Let me begin by saying that I had been a loyal customer of Nissan and especially Puente Hills Nissan, and really never had huge issues until the day I walked in on 12/30/2014, it was around 4pm, was taking my current Rouge 2013, for servicing. While I waited, I decided to walk the showroom to see what the new models were looking like. Eagerly the salesperson by the name of Benjamin Verduzco, asked me a few questions, and I advised him of my curiosity. He stated he had some models on the 4th floor or roof of the building, he asked me to have him follow him up the stairs, on doing so I advised him I recently had surgery and the flight of stairs was strenuous, he proceeded to say the only way to see the vehicles was to go up the stairs, due to no elevator access to handicap? I proceeded, we arrived to the top floor, where at the time it was raining heavily, he did not offer an umbrella, nor did it concern him if I waited in the rain, while he ran back down the stairs to retrieve keys to vehicles he was showing me? (at this point I should have walked away) he arrived with keys to a model, he asked me to get in and we headed down the ramp, we were approx. ¼ mile away when the car ran out of gas? He didn’t ask a porter or anyone to pick us up, he had me once again walk in the rain back to the sales floor. He started asking me how I liked the vehicle, I advised regarding color (the women that I am, less thinking how it will drive) and immediately started search, paperwork, and above all the promises. I am not going to lie, I didn’t absorb all he said, and at this point I was at a caught between a new car, and the great xmas offers. At this time he asked his Sales Manager Barry Pugh, to join us, and I asked him not to give me the extended speech of how to break down numbers, and so on; One clear note was that the current vehicle he stated was worth an amount that was not going to help my payment, and that HE WOULD CALL MY LENDER TO HAVE A VOLUNTARY SURRENDER OF THE VEHICLE? He stated that it would be no problem whatsoever, and not to worry. In good faith (Ignorant me) said we would close the deal; with this THEY DIDN’T GIVE ME THE COLOR I WANTED! AND DIDN’T EVEN TEST DRIVE THE VEHICLE THAT WAS SOLD TO ME!! With this, completed (again gullible me, and trusting words from Barry) “don’t worry I will handle it”. The worst night and days to follow, the following morning, as I turn on the new 2015 Rouge and as I turn it, there is this LOUD KNOCKING SOUND from under the steering, I immediately advise BARRY and BENJAMIN of the issue, and they advise me to take it to SERVICE? When I arrive, and attempt to have a word with Barry and Benjamin, they immediately have me sit away from the showroom in a private room to discuss the issue, Barry once again makes his promise by saying “DON’T WORRY, WE WILL TAKE CARE OF YOU, WE WILL EXCHANGE THE CAR, AND THIS TIME WE WILL GIVE YOU THE OPPORTUNITY TO TEST DRIVE IT UNTIL YOU ARE HAPPY, PLEASE CALL US TOMMORW SO WE HAVE THAT VEHICLE” cant deny, I was very pleased to hear this.
For a week everyday, I texted, called and left messeges for Benjamin and Barry in regards to when I was going to get my vehicle because I didn’t want to drive the current defective vehicle I was driving. By the end of the week, I receive a phone call from Barry, saying “KNOW REMIND ME? WHAT WERE WE GOING TO DO WITH YOUR 2013 ROUGE” I was in aww, and said “REALLY?” you advised me and had me bring both copies of my keys so you, stated was going to call my lender to pick it up and that there was not going to be a problem”, at that moment I was very uneasy, He proceeded to advise me that he could not make that call, that I needed to do this, and that it would still not be a problem, yes a credit negative, but no problem, proceeded to advise me to come in the following day to pick up the vehicle of my choice and again to test drive. And to take the time to think if I really wanted the car or not.
Following day came 1/10/15 @ 4:30pm (HELL NIGHT) Benjamin again asked me and my husband to wait and take a seat, yes Barry was busy, regardless of my making a prior appointment with him, Benjamin and a requested DM, which decided not to be present. After a 15min wait, BARRY, BENJAMIN WALK IN AND SIT DOWN AND HE ASK ME WHAT I WANTED, I ADVISED HIM WHY HE NEVER DISCLOSED THAT I WOULD HAVE A FINAL BILL FOR MY OLD 2013, HE PROCEEDED TO ADVISE, THAT THE BANK CHARGES OFF THE ACCOUNT AND THAT THIS WOULD NEVER HAPPEN? I ASKED HIM IF HE COULD MAKE THE PROMISE AND THEN STATED HE COULD NOT SPEAK FOR THE LENDER? At that point I asked him to break the contract, he stated it was too late, I had committed to new vehicle and nothing could be done!?!?!? And stood up and walked away, 10 min later Benjamin came back with the keys to my 2013 and stated I needed to take both vehicles. I attempted to retrieve information from GENERAL MANAGER DAVE BHOJWANI AND ASSOCIATE ANTHONY DCOSTA, which both rudely stated that particular dealership was a franchise and for me to leave immediately and it was a signed deal and nothing would be done. I was very irate, and yes raised my voice, and them they called the SHERRIF DEPT, and the managers asked me to wait for them outside, once again in the rain.
So, now, I have two car payments, 1 brand new car I am very unhappy with due to noise under the vehicle, never want to go back to Puente Nissan again, and feel very attacked by these men.

Every single one of these issues were targeted and abused at this dealership, by these men. Please, as a consumer, client please, please address this issue. Thank you

They made you walk up 4 flights of stairs, they left you in the rain, they made you walk over 1/4 mile in the rain, they actually suggested to have your other car reposessed.  So if you didn't walk away with all of that, would they have needed to do to get you to walk away?

Sorry just based on your post it sounds like a very gullable person met up with an average salesman and you are suffering from what is very commonly known as "Buyer's Remorse".

Now, you probably noticed the big bad word of "reposession".  YES, when you do a "voluntary surrender" that is a Reposession and will show up as a Repo on your credit.  Not only that but you are still legally responsible for the loan balance if there is any remaining after they sell the car at auction.

Oh and as for the mechanical issue, since this is a new car it would be covered under the mfg warranty.  IF this dealer refuses to fix the issue you need to take it to a different dealer.
