Yesterday I check the mail and I get a notice from my rental agency that I now Owe them 105 dollars. 40 For A bounced check and 65 for a late fee. Let me explain something here. My paycheck bounced. This was not due to our company having money, this was due to the bank not depositing company checks on time. There was no WAY I could have known my PAYCHECK was going to bounce. The day I find out about it (the 4th) I call my rental agency and Im told they didnt even know i bounced a check. Instead of waiting to get a notice from them like I was told I went and got a note from my boss stating it was my PAYCHECK that bounced, and a certified check in the amount of my rent and took it to them. I was told that they "might" keep me on Automatic reoccurring debit and to call them Monday.

So, I call Tuesday and Im told that yes, you are still on auto Deb. and that I would be getting a letter in the mail and its "just procedure". Not once was it mentioned that this "letter" Is a BILL for #105.00. $40 for a bounced check and a $65.00 late fee. So I call Debra and Im like, whats up with this. I get that the reason I was late is the 3rd day of the month is the LAST day of the grace period to get my rent in since it is due on the 1st. So I try to get through this ladies head that if they took my check out when it was DUE (the 1st) that I would have never bounced with them nor incurred a late fee. And that even if I bounced a check on the first that I would have had two days to rectify the situation and STILL not get a late fee. All I get told is that I can talk to the "owner and broker" and be at his mercy. I was basically told that her and rob ( my leasing agent) really went out on a limb to keep me on auto debit and the owner will most likely take me off and still make me pay, and if I go to him they will be called out on the carpet for keeping me on auto pay" So she is sitting there threatening me. Nice huh?


I talk to the broker today and hes is the most double taking person I have ever meet. First I get this speal about how fair they are. An example I got was, the grace period actually ends on closing of the 2nd of each month, yet if I bring a check in on the 3rd before the bookeeper gets there then they will not consider it late. I throw right back if the check being there ON the third is late then technically ANYONE on auto debit IS late since the checks dont get printed until he/she gets there. All I get out of this one is a blank stare and being told Im wrong.

I asked him why does he take my rent check out on the last possible day and he states its because they deposit all the checks at the same time and if he took them out the 1st people would complain he is taking them out early. . I ask him, sir, what day is the rent due? He states the first. I then ask him why should it matter what the last possible day the rent is due, shouldnt the rent come out THE FIRST because thats technically when its REALLY DUE. He tells me he does this out of fairness. No he doesnt he does this s**t because if something happens to that check on the LAST DAY he knows the bank wont post it until the NEXT day and they can collect a 65 dollar late charge. Its wrong and immoral.


On top of this he has the audacity to tell ME that I should NOT TRY to take MONEY out of HIS POCKET for CIRCUMSTANCES my BOSS started. So I let him know that if he took out my check when he was SUPPOSED TO then NONE OF THIS BULLSHIT would be happening because I would have only owed the BANK and not some outragious 40 dollar NSF and 65 dollar late fee. I also let him know that if he took my money out on the first then he would not even be ABLE to collect a 65 dollar late charge. This guy would not come off 65 bucks. I even OFFERED TO PAY the 40 DOLLAR NSF even though I know that its only a FIVE dollar charge to try to cash a bounced check.

I did not intend to bounce this check. The way I do my money is I only put enough in my bank account to cover the bills EXACTLY. The rest goes into a money market account and this is in the tens of thousands of dollars. The rental agency even has a copy of the bank statement showing this. This is an account I can touch if NEED be, but it is really for a down payment on a house in my near future and I do NOT want to touch it. Yet, they are still treating me like I MENT to do this.

I hate you REMAX.

Not to mention that my apartment is in DIRECT violation of the DUVAL COUNTY HOUSING CODE. And that I have a copy of an e-mail from my real estate agent stating that " he does not want to fix anything since the place may be getting sold to another broker"

Excuse me? So you are not going to address CODE in my apartment just because the tenant says so and you are going to attempt to pawn this rickety place off on some OTHER rental agency? Geez.

-This place for starters has a CRACKED window.

-My roof LEAKS. I was told a roofer came out TWO months ago and last night I noticed that a TARP is now on my roof that was never before. To me this shows there IS A LEAK and it is NOT FIXED.

