April 16 2013, I joined a Kickstarter for 3 shirts and what they called a space suit.  I only signed on because according to thier facebook page they had been producing these shirts as far back as October 2012 maybe longer and they even claimed on facebook to have Corporate Sponsors.

These shirts were to come in a wide selection of bright colors and my choice of 2 different color changing temperatures.  The shirts were to be sold from size XS to XXL.  They were to be machine washable.  They were to be made in America.  And they were to be ready by July 2013.

Each and every month from July 2013 up to now and continuing they keep saying the shirts are ready to ship or are shipping.  Shortly after, they announce the shirts did not ship because either A, they did not dye because the machine broke, B the shipper dropped the ball or C they are still waiting for the shirts to arrive in country.

They have mailed out about 100 shirts they had made from rejects being very bad dye jobs.  But that does not the 8,556 people who backed the project nor does it cover the multiple shirt orders.  Now Radiate/Kenny Crockett is stating that refunds will not be allowed because Kickstarter does not allow it, but in fact Kickstarter insist on refunds if the Project fails.

  1. Is a creator legally obligated to fulfill the promises of their project?

    Yes. Kickstarter's Terms of Use require creators to fulfill all rewards of their project or refund any backer whose reward they do not or cannot fulfill. (This is what creators see before they launch.) This information can serve as a basis for legal recourse if a creator doesn't fulfill their promises. We hope that backers will consider using this provision only in cases where they feel that a creator has not made a good faith effort to complete the project and fulfill.
