I booked the Red INN in Lancater Pa for a weekend through Booking.com. I indicated that wanted to have a either a room near the elevator or on the first floor. The day we arrived around 4 pm in the afternoon the hotel manger told me the hotel was full and only had rooms on third floor not near any elevator. To top it off they didn't any carts available to transport our luggage. I had to in up going to to the Hampton Inn which cost three as times as much.

It simple as this if you go to the store to  buy a bag of pototo chips and chips are posioned. The store or the company has responsiblity to take care of the demages to the consumer. If you live in the USA and not in another country that is how it  works on this planet in the USA .

Incorrect...

 If you have any issue at all(which you don't, and it will be explained in a minute) it would be with booking.com.

So they should take reponsible of agent not passing information on to them.

- It doesn't work that way.   You are basically saying that any company that has somone sell an item for them, that company is now responsible for anything that the 3rd party says and is legally bound by it.

So let's take this logic out a bit.  If you go into a Grocery Store and the store tells you that the bag of Cookies contains 1 Million Dollars.  But when you get them home and open them there isn't 1 Million Dollars.  Now, based on your logic because the store told you this, and the Cookie Company gets money from the store for selling the cookies that the Cookie Company is now liable and owes you 1 Million Dollars.

You do see how silly your argument is..right.

Anyways...as I said I would explain why you don't even have a complaint against booking.com. 

If you go through and look at their terms you will find that they state that they can not guarantee any special requests, and that you need to call the hotel directly in advance of your stay to confirm it.  The reason is simple.  It is very possible that your room type isn't even available on a lower floor.  It is possible that the only type of your room is not near any elevators. 

After all again taking your logic one step further.  If you had a special request that because of your sleeping patterns you need a room that does not have a window facing east so you can avoid the sunrise.  But if that hotel only has rooms facing east how exactly are they supposed to fulfill that request?  Oh you say..well Booking.com should know everything about the room of every single hotel in every single city that they sell.  Again..that is unrealistic and exactly why it is YOUR responsibility to contact the hotel directly.

Third Party Acted As Agent for Red Roof Inn

Any time a third party is selling anything for someone or a company they become a agent of the party providing  the service of such as Red Roof inn. Red Roof Inn reciecves payment from agent party who represented them. So they should take reponsible of agent not passing information on to them.

You did not book directly with the hotel

Unfortunately you booked through a 3rd party vendor, not the hotel directly.  It is common to NOT get your requested type of room when going through a 3rd party vendor, it ususally says they will try to get the room you want, not that you will get the room you want.  If you booked directly with the hotel you would have had a much better chance of getting the room you wanted.  This is not Red Roof's problem since you went through a 3rd party vendor.
