So I was referred to a couple that was looking to rent a home, I was originally renting the home for $2500, but after speaking to the carpal and then telling me that they’re the type of people I would never break contract that the last time they were at they stay there for several years and the fact that they had a family made me feel sympathetic. I ended up dropping the rent to $2100 a month plus I included free landscaping. Mind you, I left them the home inspector ocular condition with wooden doors wouldn’t baseboards that cost me well over 2000 To have painted. All the appliances were brand new and fully functional and working.

Not even 10 months into the lease the tenants called me out of nowhere on the first of the month instead of giving me a 30 day notice, to tell me that they cannot pay the rent and are living the deposit, the deposit was designed in case there was any damage to the property I would be able to have something to pay for damages but unfortunately I was such a kind person that I waved the last month and only asked for a first month and a security deposit. Huge mistake, you can never judge a book by its cover, and that goes both ways, they look like a nice couple. And instead of costing me thousands of dollars but I will redeem the money back, that I promise.

So they broke the lease I refused to allow me into the home to show other people who may be interested in the property to rent it so I wouldn’t take such a big loss, after hurricane Irma they also refused to allow me inside to check the damages until they finally moved out I want so I went in the property and saw the damages I was in complete shock, they painted all over the baseboards as if they didn’t care, paint stains everywhere, damaged oven. And I just wanted to let everyone out there in Miami who may be considering renting to these people to be extremely wary because they are not what they seem to be. Obviously I’m going to let the justice system take care of the rest, but I felt like I was ripped off and I needed to express my feelings on this website. Out of respect to them, which they don’t deserve any, I will place up A picture of them, but I Well postop the damages they have done. This just shows you how kindness can be a huge weakness.

  I appreciate your advice, and I definitely did learn a lesson from this. But for the record I went into the property the same day that the keys were returned to me and I has a date stamp on it with my phone. Not to mention that regardless I’m still eligible for the months that they did not pay, and I have the means and will pursue this all the way till the end. Because I have learned my lesson but now it’s time for them to learn theirs. But you are right, I made the mistake of not following typical protocols for renting the property.

You don't get to tell us that your tenants refused to let you in to do an inspection after they announced that they were breaking the lease and moving out and then say you were in "shock" when you saw the damage they had done.  No legitimate renter refuses the landlord access to the property after proper notice is given.  You didn't want to "bother" with police- well, ok, but if you had gone in with the sheriff you'd have witnesses to the damage; now the tenants can claim they knew nothing about it and that the damage was done by a malicious landlord angry that the lease was being broken.  You can't even prove they refused you access. 

My original point stands- you repeatedly called yourself "too nice" but in fact you were just being niave, lazy, or both.  I'm sure you won't make that mistake again.  First month, last month, security deposit, credit check.

 They broke the contract, and I’m in every right to walk into the property if there is damage or repairs needed to be done, it’s on clause 25. They did not pay rent. Don’t waste your time writing back, guess you agree that people should have the right to damage other people’s property, not pay rent even though they are under an agreement. I’ve hired a lawyer, so I know I’m in the right. I’ve documented all damages. And taken several pictures of before and after, don’t know how you can defend someone who is in the wrong but it’s fine. I’ve been doing real estate for over a decade. I have over 26 Tenants, this isn’t my first rodeo, I know the laws and what I can and can’t do. That being said I will not continue responding, this is pointless, I was simply stating facts and letting people know about my situation. I have a new born and a 5 year old. So while I am sympathetic towards people’s situation, I have a family to take care of and will do so.

Slow minded landlords

There is a landlord/tenant law book at your local library, I would suggest reading it. You do not have a right to enter a rented premise without at least a 24 hour notification, the tenants must be present, the tenant can request a police officer be present or legal council, etc. Entering a rented property of your own accord and especially in Florida state is incredibly bad. As Florida is a stand-your-ground state the tenant could simply say they thought you were a robber when they shot and killed you. The deposit doesn't belong to the landlord. The deposit is for if damages are incurred, if not you have to return the deposit and any interest it incurred; after a certain period of time (6 months in most states) the deposit is supposed to collect interest as it isn't the landlord's money. Banks have special bank accounts for deposits specifically. Additionally, you can not take deposit money for reasonable wear and tear. Also, don't post pictures of them or their names, that can get you sued to hell and back again. It's slandering, defamation of character, voyeurism, etc. Those are also criminal acts and could cost you your case against them. I feel for you, but keep your bases covered. Making mistakes like walking into someone's home without proper authorization is dangerous and criminal. Say if you thought there was an emergency like a gas leak you can enter, but if you are wrong you can be arrested, etc. While you are leasing or renting month-to-month, if they have paid, the property is essentially theirs unless they break a renting or leasing agreement (not counting contracts with clauses that are voided by laws already in place ~ you can sign away a right, not a law), don't pay their rent and an eviction has been served, etc. You wouldn't want people just walking into your home, other people don't want you walking in theirs.

  Just so you know, he was referred by someone who is respectable in a community. I did ask for references he did sign a lease contract, which he broke and my lawyers currently working on it. I could’ve gone into the property at any time, there was a clause in the lease agreement that allows me to go inside but to avoid further problems I decided not to because I would have to call the police and be escorted by the police. The only reason that I did not approach this more aggressively was because I wanted to avoid having to pay legal fees that we vixen one and then have someone stay there instead of 30 days 90 days. I’m not saying I’m an angel, but I am a person that has consideration for others, both him and his wife work and showed me proof of this and again they were referred highly by someone who is very respectable so I did not see a problem. This website is designed to put complaints against people to rip other people off and that is simply what I am doing. I know that lowering the rent was of my choosing and I probably should’ve been a bit smarter about it and had more patience and rented to someone at the price that I wanted. But you learn from your mistakes as well they.

..if you had just used the word "stupid" or 'niave" whenever you used the word "kind" or "kindnes$s" in your post.  Waiving a security deposit when renting to total strangers isn't "kind," and you didn't do it out of the goodness of your heart.  It was STUPID and you did it out of the emptiness of your brain.  Then when the tenants wouldn't "let" you come in to inspect or show the place, you were too nice to exercise your legal right to show up with a sheriff to force them to let you on to YOUR OWN PROPERTY, right?

I imagine that you dropped the rental price of the house $400 per month for these total strangers and were just too kind-hearted to consider that just maybe if they could not afford the stated rent or a security deposit they just MIGHT not be the MOST reliable people you could rent to?  Did you do a credit check at least?

Here's a quick tip from someone who has never rented a house to anyone- next time you want to rent that property, rent it to someone who doesn't object to the stated rental price, can afford first-month, last-month and security deposit, and can pass a credit check.  Or don't complain when you get burned because you are such an angel who can only see the good in people.
