I would like to take the opportunity as a buyer to exerce my rights in sharing my very bad experiences I had with the company Print On a Dime Inc. and its seller Emery Nelson.

The company, Print On a Dime Inc. sells Continuous Ink Systems, bulk ink and refillable cartridges with smart chips among other products. I have decided one day to purchase a set of 6 empty, EPSON R200 compatible refillable cartridges after reading information on his web site, which claimed that these cartridges help you save on ink and make it easy for you with its auto-reset chips. The smart chips in question are advertised to reset to 90% capacity (once they have reached the 10% level), for your printer to avoid going through a cleaning cycle, which would normally consume 3% of ink for each color. When a printer sees detects ink levels going at 100% it assumes new cartridges were installed - The whole idea behind the smart chips resetting to 90% is for you to conviently refill the cartridges while still in the printer, avoiding the unecessary cleaning cycles and saving you money on wasted ink.

Prior to receiving my order I have e-mailed the seller, Emery Nelson many times and have gotten a prompt reply to my questions, the very same day. He quoted me a price of $42.00 for 6 empty cartridges, which are basically made of plastic and contain a smart chip and $10.00 for shipping to Canada via standard USPS Airmail Parcel. At first I found the price to be excessive for empty cartridge and the shipping to be inflated, but I did accept his quote thinking that in the long run the money saved on wasted ink would pay for itself, and because of the convenience in refilling the cartridges without removing them from the printer.

I filled all the necessary forms on his website and read some information about the shipping, which stated that orders are shipped using USPS or UPS (as determined by the seller) and that a delivery confirmation would be sent to the buyer. I felt safe at the time because that represents proof of shipment and it allows me to track my order. I have also e-mailed prior to the sale and asked if I would receive a tracking and was told that yes, I would receive a customs/tracking.

I placed my order and sent a payment to Emery Nelson of Print On a Dime Inc. using my PayPal account - Shortly after I received an e-mail confirmation from Paypal and Print On a Dime. At no time did Print On A Dime send me any official / numbered invoice reflecting my order and the charges (other than the paypal confirmation and printonadime's website confirmation). Days have passed and I have not received any delivery confirmation / tracking number so I e-mailed the seller, but from there on all e-mails sent to the seller were not responded promptly and it appears that he would avoid certain concerns and questions, where I would often have to e-mail him again and ask the questions again, and in my opinion getting excuses in return, which at the time his reasons seemed valid and I accepted them. I did get a customs declaration form in one of his e-mails.

After a few lengthy e-mails and when realised that I was upset
and told him that I may consider opening a complaint to Paypal,
he sent me this time a scanned copy of the actual customs declaration form and a long explanation - I tried tracking my package through this number through customs and Canada post to no avail - The number on the scanned document did not match the number he sent me by e-mail a few days after my order was placed, which was a typo on his part - Not a problem. Either way, both numbers could not be located or tracked.

After questioning and more e-mails back and forth I was informed that there is no delivery confirmation as he used USPS AirMail Parcel and according to him, this type of shipping cannot be traced when sent outside the U.S. No mention of this detail on his website - I think it would be essential for a good seller to inform customers that shipments outside the U.S. cannot be traced using Airmail parcel. I feel I was not informed properly by the seller. Also, in sending my money through PayPal, I left a message to the seller to have the parcel insured and I have tried on more than one occasion to ask him if he had done that, and never got a response in return - It was obvious to me then, that the parcel was not insured - Seller failed to address my request and sent the order anyways, without returning e-mail telling me whether insurance was included or would cost me extra. I was later informed that he choose this method of shipping for me to avoid paying too much for shipping, which is unacceptable to me considering I paid $10.00 already which is a lot considering the very small size and weight of the goods I ordered. Questions were avoided and I was not informed properly on this matter, resulting in a misunderstanding.

10 days later I finally received the order and to my big surprise noticed that on the box it said "U.S. Postage paid $3.95" The box itself was fairly big considering the item inside took so little space. Upon opening the box, removing the shipping sheets inside and inspecting the items I noticed the empty cartridges where sitting there tied with an elastic band, unprotected from dust. They were not even sealed or placed in a box. The bottom of those cartridges had ink on them as the seller tested them based on a request I made asking him to make sure the cartridges are tested to work on the EPSON R200, where I meant tested by the maker of the cartridges - he interpreted this as me wanting him to test them, which I appreciate, however he could have sealed them and packed them better. I was upset about the fact I paid $10.00 US for something that cost $3.95 to ship. The gap is huge and his response was that he filled custom papers, the materials used, sending box to post office, etc. In my opinion it would not justify such a charge, even for a handling fee it is excessive, in my opinion, considering the cartridges themselves are expensive, eventhough they came with 6 syringes, needle tips and a disc.

I proceeded to refilling my empty cartridges as per seller's instructions, to the letter. Everything went well and it was easy. I then placed the cartridges in my printer, removed vent plugs and ran a few cleaning cycles later I was ready to go.

