked if her husband could stand beside her.  Throughout the proceedings the judge continued to tell her all her other claims were useless and he didn't want to hear them.  He had explained at the start of the court sessions that if a person signed an agreement he didn't want to waste time with other excuses. 

She paid what was due in court that day and has made it a point to post her story, etc as many places as possible. So choose as you will, but please know the whole story from information contained in this reply.  Contact us for any questions you may have.