-My front door is more than 3/8ths an inch off the ground and is letting in Leaves, bugs, spiders ( I have been bitten once) and lizards. Do you know how nasty it is to find a DEAD lizard in your house? No to mention how much spider bites hurt???

-My back concrete porch is getting lifted up by tree roots. I have feel off this once already. One side of it is at a 45 degree angle.

-I could not find it in the housing code but my whole place is NOT GROUNDED electricity wise. This means that any kind of thunderstorm we have I have to go unplugging everything. It has FRIED one computer and has basically rendered out JBLS useless since they have to be grounded for the touch volume to work. ( no they cannot be turned up any other way)

-I think two windows can open. The others are non operational due to not having cranks to open them with. This may no longer be covered in the code since usually it only deals with ventilation, but it is a fire hazard.


-The electrical outlet in the kitchen is coming out of the wall. I can see the wires, this has never been fixed.

Please, I need help from someone. I have been very nice and accommodating to these people when it comes to them NEVER repairing anything. I have sent multiple e-mails about these things and always get the response " we will look at it" and nothing is ever done. I was even told by the broker today that if the cracked window it double pane he does not legally have to fix it.

Can someone give me some kind of legal advise on what I should do about these people. I want to turn them in to code enforcement but have 8 months left on my lease and really dont want my life to become a living hell with these people. I do not think it is right to not give anyone time to get things in to them on time and I do not feel I should have to pay these outrageous fees when they wont even fix what was wrong before I moved in.

Also here are the e-mails from The landlord ( who is not in the state) Stating that he will get a contractor to address the items and a few other e-mails from Rob the property manager. The first e-mail is going to be my original e-mail addressing my concerns about the apartment. I sent them pictures and an excel document outlining the problems with EACH room.

From me: "Rob,
We have just got moved in and there are a lot of things ******* and I are unhappy about.
In the living room it looks like the blinds were forced it fit in the brackets, this is causing them to bend in a U shape. Also, the repair man noticed a crack in the upper right hand corner of the window.

In the larger bedroom as you know, the blinds on one window are too small. I do not know if this is because the brackets are not installed correctly or what. One of the brackets is nearly falling off the wall. (either way, the blinds fell down and the window got broken, my hand got cut up pretty bad, and that cost me an 80 dollar repair bill)

In the bathroom a bracket did fall off the wall. Instead of them being screwed in it was attached using some kind of foam putty that looks like it rotted out ( this happened at 8:30 pm tonight however, i took photos of it the day beofore) I have had to duct tape a peice of fabric up on the window to get privacy to shower since the window itself is clear and I cannot use the blinds.

We went out and bought some adhesive ( $5.00) but it is not working. the tub is very nasty looking, it looks like it is "rubbed off" The toilet is rusty and the handle is falling off. (the toilet thing, not a huge issue)

The blinds in the other (small) bedroom are old. This is not too big of an issue But I wanted to point out that they are broken on the left side. There was also no rod in the closet, we had to purchase one ( $7.00).

Living room - when the window man came today, he noticed that the living room window is cracked. The tile is also cracked in the living room window sill.

In the kitchen there is an outlet that was not attached to the wall. It is jutting out from the wall and this seems like it would pose an electrocution hazard. Also, the caulking between the sink and the backboard looks like its cracking. Under the sink the cabnet is slanted at about a 45 degree angle, things are falling down)There is what looks like water damage on the wall by the back door. It is not visible but the wall has a spongy feel to it.

There is only ONE screen, the rest of the windows have none. Most of the windows I cannot get open, mainly the one in the big bedroom, it is a Crank window and there is no handle to crank it with.

I have attached an Excell inspection form since I have not been able to get the one you gave to me to you. I have also included pictures of most of what I stated.

I do apologize that I have not gotten with you sooner on all this. But the last week has been hectic with the move in and I honestly did not think so much would be wrong with the place. Please get back with me soon on this so we can resolve this problem."

E-mail reply from LANDORD Aug 21st. 2007 Mrs. *****, I am sure you'll hear back from Rob. I have asked a handyman to schedule time with Rob to come in and fix most if not all of the items you listed.

I am sorry to hear about the incident regarding your hand. I am out of town but will have a check mailed out to you for the 80 dollars that you incurred + the 12 dollars you spent on the closet rod and adhesive.

Thank you very much for being so thorough. We will attend to each issue and resolve it as much as is possible as soon as possible.