I use my printer regularly for heavy printing jobs so my ink runs out quickly. Along the way I noticed that every 2nd day or so or every few print jobs, my printer would go throug a short cleaning cycle, which wastes about 1% of ink of each of the 6 colors. This adds up considering I use printer everyday. I have informed the seller about this and was told that the chips used in my cartridges are part of a large batch sent to customers and that no complaint was received and there is nothing he can do and wish he could offer more. He keeps reminding me that he never gets complaints. I then proceeded to using my printer as I normally would, until eventually, to my big surprise I see that one of the colors has reset earlier than it should, when I still had 20% ink left, when it was advertised to reset when ink would be 10%. After looking closely I noticed that chip reset itself to 100% capacity! My printer then went into a cleaning cycle as it thinks that a new cartridge was put in! A few prints later, some of my other colors started resetting too, to 100%, engaging my printer, again, into a cleaning cycle, wasting more ink of previously reset colors, all in all, about 6 more cleaning cycles as other colors followed, wasting a total of about 18% of my ink in unecessary cleaning. Print On a Dime has clearly advertised that those chips would reset to 90%, NOT 100% - avoiding clean cycles. This was not the case with the product I received - At that point I was very upset, and after the seller made it clear that he cannot do anything more and that he did not get complaints, I did my own investigation and research into the matter only to find out that other people like me have complained about the SAME issues of chip resetting to 100% and unecessary cleaning cycles!, complaints dating as early back to 2005 as posted on vcdhelp.com by some individuals. Given the many unfortunate circomstances, I feel that the seller has not been honest and cooperative in light of the situation and feeling I may not reach an amicable resolution to my problem I opened a dispute with Paypal and escalated it to a claim as I was tired of going back and forth with the seller. Minutes later I got a response from Paypal denying my claim and closing my case without as much as taking the time to get my side of things, claiming that according to their guidelines, claims can only be made in regards to non shipment of goods - Which is not true, considering it is very well stated in their policy that a buyer may file a complaint about a product received significantly different. Where is the buyer protection that PayPal claims ? I think it is important to expose sellers who make allegedly false claims/advertisement about products being sold. His product has caused me a lot of frustrations and a lot of wasted ink, which is quite the opposite of what they claim. It is clear that the product is not functioning as advertised and the seller has not shown good faith in resolving this issue. I hope that through this testimony, people reading this will be better informed. There are federal laws in regards to false advertisement and misrepresentation - I hope that Print On A Dime will accept responsibility in this regards and honor their claims as per there website and send me the product I paid for or refund my money in FULL, including shipping.

After numerous e-mails seller has agreed to inspect my cartridges to see if they can be fixed or replaced and said I may have received defective chips. I have refused to send product back because of the $20 shipping it would cost me. I do understand and agree that the seller cannot do anything unless he receives the product back. Product is still in working condition, and I would recommend it to anyone, except the chipset does not reset on its own, requirse you to turn off the printer and resets back to 100% causing wasted ink in cleaning cycles. It is difficult at this point to determine whether seller is aware of this or not but given his reply and offer of discount on my next order I would assume that this is an unfortunate bad luck and that I may have ended up with bad chips.

The case is now closed and we have both reached an understanding on this matter.

UPDATE April 1st 2007,

After numerous e-mails to seller being ignored I decided to open a new account with gmail and send him a sales request e-mail from there, was replied to promptly, then I confronted him about this. Seller replied very angry claiming he has no obligation to reply to my e-mails and claims harrassment - Seller also claims I tricked him into sending me an order using the same method of shipping and trying to make me as an unreasonable buyer/scammer indirectly when it was never my intentions whatsoever! He has threatened me not to contact him anymore about this eventhough it is evident he sent me a product that does not fit the description - He goes on saying that I made a false claim with paypal eventhough I was very clear about my claim and have proof.

Now after all this dispute the seller claims that the case is closed and business transaction is complete and that he will contact his lawyer about all the e-mails and what he claims are "threats" when all the threats I made was to file a report with the FTC, BBB and take all legal means necessary to expose my case, I don't consider this as threats - and if he had responded to my e-mails and not ignored me I would not have e-mailed him several times. AT this point the seller requests that I send the product back to him, at my expense, and upon testing and reviewing the product he will decide on the outcome otherwise case closed. At this point I don't feel I can trust the seller.

I would like to stress that this report reflects my experiences with the seller and my opinion that the seller is falsely advertising his products based on the unfortunate circomstances surrounding this order. Seller has a 100% positive feedback rating and a power seller status on eBay and I atest and stress that my testimony is accurate and that my product is not working as advertised and that in no way I did trick the seller into sending me another product - I did tell the seller that I would not spend a dime to send the product back without getting replacement chips/cartridges first !

I will take a few days to think of what to do next but it seems it is a case closed and I am short $52.00 US and facing legal threats from the seller because I merely stated I would exerce my rights as a consumer who feels ripped-off.
