When I asked the salesperson if a permit was needed to install a above ground pool in Sarasota Fl, city limits, Salesperson ( Deuce McCoy ) stated no. I purchased the pool that day on 03/18/07, and they installed it on 03/21/07 three days later.

On 04/06/07, I received a letter from the City of Sarasota code compliance that in fact a permit was needed. We then called Rec Warehouse and we spoke with the manager ( James Bujan ) and he said he would call codes. Upon our return call to James Bujan he stated he did call codes and said that he got into a heated discussion and codes told him we in fact did need a permit. at that point James said he would take the pool back and give us a $1500.00 store credit
( pool cost $2459.93 ) mind you now this is all under 30 days of the purchase, and if i don't have a pool I don't need a $1500.00 store credit to purchased pool supplies.

Then James denied the fact that the salesperson said we didn't need a permit.

Now after dealing with the City of Sarasota Fl they will not grant us a permit. Now I need to apply for a variance which will cost another $1500.00. Which I can not afford, and the city stated that it wont guarantee that they will give us the variance but will keep the money either way, and I'm not in the habit of taking a roll of the dice, which is the way the City explained it.

If the salesperson was upfront and honest and forthright and knew his job, I would of contacted the City of Sarasota Fl for the code compliance guidlines and could of avoided all of the stress this has put me and my family through.

Now when we call Rec Warehouse they hang up on us, and are very nasty.
I fill we have been mislead and mistreated and taken advantage of.

I just want Rec Warehouse to pick up the pool and refund us our money.

#3 UPDATE EX-employee responds

The minimum wage comment

AUTHOR: Spaguy - (U.S.A.)

POSTED: Friday, August 10, 2007

In response to this complaint, someone suggested that the customer should have done his/her own research in regards to permits etc. A a consumer as well as a longtime salesperson, I could not agree more. If you listen to a salesperson about these matters and believe him, you are just asking for it! How do you think salespeople get paid! Besides,if you make any purchase you own it. It is not the responsibility of a retail establishment to be an encyclopedia of do's and donts'. I would consider myself lucky if Rec offered me anything. Now consider this, I am a former employee of Rec Warehouse, for many years, and now work in direct competition with them. I still have to take their side. I can guarantee with certainty that the customer signed an installation agreement detailing all relevant info. As for the minimum wage comment, I know the salesperson personally and I can assure all who read this, he does not make minimum wage. Not even close!!!

However if you want a quality pool, SPA, or anything else they sell, do not believe the tactics of luring you in on price alone in general you get what you pay for! Rec warehouse never change their prices, everything is on sale 365 (not just today) and they never ever sell a spa for the price on the signs, these are just overinflated #'s to make you think you are getting a deal. Most of their so called "dealers" or "mom and pop stores" sell the products that Leisure Bay i.e. Rec warehouse mfg's for less than they do! Quality spas start @ 5k. Anyone who thinks you can get one for $699 needs to remove the rock that they live under and join the rest of us! Gas $3.00/gallon-----Spas $699 ????????

#2 Consumer Suggestion

Contractor should obtain permits for you.

AUTHOR: Mike - (U.S.A.)

POSTED: Friday, July 20, 2007

Always make sure there's a clause in the contract for home improvements that the CONTRACTOR will obtain any necessary permits. Then if it turns out a permit was necessary and he didn't get it, he has to deal with it or give you your money back. Any contractor that wants you to obtain permits yourself is very shady and probably ripping you off.

The other key thing to have in the contract is a "furnish and install" basis. The CONTRACTOR will buy the supplies. Then you don't have to deal with suppliers. Again, contractors that want you to buy supplies seperate from the contract are usually not on the up and up.

#1 Consumer Suggestion

Do your own research

AUTHOR: Cybervee - (U.S.A.)

POSTED: Friday, July 20, 2007

To avoid this situation in the future always do your own research. Contact the city yourself to see if a permit is needed for the work you are having done. Do not rely on the 'expertise' of someone making minimum wage.