On aug,21st I let rob know that a contractor should be contacting him. I got this back from Rob on the 22nd of aug.

I am still awaiting contact from his contractor. If I do not by the end of the week I will use my own. Please do not take any more chances trying to fix things,


I e-mailed him letting him know that the main problem i had was the blinds being messed up since (back then) things were working as intended. I did not know the Housing Code for my city then. This is the reponse I got from him.

Thank you. I understand you concern about the condition of the apartment. It is old and in need of being upgraded.


I got this e-mail the same day from the landlord .

Hi *******, we're in the process of working with a new team that would do our maintenance on the property. You'll hear from ***** who will set up an appointment for her husband **** to come over and do the window fix for you.

They were a no show for one appointment, they came about two weeks later and did not have anything to measure my window with. ( this is for the clear bathroom window) They said they would be back and never showed up again.


I sent an e-mail to the landlord thanking him (before they never showed back up) and i got this in return.

I let the blind thing go. I figured since I never heard from the lady that she got fired. I also figured since my rent was cheap that I could get a tension rod for the bathroom and I threw up curtains that way. Everything was fine until October. The e-mails are as follows

When I went to lay down tonight I noticed that I had a large wet spot on my bed. Upon further inspection I noticed there is a leak in the roof. It looks like it has been patched before ( there is a square on the ceiling where the leak is coming from) and when I put my fingers to it there is a large area that is wet. The leak is not a "horrible" leak ( it is only dripping) but it is in dire need of repair before it gets worse. I fear that may happen soon since the area around the leak is about 5 - 7 inches long.
The leak is in the bedroom off to the right. I am going to move my bed and put something down so the floors do not get wet so if you need to come in tomarrow ( I hope you can get out there that soon since it is an emergency) I will not mind.
Please advise me on what to do.


Rob: I will call a roofer but can only hope they will respond today. There are a lot of roof issues going on right now with all the rain we have been having so I will do what I can. I will take a look at when I am there too. Until it can be fixed I suggest you move into the other bedroom and put a pot or something on the floor to catch the water. I am sorry for the in convenience. I know it is a hassle and wish I were able to do more.

Rob: I showed it to the realty agent and it looked fine. I could not see the spot on the ceiling at all sao it is going to be hard for the roofer to figure I fear. The pan was dry and i hopoe so lomg as we don't get such a driving rain again it will not leak on you. The roofer is very backed up so please be as patient as you can. Linda is going to be working on the unit next door so if you see her when you get home let her look at the cracked window. Otherwise she'll have to get in with a key sometime. Let me know.

I havent seen or heard anyone in the other apartment when ****** or I am home but three nights a week he has college and we aren't even home till 8 or 9, and I'm sure they don't come on weekend. Is Linda the one that was supposed to come over and rehang the blinds in the bathroom in my apartment? I thought the persons name >was Dianne but Im not too sure. If so, when they came over to look at it they said they would be back, and when we didnt hear from them for three weeks we went and got a mini tention rod and put curtains up.

No big deal , just thought you may have wanted to know where the blinds went from that room. If you or the management company need them, ( maybe for the one Linda is remodeling) we do have them sitting in the hallway. > Also, I dont know if you saw it when you showed the apartment but the tub is still not draining right. I have tried a few brands of Draino to get whatever is causing the clog that the plummer may have missed but to no avail. Rob: We will still be getting a lot of rain so keep me informed. The roofer was there but I have not gotten his report so not surte of the evaluation as yet. Juist keep an eye on it and don't trust it to be fixed until I can advise you further. I hope he was able to do so. Linda will try to get to that as soon as she can she is working on the tilew in 4476 right now. I have no idea about trhe new company. I met the man and he did his look about but that is all I know. Limnda may be around over this weekend, I am not sure . You will see he big old Lincoln if she is there working. As for the drain she can l;ook at it but we mauy need a plumber again as it could be in the sewer line which she can't reach. Yes she is the one to hang the blinds but with nthe possible change in management I am reluctant to have her do too much now.

See what I have highlighted in BOLD? Yes, he did say that. I have it saved in an e-mail on my computer. That was the last thing I heard from Rob about my leaking roof and I would have been none the wary except last night there was a TARP on my roof. If there was NO leak, why is there a TARP on my roof?
