On july 24.2013, the riverwalk of the palm beaches homeowners association inc. sent a notice of special members meeting to amend the declartion of conenants inorder the change the food store/gas station into a cafe. The board rented the store/minicafe to rich hardy who owned the empire state deli, who ran it rent free for 11 months, since the store was always empty due to rich hardy limited funds, the riverwalk association wanted to asess all home owners 120.00 debit card to support the cafe.
The riverwalk homeowners association wrote a half a page reguarding mr. hardys back ground. no where did it state his true finances , the board knew he had jugements against him from his deli, yet the board breach its duty not to tell the homeowners. The board promised to protect the payment against lost for 1 year if Mr. hardy couldnot furnish the promised merchandise,Yet when the payment booklets came, it stated, once paid the association resumes no responsibility for the funds.
which is an unethical and illegal scheme to finance the new cafe. On top of it, the riverwalk association was served a writ to garnish Mr. Hardy funds on nov 12 2013 by the 15 judical circuit court. In its monthly board meeting, nov 19 2013 the board never talked about the garnishment, yet encouraged every one to pay. since this development is made up of senior citizens and are to old to fight they give in. this board certainly knew , or should have known, in compliance with its fiduciary obligation,
that this cafe operator had serious financial and legal problems that might be imputed to the riverwalk homeowners. so whether itis called rank incompetence or purposeful malfeasance , it is inexcusable. their joint and several failure to so advise the homeownwers before their nov 12 financial assessment demand, conveyed through the u.s. postal service constitutes deception and fraud. this board needs to reverse this malfeasant fraudulent debit card scheme immediately or resign. The homeowners are not aware that bankruptcy means lossing 164,000.

Before I die. I want to set the record straight. Stein was not in the mail room it was olish. I know he called me to help him in the mail room to put the inserts into the Riverwalk Talk. A homeowner at Riverwalk.

On January 21, 2016, the jury in Palm Beach County Circuit Court Case No.502013CA018250XXXXMBAE returned a verdict finding (1) that Jack Stein posted Report No. 1100917 on the Ripoff Report, (2) that the statement toward Bargain Bob's Carpets was defamatory per se under Florida law, and (3) awarded Bargain Bob's Carpets a total of $1,000,000 for the injury, which was composed of $200,000 in nominal damages and $800,000 in punitive damages against Mr. Jack Stein.

I am David Steinfeld, Esq., the attorney for Bargain Bob's Carpets, Inc. which is named in Report No. 1100917, posted on November 20, 2013. On December 13, 2013, Bargain Bob's filed suit in Palm Beach County Circuit Court Case No. 502013CA018250XXXXMBAE against Mr. Jack Stein regarding the defamatory post.
The author, "Jack-West Palm Beach", accuses Riverwalk of the Palm Beaches, selected members of its governing board, Bargain Bob's, and others of a, "Malfeasant, Fraudulent Debit Card Scheme Soliciting 164,000 From The Homeowners To Finance The New Cafe West Palm Beach Florida."
Bargain Bob's is a business that sells and installs carpet and flooring primarily in the West Palm Beach, Florida area. Bargain Bob's has never been, nor is it now a member of the Board of Directors of the Riverwalk of the Palm Beaches Homeowners Association.
The inclusion of Bargain Bob's in the post has and is continuing to harm its reputation. The only purpose of including Bargain Bob's in the statement was to smear its good reputation and to dissuade potential customers from doing business with it.
