My story starts with my wife and I looking to invest in a house or a condo. We came across an Ad in a Russian Newspaper my wife was reading. Investment Opportunity in Costa Rica send e-mail or call 1-800-261-6145 as we thought about some we finally decided to call and find out what was this all about. Mr. Roman Kirillov operated Tico Paradise Properties and webuyrealestate911@yahoo.com Mr. Kirillov proceeded to explain all of what they had to offer. They were selling parcels of land in Costa Rica in which they were going to develop into a resort and if we were to buy now, we could buy low. The contract stated that in order for us to take a look at this resort land we had to buy a parcel, Mr. Kirillov talked us into buying 5 parcels since it was low now. We put down $30,000.00 dollars and mailed a Cashiers Check by certified US Postal Mail on Sept 11. 2007. I flew down to Costa Rica on Dec. 5, 2007 to do the scouting on this resort. I was driven to other plush and developed resort and told countless of times that this is what our development would look like, they would always pull out these artist drawings of this complex. When we were finally taken to our land I knew right away that this was not what we wanted. We were driven to the main office of Paradigma Construction of Costa Rica and we met the staff and Owner of Paradigma Construction Eric Neuvert who was doing all of this development. Paradigma controls all the paper work and the financial ( money ), Adam Barton is the CFO of Paradigma Construction.

All I wanted to do is get home and cancel our reservations for our parcels. In the contract on line #6 that in order for us to terminate we have to send a certified mail of termination letter to Tico Paradise within an allotted time frame. I got home on Dec. 10 and we sent the letter out Dec. 12, 2007. We waited for an answer of which we did not hear of. When I contacted Tico Paradise Mr. Kirillov told me that they did not receive our letter and I told him that someone in his office signed for it. Then he asked where did I send the letter to and I told him to 4366 Auburn Blvd. Sacramento, CA. That is when he told me that they had moved to 2967 Fulton Ave. Suite #4 Sacramento, CA. but yet they had failed to tell any of there clients of this move as the phone receptionist told they did not tell everyone. I sent the letter again and we waited this is when Mr. Kirillov started to tell me that this is the most critical time and that I would have to wait until money was freed up for our refund and that it takes some time to do. Then from Jan. to present all I have gotten from Mr. Kirillov and Paradigma Construction is lies, excuses, and every kind of story about why I have not gotten my refund back. I was told at one time that the money was wired to my account and then it was stopped because they needed us to sign a Release Waiver before we could get our money so we signed it and sent it and waited. I have pleaded with Mr. Kirillov about our refund and as of this date I have gotten the same results. I got an attorney to send him a letter in hopes to get him to understand that I was fed up with his and Paradigma lies and excuses. It got me nothing as Mr. Kirillov lied to the attorney and that he had to talk to his board members about releasing funds and they heard nothing form Mr. Kirillov.

Now I am finding out that I am not the only one who is going through this with Mr. Kirillov and Paradigma. I have found a few more people in the same predicament and they get the same answers NOTHING. I believe Tico Paradise and Paradigma Construction are doing the same as Heaven Investments Holding Corp. did in Sacramento it is a Ponzi Scheme and as soon as I find more people who have been taken by these two Companies we will file criminal charges. I have sent Mr. Adam Barton a letter asking him about my refund and as of yet I have received NO reply, this tells me that Mr. Barton is also in on this scheme. I am writing this letter to RipOff Report so that you can publish it so that people can be aware of these two Companies. Tico Paradise Properties and Paradigma Construction of Costa Rica two Companies you do not want to do business with.

As the Attorney assigned to this case by Paradigma Construccion S.A of Costa Rica and its legal representative, Eric Neuvert, we respond to the declarations and accusations posted by you on the website www.ripoffreport.com, et al.

The purpose of this letter is to state Paradigma Construccin' official position against the slanderous, malicious and tendentious declarations posted by you on the abovementioned website, where you strongly stated a Paradigma' default of an alleged contract, refund denial and Ponzi Scheme among many other false and misleading statements, to the defamation of the Company known as Paradigma Construccion S.A. and its Legal Representative, Eric Neuvert, both as the Legal Representative of Paradigma Construccion S.A and as a physical person. On behalf of the Company and Mr. Neuvert, we declare these statements and accusations to be completely untrue, malicious, and with ill intent. We deny all allegations made by you in your Slanderous internet posting et al, herein mentioned.

