I am extremely furious as I am typing this letter. I was ripped off by my apartment complex. This seems to happen to many people I know.

What happend was my toilet got blocked. I have done that many times in my life but never has anything like this happend. As the water reached the top it stopped and I just let it go but all of a sudden water started to come out of the sides of the toilet and was filling up the bathroom pretty quickly. I started to panic as I didnt know what to do. I opened the top of the toilet and accidently broke off the piece that has the black rubber end on it.

I tried to call my apartment complex but there was no answer then I ran there to the office in my barefeet and someone was there and I told them to get the maintenance guy it was an emergency. He then told me I could stop the water from coming out by twisting a knob on the bottom of the toilet ( I had no idea about this ). By the time I got back to my apartment there was water all over and it was nearing my furniture. Luckily I was able to stop it by turning the knob.

The maintenance guy didnt even come over till 45 minutes later. I was really upset. If the person in the apt office was not there for sure I would have lost everything and really damaged the apt. They had to get a carpet guy to come over and take the padding out from under the rug.

They are saying this is my fault and my responsibility. I cannot believe this. How could this be my fault? The water was coming out like the pacific ocean, I had never seen the water keep coming out the way it did.

The apt manager said it was my fault because I did not call the office. HA! what a crock, I did but there was no answer then I ran there in my barefeet. I am sooo pissed off with them I could scream!! They said the piece was broken off which caused the water to come out but the water has already started to come out before I broke the piece off.

Can you believe this? What the hell do I pay rent for? It should go towards fixing things.

Response to the above REBUTTAL ..if you think an overflowing toilet isn't a maintenance emergency then you don't have much experience in apartment management

Hey, lady, if you think an overflowing toilet isn't a maintenance emergency then you don't have much experience in apartment management. The damage to carpeting, floors, and if there are apartments directly below, ceilings & furnishings can be quite costly. I worked as caretaker & maintenance at an apartment complex and can attest firsthand to that. I would rather have been called before the tenant inadvertantly broke the toilet mechanism than afterward, when you've got to clean up 20 or 30 gallons of water. Sure, some tenants do dumb things, like flush things down toilets that were never meant to be flushed, but that's what we get paid for.

I work for an apartment management company and get stuff like this all the time. Why should we have to pay for you clogging the toilet? Keep a plunger close by or don't clog it. When tenants call us with a clogged or overflowing toilet the first thing I tell them is get a plunger if that doesn't work we'll see if we can get someone out there. There is no reason to pull a maintenance man from an emergency to unclog your toilet. That is ridiculous that people even consider the notion. Your rent pays for maintenance on the apartment but there is some stuff you are responsible for. We've had tenants thorwing deodorant, tampons, cigarettes, toys, etc. down toilets and clogging them until we have to take the toilet away from the floor to unclog it. That isn't our fault that you don't have common sense to know better.
