During a rain storm a huge limb from my neighbor's tree fell on my privacy fence, breaking it and knocking down a large limb from my own tree, covering up about half of my garden. My neighbor called his insurance company, American Family, and was told that they would look at it right away. Five days later they still hadn't come, so we gave them a call.

The agent, Robert Redmond, said there was no need to come to look because it was an act of God and, therefore, not his insurance company's problem. I asked him how he and his company knew God's will. He changed his tune and said it was an act of nature. Duh! Isn't that what insurance is supposed to cover?

Also, how did the agent know God did it if he didn't even come to look? I guess God speaks directly to insurance agents in these cases. How do insurance companies get away with practicing theology without a license.

Could I go to a priest or a Rabi and get a second opinion? Would it hold up in court if they swore that God didn't do it because he was busy preparing a special place in Hell for liars and cheats at the time so He couldn't possibly be the one knocking the limbs off my neighbor's tree.

As in the case of Katrina victims, insurance companies have been using this lame Act of God excuse to screw people out of their claims. How can we challenge Insurers to prove that they really know the difference between God's will and an outright accident?

Stating your experiences, when factual, and your opinions is NOT slander.  Slander is to say "You're an idot."   It is not slander to say "I think you are an idiot."    I see noting in the author's writing that is slanderous.  Your response does not seem at all objective to me, appearing bias and defensive; and not trying to be helpful.  Coloradro has had many, many forest fires this year with over 300 houses burned to the ground.  Is this an act of nature?  Unintentional fire is one of the reasons you buy insurance.  And I do think you are an idot.

Mr Redmond could have used a different word but it would not have changed the coverage. I have worked in insurance and insurance law for over 20 years and know  of Mr Redmond and he has always been a good agent. If you where cutting the tree down and it fell on your neighbors house you would be responsible for the damages and they would have paid per policy. Since the wind or storm knocked the tree down it is an act of nature and is not covered under any policy even yours. The law states that you MUST read your policy, it is your duty to understand it. If you have any questions you could have asked him after reading it. I had a chance to work for American Family over 20 years ago and kick myself everyday for not taking the job. They are a good company and are very fair when it comes to paying claims, better than most including the one I work for. Do the ever error? Sure, but they do take pride in fixing it. Before slammimg on Mr Redmond you should have read your policy. I am amazed how everyone blames the agent first and never takes any responsibility themselves. Just remember Thomas, you the client must be found guilty of liability. if you did nothing wrong and did not knock the tree over it is not going to covered by any insurance company you have. Read the language in the policy, even the courts will tell you that. Putting this on Rip Off report is going to far, if you would have left your last name this could easliy be slander if you are found in the wrong. Becareful what you put in writing!!

"Act of god" is an old insurance term used to describe something that is an act of nature. God doesnt hate your fence, nature does.

Your own homeowners insurance policy will cover your fence. Your neighbor's homeowners insurance policy will also cover your fence. Ultimately nature is at fault for this accident, unless your neighbor's tree should have been trimmed or cut down before the storm due to being a hazard.

I suggest you file a claim with your homeowners insurance company and let them try to subrogate against your neighbor's company. Typically acts of god....errrr...nature do not count against your policy as a claim.

Thanks for your insight. In all fairness, I did not give the agent time to explain his position: once he said it was an act of god, I went ballistic since it seemed such a sleazy, ridiculous way to get out of paying up.

Giving cheesy business types the power to invoke the supernatural to dismiss claims rubs my fur the wrong way. This is America--Fair is fair. I break your stuff, I pay. You break mine, you pay. We all learned this by third grade.

It is the very fabric and essence of what holds a civilized society together. Wars are fought over this principle. A business (or country) that has no sense of respect for personal rights or property and seeks to circumnavigate basic human rights through unfair policies or convoluted language deserves what it gets.

Act of Nature/God

Claims that fall into the "Act of God or Mother Nature" category are not covered by your neighbors policy because he has no liability for the damages done to your property. He would have had to done some kind of action or ignored a known problem with the tree for there to be any chance that his policy would pay you. You are presenting a 3rd party claim against his policy and he has to be negligent or have laibility in order for the policy to pay you. If the tree had a known disease and he was told to cut it down but didn't then you might have a chance. Otherwise, you are just wasting your time presenting this claim.

The American Family Agent or adjuster that talked to should have taken the time to explain this to you. If you want to verify this info call your own company's claims dept and ask to talk to a property/homeowners adjuster and ask if you policy would pay your neighbor if the roles were reversed.

The catch phrase "Act of God" is a blanket for all acts of natural causes. I had my agent include an AOG clause in my renter's policy. Check your insurance policy to see what is covered and what isn't.