You make mention in your statements that you visited the offices of Paradigma Construccion S.A. in Costa Rica. This may be very true due to the fact that it was customary for Tico Paradise Properties to tour the offices of more than one Developer while conducting their property tours in Costa Rica. These tours are designed so that people can actually see these Developers Offices, meet their entire staff of Executives, Architects, Engineers, Graphic Designers, Legal Department, Accounting and the Entire Team. The tours of the Developers offices is designed to give a good general overview of information and in fact to show that we are all solid companies with real intent in our objectives and in fact NOT any sort of Ponzi Scheme. The solicitation of sales contracts is not part of our Tour Agreement with Tico Paradise Properties. Tico Paradise Properties handled their own transaction and agreements solely and responsibly.

Mr. Trujillo, you entered into an agreement with a company known as Tico Paradise Properties, regarding a real estate purchase in Costa Rica. Tico Paradise Properties had actually purchases many lots from our company for the purpose of reselling said lots at their own price point, agreements and procedures. However, Tico Paradise Properties is not related, linked and/or bonded with Paradigma Construccin S.A or its related parties, which means that neither Tico Paradise Properties nor its representatives were authorized to emit any kind of document on behalf of Paradigma Construccion S.A or its related parties.

Paradigma Construccin S.A and/or its representatives and/or Eric Neuvert have never received funds from you and they have never signed or proposed you to sign an offer, reservation form, contract or any other document that could suggest a business relationship. There has never existed a relationship between Paradigma Construccin S.A and yourself, and speaking of such relationship is a slanderous statement.

In order to restore Paradigma Construccion' and Mr. Neuvert' credit and character you must immediately retract your internet postings from their Domains, Search Engines and any and all other attacks that may be considered; state that neither Paradigma Construccion S.A, nor its legal representatives, shareholders, its officers and/or employees, and/or, Eric Neuvert as a Representative or Person, were a contracting party or participating/involved party in the conversations, promises, offers, negotiations, arrangements, and/or agreements made between Tico Paradise Properties, its shareholders or representatives and yourself in other words, tell the truth.

In the past, Paradigma Construccion maintained a business relationship with the company known as Tico Paradise Properties. Tico Paradise Properties is Real Estate Company that works with a hand full of Developers and Builders in Costa Rica, in both the Central and South Pacific Regions of the country. Our Agreement with Tico Paradise Properties clearly states Tico Paradise Properties as an independent Realtor, solely legal for any representations or misreprentations made on their behalf (See Below Agreement with Tico Paradise Properties).

Be it known to all that this relationship has ended many months ago with an official letter of said termination again recently delivered (See below).

With this in mind and according to the Agreements signed by the parties hereto attached (See below given courtesy of Tico Paradise Properties), which is a copy of your actual Agreement with Tico Paradise Properties, one can clearly see that Paradigma Construccion S.A., its Representatives or Mr. Neuvert, have NOT entered into any type of Agreement with you and have never received any funds from you, the Agreement you have clearly is with Tico Paradise Properties, solely.

The aforementioned business relationship between Paradigma Construccin S.A and Tico Paradise Properties, implied rights and obligations for both parties. However, due to a breach of contract and a default situation regarding Tico Paradise Properties, an end has been put to said business relationship, which is now concluded and certainly notified to Tico Paradise Properties by means of a termination letter sent via certified mail. A termination letter has been sent to notify Tico Paradise Properties that they are not authorized to link Paradigma Construccion S.A or any of Paradigma's projects with Tico Paradise Properties or its business, let alone to act as Paradigma's representative or on behalf of Paradigma Construccion S.A. Not to say that we would not reconsider a business relationship with them once they are able to resolve their outstanding issues.

