I sold my house in Dec. and closed in the middle of Jan. Resurgent Capital Services supplied payoff to the title company. That amount was paid and satisfied at closing. During the last week of Feb., I received a notice from my bank that 2 checks were returned from my bank because of nonsufficient funds. I had no idea who did this. When I realized that the amounts were the same as the payment to Resurgent, I contacted them. They informed me that they just got information from their bank that I had 2 checks returned several months before the closing and pay off of this mortgage. So they just sent them through without notice.

I asked if they would send me a statement showing me that this was true and the payments were actually never reversed( since I had other unethical and dishonest conversasions on their part before). They sent me a made up print out. The print out showed that they applied the $24,000 that was given to them the day after closing the same day. Then they took it off the day after and set it aside.

Then they supposedly found out 6 weeks after that I had 2 nsf checks while the pay off just sat there for no reason unapplied. Then the collection calls started. They informed me that they could continue to collect monthly payments. And even though they had that large chunk of money set aside, in the month of April, they made it look as though we had not made payments since Dec (right before sale of house). So it went from approx. $1100 for the checks to $2800 for late fees and many many months behind.

When I asked why they did not apply closing money, they told me I made up pay off and there was not pay off and they could do that if they wanted. I had to contact the title company's lawyers to get them involved and send paperwork stating Resurgent provided the payoff. Finally, miraculously, I talked to someone in a different department. And at the end of April I received the notarized letter stating account has been paid in full and lean is released.

A few weeks later, I started receiving collection calls again, telling me they will put a lean back on property and I owe them for the checks. I asked several times if they would send me statements proving that these payments were never reversed, they will not do it. And when I went to access statements on line while account was still "open", they blocked them.

They call several times a day and the latest was a threat to put my wife in prison for the checks even though I did them over the phone. They were not written and mailed.
