I have been aware of the reported complaint on your site; I finally feel there is time to respond to it. As you have suggested on your site it is how we respond to a complaint that says a lot about us. Like every statement there is some truth, but how much truth is determined on the mental state of the one who posts it. When things have been written in spite and hatred it is very easy to lash out at another, saying all manner of things. I want to put before the reader this, have you ever had someone not agree with you, has that person said things that were not true? Even the people closest to us can say things that can be very hurtful. So if this is the case for those that are close to us, how much more and outsider. If someone who does not agree with you was to put information on a site like this site, and was not totally true or accurate would that bother you? I feel if someone hides there identity this should give us our first clue, why hide. Kevin, Owner of All Phase Garage Door is the author.  I hope you never have any disagreements with this company.

So given this I would like to share my side of this complaint, your organization  seems very fair and open to all sides in how you deal with each complaint. I would like you to know that Primary Construction LLC has gone out of business as of December, 2009.

To start this off I have attached two letters dated Feb, 18 2010 & April 2, 2010. These letters were addressed to my subs that took care of me. Kevin received these letters as well. I took it upon myself out of respect for my subs to write them. I am not aware of two many contractors that have done this. I have added these letters for several reasons, first to help with my case and to show what type of person I am, verses what the complaint portrays me as.

At the time I was closing down Primary, Kevin made contact with me about his invoice. He did call and he did leave a note on my door step. I did make contact with Kevin to ask him to provide me with the invoice for the work he had done. All of the office paper work had been boxed, Kevin did provide this invoice. I let him know again as I did in the two letters I sent. I am not going to forget my responsibility. If I did anything wrong it was I did not communicate with him as much as I should have. I guess I felt I sent two letters and have spoken with him on the phone. Kevins complaint stated I received payment for the job, I did receive payment, but I was so far behind at that point the money was gone. Please see my attached letters, they explain the situation. I had my hands full at this point. Just when I thought it could not get worse I was audited for three years. (I came out winning, which should say a lot)

At that time Kevin started to do some strange things he should not have done. ( Out of respect for Kevin I will not lower myself to rip him apart) It left me no choice but to file a harassment order against Kevin. Well this made Kevin very upset he text me, now watch what I am going to do. This is the time he made the posting on your site, after he had done this he again text me your site information. I dont feel going forth will help my case with you further. I went out of business I have since paid three of the subs and am paying Kevin at this point. My intention has never been to walk away from my responsibility. I think that this posting was done out of revenge for my filing a harassment order against Kevin. He was well aware I had fully intended to make good. No matter what is done by me in the future. I will do my best to make good, that is more then most companies that have gone out of business are doing.

I have no regret; many companies have gone out of business. Look what is happing in our government, not to mention Wall Street, talk about rip off Please see attached letters, of my hearts true intention at that time.

Too all Subcontractors of Primary Construction

I am writing this letter with much regret. I am sorry that it has taken me so long to inform you personally as to the status of Primary Construction LLC.

Well as of the 31^st of December, Primary Construction LLC closed its doors. We could not hold out as work decreased.  As you well know many of our friends in the construction industry, have not been able to weather this storm. My heart is heavy, due to the fact that we still have some outstanding invoices.

Well the purpose in writing this letter is to let you know that those of you that have outstanding invoices, I am not forgetting my obligations my heart is to pay these invoices and not to walk away from them. I cant tell you when, but I will do my best to keep you informed in the future. At this time I am still in shock, and have not thought of what is next.

I have valued your friendship in the past, which is why this has been so difficult. I want to say that I am so sorry that you have been caught up in the closing of Primary. I can assure you that I had the best of intentions, right tell the end. Problem is that I held out to long, with a hope things would turn around.

For those of you that worked on the ________ project. I was working with the insurance, who at the time told me that, I would be receiving the last payment. So I had made calls letting some of you know that you would be getting pay. Well that payment was stopped by Mr. _________You maybe contacted by him or his attorney. If you have not you may want to make contact.

Again, I am so sorry for the inconveniences this has caused you.

I made mention in my last letter, dated, February 18^th, 2010. I would do my best to keep you up to date as things progress. Now that things have calmed down some. I feel, given the situation you have a right, to have some blanks filled in. You have invested time and money into Primary. Some may not care, but for those of you who do, please hear my heart.  

What has transpired has sickened me. Not to mention, listening to some of the lies and gossip. I want you to know, that I absolutely want to make good on any moneys that I owe you. It has never been my intent to have work done, only to have it not paid for, (Contrary to some opinions). I happen to be a person who cares about my reputation.

I hope this will stand about how I truly felt and feel.

Though the amount owed yet to be paid in full remains. A portion has been recently been received in effort. And though I do not believe any of the content (based on facts) of my report to be slander, I agreed in an anti harassment hearing with the petitioner on 04/02/10 to request that my report be removed from ripoffreport.com. I do hope that Mr. Brocatto is a man of his word, and I do have faith that he will work toward fully resolving his debt with me. I hearby ask that my report be removed from this website.