Regardless of the termination and default situation with Tico Paradise Properties, Paradigma Construccion S.A is not responsible for any direct and/or indirect client, lead or acquaintance of Tico Paradise Properties. In fact, according to the signed contract's clause 5 that exists between Tico Paradise and Paradigma Construccin, any of the parties will not be liable for the other party's acts. Contract Clause 5 reads as follows:

Developer is not liable for Salesperson's actions when selling the product. The Developer shall not be liable to the Salesperson for any expenses incurred by the Salesperson or for any of his/her acts, nor shall the Salesperson be liable to the Developer for any expenses of the operation of the Developer's business

This writing is quite clear and it states without any doubt that Tico Paradise Properties is 100% responsible for its clients and for the client's funds (if any), and never received by Paradigma Construccion S.A, as Tico Paradise Properties and Mr. Joe Trujillo, are responsible for the inconveniences and legal actions that this may have caused to Paradigma Construccion and Mr. Neuvert.

You must retract your statements and release Paradigma Construccion S.A and its legal representatives, and Eric Neuvert in all capacities, of any and all liability regarding the purchases, the conversations, offers and/or promises with Tico Paradise Properties, for being those facts directly ascribable to Tico Paradise Properties and its representatives, solely.

As well you state that you have been in correspondence with a one Adam Barton that is employed by Paradigma. Adam Barton left the Company just before you allegedly cancelled your Agreement with Tico Paradise Properties in January of 2008 and has not been employed in the service of Paradigma or any related companies since in any way, shape or fashion. Therefore your allegations that you have been dealing with Paradigma through Adam Barton are untrue and without merit.

Our legal department and legal advisors informed you with two different Cease and Desist Letters up to this date, attempting to head off any legal process, enforcement or penalties, both civil and criminal toward yourself and any related parties, web site hosting, domains et al, that are participatory in this malicious attack on my clients. Your denial to heed these legal letters sent over the past months causes me to remind you that, to maliciously slander a person or corporation is a punishable crime in both Criminal and Civil Courts in both the United States of America and the Jurisdiction of Costa Rica. Your posted comments and untrue declarations has damaged Paradigma Construccin S.A. credit, character and Eric Neuvert' credit worthiness, character and reputation.

You have been properly informed regarding all the information herein stated, but yet apparently you have decided to ignore all notifications, which is why Paradigma Construccion S.A and Eric Neuvert in all of their capacities will be forced to take further legal actions, both civil and criminal, to process this issue and restore these well established names, with the subsequent penalties for your malicious attacks on my clients, unless this matter is resolved immediately.

Please make a wise choice.

Dear Mr. Trujillo:

This Office represents Paradigma Construccion, S.A., a Costa Rica corporation, and Eric Neuvert and we are in receipt of an e-mail that you forwarded on January 18, 2009 to Roman Kirillov, a realtor at Tico Paradise Properties, S.A. It is our understanding that you paid a deposit of $30,000.00 to Tico Paradise Properties, S.A., as the Seller, under a Residential 5-Pack Lot Reservation Agreement dated August 30, 2007 and based upon our review of that Agreement our Clients were not parties to that Agreement.

Please be advised that our Clients never received any of your deposit, it does not appear that you have any information or documents indicating that our Clients had received any of your deposit and, in our opinion, your issue is, therefore, with Mr. Kirillov and Tico Paradise Properties, S.A., which is clearly indicated in your Blog on RipOffReport.com where you constantly refer to your contacts with Mr. Kirillov and his actions denying you a refund of your deposit. We also find it interesting that in the Blog you indicated that you had contact with Adam Barton, who at one time worked for Paradigma Construccion, S.A., but who was no longer employed by Paradigma Construccion, S.A. at the time you alleged that you had contact with him.

Our problem is that you have included our Clients' names in the Blog and by implication you are wrongfully attributing Mr. Kirillov's actions and conduct to our Clients. We find this implication and the inclusion of our Clients' names in the Blog to be false, slanderous, libelous, and malicious with the intent of causing irreparable harm to our Clients' names, reputations and business.

Accordingly, we hereby formally demand that you immediately cease and desist any further actions of this type toward our Clients and that on or before 5:00 P.M. EST on January 28, 2009, you post a retraction relative to our Clients on RipOffReport.com. If you fail to cease and desist such actions toward our Clients and/or fail to post the retraction within the timeline specified above, we have advised our Client to retain local legal counsel to initiate federal and state litigations against you and to seek any and all legal and equitable remedies available to our Clients.

