I originally signed up for a year long fitness membership in Dec 2007. After two sessions I came to realize that

1) bait and switch with trainers. I had one good one and then three terrible ones that...

2) Only interest was female clients. who they flirted with most of the time

3) very apathic towards you and didn't really give you any advice worth knowing.

So I quit in Feb 2008. I sent a letter to them requesting to quit and to stop billing me. Naturally I kept getting billed until June 2008. At that point I changed my Credit Card number and put an end to it. I got numerous phone calls from collectors and my current total is up to $360.

Calling these people doesn't help. I got the run around. In fact one person said that I only owed 105 dollars. At that point I tried to get it less and that person said "I am not the one to talk to about that, you have to talk to the collection agency". When I called the agency they said "you have to talk to the professional fitness account manager to change the price".

There office location is a mail box.

360 dollars? well how? Well I didn't put in a certified letter to them. By default they will say that I never sent it in, or it was lost in the mail. Both tatics are dirty. Moreover I got a late fee for each month, as well as I somehow got signed up for an extra year. I'm quite certain that even if I did get it certified, that it would have met the trash can.

Keep in mind a startup fee is around 100, plus 360 from debt, plus 210 charged to my card that I didn't want brings a grand total of 670 dollars for three workouts. That means 223 dollars a workout. Seriously...

Indeed I did sign a contract. In their minds that is all they care about. Actually fulfilling a contract is another story to these people.

I filed it with BBB. hopefully something will happen. Is there any suggestions?

BTW they are not getting a dime from me.

My mother works there in the Production Department of their corporate office located in Raleigh, NC. Filing a complaint with the BBB doesn't do any good if they respond within 30 days, and responding gives them a status of "good." It's the same with the Attorney General. You can't complain in person because the address on their contracts is the mailing address to a post office box at the UPS store across the street from their physical location. Clients who find the physical location don't get far since the VP of Operations, Scott Higginbotham (point of contact for the Attorney General complaints), carries a gun for protection and keeps the police on speed dial in case clients get irate.

The best approach that's worked is for clients to hire a lawyer to dispute on their behalf--that and subpoenas--otherwise you'll keep getting the run around and they'll keep your account/contract in delinquent status. You stand a better chance of having your contract cancelled and being refunded your money if a subpoena is delivered by the Sheriff's department to their physical address:

Filing a chargeback won't help, because their Merchant department is trained to utilize every source possible to prove you're not due a refund or that your can't be cancelled without a fee.

My brother is a district manager in Boston, and I can tell you it's not the trainers. They're told to sell by any means necessary and they're yelled at and cussed at if they don't sell.

For future clients, I suggest a "Paid In Full" or P.I.F. because there's no monthly debit to your account. Those are my suggestions.
