I sign up for smart card visa card on line. (www.smartcard.com) and I receive the card under providian bank. Everything work fine they send the bill on time for a few months.

They "forgot" to send the bill for may 2002 and they add late charge fee to my account. They call my wife and harass her that I was late and they ask for a payment right a way "look for the check book and give the check number!!!" The credit card is not under my wife name I don't understand why they talk with her when the credit card is my responsability? and is under my name?
My wife didn't speak english very good and she give them the check no.

As soon as I got home I call providian and I told them that I never receive any bill /statement from them. They said that's my responsability and I have make sure to pay them even if I don't receive a statement.

The due date everymonth is the 9th . In june I receive the letter with the statement from providian. The stamp on the envelope is may 31st 2002 and the payment due date on the statement is may 09 2002 .

They send the statement after they charge the late fee of $25. I ask providian to refund my late fee charge because I didn't get my bill when I supose to get it.
I have the letter with the date and the statement as I state above .

I am wonder if they have 1,000,000 ( one million ) accounts and they do this scam to all of the people they make 25,000,000 in just one month . And they pay taxes to the goverment and they get away with this "legal" scam .
I paid my ballance in full and I close the acccount.

DO NOT USE PROVIDIAN CARD ! IF YOU HAVE A PROVIDIAN CREDIT CARD TRANSFER THE BALANCE AND CLOSE THE ACCOUNT ! YOU CAN BE NEXT !

Each month when you get your statement, make a note of the date it is postmarked, the date you receive it, and the payment due date.

First USA tried the same BS with us several years ago - e.g., the statement closing date would be, say, May 23, but the statement would be mailed on May 31, we would receive it on June 3, and payment would be due on June 6. Given the company's own guidelines, it is impossible to mail a payment (which should be mailed "at least 7 days in advance of the due date" to ensure it's received on time) & have it arrive on time.

Every month, we would get a $25 late fee and our interest rate would get jacked up - and every month we phoned them & they took off the late fee & brought our interest rate to where it should be.

See, they knew they shouldn't be doing what they were doing - and because we called them on it, they had to fix it. We eventually cancelled our card (& several more in the interim - it seems every time we opened a credit card account, the company would merge with First USA!) - but we heard about a year later that a class-action suit had been brought against First USA for that very practice... hmmm...

My advice: First, document all the information about when the statement is mailed, when it is received, and the payment due date.

Second, call them on it! Stand up to them. Tell them that you know what they're up to & that you won't stand for it - you'll cancel your account if you don't get satisfaction. Then follow through.

If all else fails, contact your state's attorney general with the documentation I mentioned above. It's the attorney general's job to protect consumers from bad business practices, so make 'em work for you.

The issue of not receiving a statement in a timely manner does not waive your responsibility and liability to make a payment. Payments can be sent with an old payment coupon, a copy of a payment coupon or simply your account number in the memo section of your check without a payment coupon.