We also formally request that any and all future correspondence or communications from you or your legal counsel be directed to this Office and not to our Clients.

El artculo 153 del Cdigo Penal de Costa Rica, estipula que comete el delito de difamacin de una persona jurdica quien propalare hechos falsos concernientes a una persona jurdica o a sus personeros en razn del ejercicio de sus cargos y que puedan daar gravemente la confianza del pblico o el crdito que gozan.
En su caso ha utilizado la pgina web www.ripoffreport.com, para difamar pblicamente a la empresa Paradigma Construccin y a su representante el seor Eric Neuvert, aludiendo que se le han incumplido condiciones y que se le ha negado la devolucin de su dinero.
Usted sabe que sus declaraciones son TOTALMENTE FALSAS, pues la empresa Paradigma Construccin no tiene ningn negocio con usted y nunca le ha ofrecido un producto a su persona. El negocio fallido al que usted refiere se da entre usted y la empresa Tico Paradise, NO con Paradigma Construccin.
De usted la empresa Paradigma Construccin NUNCA ha recibido dinero, ni tiene contrato o promesa alguna con usted, por lo que su reporte puesto en esa pgina de Internet y hecho pblico es ABIERTAMENTE FALSO Y TENDENCIOSO.
Esta accin delictiva desplegada por usted ha causado daos en la imagen de la empresa Paradigma Construccin S.A y del seor Eric Neuvert, por lo que de manera INMEDIATA debe retirar esa denuncia o retractarse por esa misma va de los alegatos hechos contra la empresa y el seor Neuvert.
Si no se retracta pblicamente por sus manifestaciones, se acudir a la va civil y penal para hacer valer los derechos de la empresa Paradigma Construccin y del seor Neuvert y se le cobrarn los daos y perjuicios que sus comentarios ya han causado, mas los gastos procesales y personales en los que se incurra para limpiar la imagen que usted da.
Si en un plazo de 24 horas despus de recibida esta carta, usted no ha modificado su comentario en lo que respecta a Paradigma Construccin y al seor Eric Neuvert, entonces tomaremos las acciones legales en su contra.
Le recuerdo que de acuerdo a la legislacin costarricense, el hecho que usted est en Estados Unidos, no lo exime de ser juzgado y condenado civilmente en Costa Rica, por manifestaciones falsas cometidas en Internet y si usted es notificado de un proceso en Costa Rica y no se apersona, se tendrn como aceptados todos los cargos y condenado automticamente.
En busca de la paz social y la buena fe en los negocios que siempre ha caracterizado a la empresa Paradigma Construccin y al seor Eric Neuvert se le otorga este plazo de 24 horas para que se retracte pblicamente de lo dicho, so pena de no hacerlo, tener que acudir a estrados judiciales.

The last conversation you had with my attorney was this part of the letter that claims you will be sending or wire money as funds become available. It Jan 18 2009 and you have had our money NOT your money for over a year and we want it back NOW! I want you to go to RipOffReport.com and type Tico Paradise or Paradigma and you will see what is on the Internet. When people type up Tico Paradise or Paradigma my Rip Off Report will be next to your ad as well. Roman this is just one of many more reports to come onto the Internet and it will not stop until you pay our refund and interest and expenses. I have been in contact with the FBI in Sacramento, CA and she told me that I should get the other people that have not had there refunds from Tico Paradise before I send all of the info. to her so that she can have a better picture of the problem and right now I have three people that you owe refunds to. Mr. Roman Kirillov just remember I will not stop. I will see you in court soon enough.

Ponzi Scheme at Tico Paradise Propertiies and Paradigma Construction

I read about Mr. Madoff and his Ponzi Scheme- and I believe that when a man or company takes money in and tells you that by investing with them you will make extra money, and then when someone wants there money they have to wait for new investors so that they can pay the old investor then that what a Ponzi Scheme is and I believe that is what Tico Paradise Properties and Paradigma Construction are doing. They have told me many times that I am at a critical time and that they have to wait until this new money comes in so that they can pay.
