I was advised to sign a one year contract with a realtor of this firm in order to purchase a home. I did (I should not have).

Realtor and I did not get along, we agreed to end contract. My New Realtor (different agency) advices that a release from Remax Broker is necessary to fulfil all legal ramifications.

I have called and left voicemails PLEADING that this CAROL BOJI send me a written release but got no reply. I also sent emails, no response. I also mailed a letter which wa returned unopened with a return to sender stamp.

This is highly suspicious and I believe the broker is not straioghtforward. Somebody please help free me from this bad contract.

All first time home buyer, PLEASE PLEASE PLEASE, do not sign with these people or at least do not sign a one year contract with any broker REGARDLESS OF WHO THEY ARE.

In reference to the complaint filed by Simbiat (?), it has never been our protocol to not release a client from a Buyer Agency Contract.  We are disputing the fact that his intent to file a complaint against for this act is an intent of maliciousness against our company and our Broker/Owner, Carol Boji. 

It is possible that the person that filed this report misunderstood something in the course of action and process to release them from the buyer agency contract, but since we have no contract on file for this person, we cannot further prove our innocence in this matter with any legal document to attach. 

Our company would never intentially or neglectfully prevent a buyer from using another Realtor under any circumstance and we would not avoid contact with a client in the effort to prevent them from purchasing a home through any other brokerage.  As we have no copy of a buyer's agency contract on file with our company for this person, we ask that you remove this complaint from your Ripoff Report immediately.

Fire Them one year buyer brokerage agreement

As a real estate broker, I am appalled that some agent would have you sign a one year buyer brokerage agreement. Generally these are for a short term (generally less than 90 days) and have specific duties that the agent must complete to earn your business.

I suggest you send a letter (preferably certified with a return receipt signature required) to the agent with a copy to the broker of that office, a copy to Re/Max International in Colorado, a copy to the local Board of Realtors and one to the state licensing authorities.

In that letter, be sure to outline the duties to you, the buyer, that this agent failed to complete (words and phrases like abandonment, failure to communicate and malfeasance really help here).

Your new agent is only trying to help you avoid a future problem, as the first agent could come after you for a sales commission based on the agreement you signed. Getting a release is the way to go.
