Los Angeles, CaliforniaI purchased several domain registrations from itsyourdomain.com and I have been trying to transfer them away from this company for over 2 months. They appear to be blocking the transfers in an effort either to resell my domain name, or to blackmail me in to renewing with them, or to allow the domains to expire so that they can charge more money to get them back, or for some other reason of which I am not aware. I have all the documents stating that I wish to transfer these domains. I have sent them multiple requests, and they do nothing but claim they did not get them.
They are NOT responding in any way, from the technical support person, Brian Toon, all the way up to the CEO. They appear to be holding my domain names hostage, and refuse to release them. I am concerned because they are in effect, keeping me from doing my business with these domains, which I own, and they are preventing me from moving them to another registrar.
Furthermore, they claim that they do not allow transfers within 10 days of expiration. I have been attempting to transfer seven domain (one of which expires on April 24) away from them since April 6, which was well within the time frame. Now it is April 14, and they do not even respond to my phone calls, faxes or emails. I spoke with Brian Toon yesterday along with the new registrar, and he denies ever getting any requests. This is an out and out lie, and I suspect if you go to his computer, you will find the emails- there in lies the FRAUD. They are trying to force me to renew with them against my wishes on this one domain. Updated as of 6-16-2004, only 4 of my domains were released, after trying 10-15 times each!
This entire dispute started because they shut my business down for six days due to a chargeback that they received in error. This is why I want to move these domains. The fact is, they HIDE their company name on the credit card billing purposefully (see footnote 1), so when one of their bills was disputed by my business partner because it was not a recognizable charge. They made no effort to contact me and ask me about the chargeback, nor did they give me any warning about it. I believe this is because in their TOS agreement, they give themselves a nice bonus of $200.00 to reinstate the account.
Because of the $155 chargeback, they shut my business down for six days! This is outrageous. Even a property owner cannot throw out a tenant without notifying them first and allowing the problem to be corrected. They denied me access to all my domain names (28) (even those that were paid in full) and in effect, closed my business for six days without notice to me. This cost me countless thousands of dollars in wasted advertising and lost business. This to me a CRIME.
Since there is NO agency to regulate them. I do not know where to turn on this matter. I believe they are fraudulent in their activities and should be shut down. I have reported them to ICAAN, because of BOTH problems I have had with them, however, ICAAN claim that they do not handle individual complaints, or transfer protocol with accredited registrars. It is shocking to me that they are accredited, and that means nothing really. I am not the only one that has experienced these kinds of problems from this company. I believe they are defrauding others just like me. Look up itsyourdomain on Google. You will see others have reported this same issue with trying to transfer domains away from them.
I have tons of email requests, faxes, phone calls- all documented. This unscrupulous registrar is taking advantage of people. Please investigate them as I know where there is smoke, there is fire.

My name is Fred Bunzl.
Although not an employee, or ex-employee of Innerwise - ItsYourDomain.Com, I am a domain name reseller for (((REDACTED by ROR))) and have been working with them for more than 5 years through my site: (((REDACTED by ROR)))
Consequently I know something of how this company works and its officers.
Despite the lapse of time since the customer's complaint, I feel this response may help to clear some misunderstandings and better understand the domain name transfer and expiry procedure.
1. As a general rule ICANN accredited domain name registrars will not allow transfers away until 60 days after renewal or new registration. This is to stop fraudulant transactions where someone transfers or registers a domain, then immedietely transfers out, and does a chargeback. The registrar is then stuck paying the chargeback fee, paying for the domain, and having nothing. More detail in my article at:

2. No registrar will allow expired domains to be transferred away. For this reason, and because domain transfers from one registrar to another can take up to a week or so to complete, many registrars won't permit transfers if the domain has only a few days before expiry. Owners should remember that they lose nothing by renewing their domains well before expiry because a 1 year renewal is added to the domain's existing expiry date. Therefore no remaining validity time is lost.
3. I do not know all the circumstances which caused the $155 chargeback the client refers to. For those who don't know, a chargeback is an additional fee by the credit card company on the merchant when a customer fails to pay for some reason. It is a fee in addition to the original amount of the transaction.
Because of the small average ticket size, most registrars understandably take precautions to avoid these losses. Depending on volume, ItsYourDomain.com sells domains at between $8.95 and $14.95. After deducting registry cost ($6) and credit card processing fee (up to 5% of ticket amount), the remaining profit is well under $10. Therefore a $155 chargeback is something any registrar needs to avoid and will understandably seek recourse from the client if justified.
In case a client cannot recognise the name of the merchant on his/her credit card bill, a call to their credit card company will usually identify the seller's name.
4. I cannot comment on the delays or failure to respond to support requests. But I do know that when I need support from ItsYourDomain.com for my customers, I usually get answers in less than 24 hours.
