I received a notification in the mail on 9/18/06 that stated "WE ARE YOUR NEW CREDITOR"! Of course this caught my attention and I read on. It stated that I owed someone $3,130.10! Which I had no idea what or who they were talking about.

It gave me two different opportunities to pay the debt at a 40% discount. Opportunity #1 was to pay $187.81 in 10 convenitnt monthly payments OR Opportunity @2 was to pay $60.00 per month until the balance was paid!

I called them and find out what they were talking about. But I have since remarried and my last name is different on the letter I received and I refused to give them any personal information about me until they answered my question as to what & for whom they were trying to collect.

I gave the attendent the Reference Number that is on the letter I received from them, but she refused to give me any information on the creditor until I updated my personal information. I relayed to her that if the letter had come to my current address (how they got that I don't have a clue), and the reference number, that should be suffient identification to at least tell me who the origional debtor was. She refused to give me any information but said that I could send a letter of "dispute" to them via U.S. Mail and they would then respond to me with information.

I felt this was just another way to get my personal information. I did tell her that if I formally responded to this letter and I find that they were fraudulent, I would contact my lawyer. Her response was "Fine"!

I am in the process of trying to find out how & where to go to get a couple of issues that have after a number of years appeared on my credit report as it is, and I was really upset with this additional issue.

I know for a fact that this particular amount and who RJM listed on the letter is NOT on my credit report at present because I pulled it this last week to attend to the other issues that have re-appeared on my credit report after a number of years. If anyone knows Where or Whom to contact to have these issues resolved, please respond.

I recently received a very similar "We are your new creditor" Notice... for a Montgomery Ward Account that was paid years ago. The account had a high limit of $500 and they say I owe $1400 +, now I have not had so much as a blemish on my report for years.

Now, how do I dispute their BS claim when my proof of payment is long since gone. This account was opened back in 1991, charged off in 1994 and settled in 2000 before I bought my first house.

Weird, ever since my credit score got into the super A credit area, I am getting a lot of shady people trying to get money out of me. One might say it is extortion, holding your credit score hostage...

Dana,

Never speak to any collector on the phone...EVER!!
It will never do anything positive for you, and will always make the situation worse. They want to speak with you so they can terrorize you and coerce you into making even a small payment that would reaffirm an otherwise uncollectable debt.

This is the game they play. They are JUNK DEBT BUYERS who buy "debts" of this age/type for less than a penny on the dollar, and most are time barred and they know it. Every state has a statute of limitations [SOL] for legal enforcement of debt collections. Yours in TN is a max of 4 years depending on the type of debt. This is 4 years from date of last activity, or charge off, whichever is later.

Do everything in writing by certified mail, return reciept requested. Put the certified# on the letter itself, and keep a copy for your records. Now you have solid documentation that you can use to sue them with and/or prosecute them.

Go to FTC.gov and file a complaint on them each time they call. You can do this online in 2 minutes. While there, read and print out the FDCPA which outlines your rights, and tells what they can or cannot do legally.

Have fun with these crackheads.
