Recently I received a copy of the Hearing Transcript for the case between Cecil Rolle and Robert Zarco and Robert Einhorn. I'm appaulled. This was, in part, as I understand it, a "VIP Rip-Off Report mediation" to allow Zarco Law Firm the right to delclair "false allegations" and further validate and substantiate statements made by me in a earlier RO Report so they could redact "facts" that they said were disputable and not substantiated at this hearing.

What's very upsetting is my statement was very accurate and if they had the balls to invite me to the hearing so I could speak on my own experiences and opinions of what I described therein, I don't believe any redaction would have been allowed. Why didn't someone make an effort contact me, I've had the same phone number for over 30 years, I'm easy to find here in Fort Lauderdale by either ROR or Zarco. The case Mr. Rolle was persuing was his own, he and I have never met in person. But what I don't like is having facts ripped out of my story by ROR without my knowledge and losing the ability to stand up for myself and what I've experienced previously with Zarco Law Firm of Miami.

In my opinion, The Zarco Law Firm represented by Robert Zarco and Robert Einhorn, are the absolute most "scammingest" attorney's in franchising. I've known this for years now and I've attained further confirmation by a Florida Franchisor who says he paid Zarco off one million dollars to defeat his own franchisees Zarco was to suppossedly representing and represented for this franchise, Lady of America Fitness I believe was the name. Further in reading the transcript, I see it is riddled with specific misrepresentations, lies and deception made in my opinion by Mr. Einhorn, Zarco's partner, within the court transcript.

If anyone wants to locate me, just go to Facebook, or LinkedIn, you WILL find me under Chris Nolan or Chris "CP" Nolan and I'll be happy to share my entire story. In my experience and in my opinion, Zarco Law Firm lost millions of dollars because they weren't prepared for the case we had back around 2003. In my opinion, anyone hiring Zarco Law Firm should be forwarned that they may be stepping into a bad arena of deception.  

I've just read this "glowing report" about Robert Zarco and his "merry men", you (the writer of the above "positive" review) has got to be a close friend of Mr. Zarco, but you may have been dupped.

In my experience and in my opinion, I now clearly know that Robert Zarco is a ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)). How you ask? Based upon an accidental recent interview I did with a previous opposing client of Robert Zarco, (Mr. Roger Wittenberns, Franchisor of Lady Fitness of America,) Mr. Wittenberns told me a long story and confirmed my suspicions 100% about the kind of lawyer Mr. Zarco really is and how he ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)).

In my expereince and in my opinion Mr. Zarco primarily represents franchisees and area developers, not Franchisors. He brags about his victories over companies like Burger King as a part of his legal sales pitch. Further however, keep in mind ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)). Mr Zarco makes me sick. Did you see him appear in the TV show "How Did I Get  So Rich" ?? Wasn't on TV very long as I suspect if was a flop, just like Mr. Zarco is in my opinion. Sure, he has a big house in Miami and some expensive boats, at the expense of his clients.  I want to let the world know how he, at least in part, likely acquired them. In my experience, and based on what I've recently learned speaking directly to a former Franchisor who told me his story BEFORE he knew who I was, a previous client of Zarco and Einhorn.

Roger Wittenberns was the Franchisor for Lady Fitness of America I believe is the correct name of the franchise system I'm discussing here. Mr. Wittenberns was also the next door neighbor of a highly reputable Fort Lauderdale woman and close friend of mine who's local charity Board I've served on for the past couple of years. The reason I just happened to meet Mr. Wittenberns was because I was attending a party in his neighborhood at the next door neighbors home. Mr. Wittenberns met me and took an interest in me, our commonalities in franchising and invited me into his home for a private discussion. Mr. Wittenberns enjoys his cocktails and was into them deeply when he expressed his desire to tell me his story, a story on how he paid off opposing cousel , Mr. Zarco, representing Mr. Wittenberns franchisees to avoid screwing up a sale of his Lady Fitness of America franchise system for about $48 million dollars. Mr. Wittenberns indicated to me that although he was about to get into a blow out, drag down legal battle with his own franchisees, represented by Mr. Zarco and his firm, Mr. Wittenberns needed to somehow quite and difuse this legal action. You see, because Roger Wittenberns had a buyer for his franchise system and didn't want his sale to be interrupted or interferred with by a franchisee litigation issue.  Therefore, expressing this concern to Mr. Zarco via personal meetings, ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)). The franchisees were apparently not aware that the entire concept was about to be sold. The franchisees, according to what Mr. Wittenberns told me, took the scathingly low settlement as they trusted in Mr. Zarco's counsel.

Today, Mr. Wittenberns laughs and enjoys telling this story about how he successfully completed his sale of his franchise sytem because Zarco representing the franchisees was ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)). Mr. Wittenberns refers to "Zarco" as a good friend and Idiot. Although I can't unequivicably prove Mr. Zarco and his firm did exactly the same to me, I've always suspected this was done to me by Mr. Zarco and Mr. Einhorn, as a multi-unity operator and Area Developer in a case involving Schlotzsky's Inc (Deli). I later contacted the State of Florida to file a complaint with the Bar, I wanted all of my overpayment of legal fees to Mr. Zarco, approximately $137,000, returned by Mr. Zarco to me vs. the alternative in these kinds of matters, taking the maximum of $50,000 offered by the State Bar  victims fund, that handles these kinds of lawyer malpractice liabilities.

Unfortunately there is nothing I can now do to recover my life or money ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)) because of the statute of limitations. My name is Chris Nolan and I can be easily reached as I serve with a number of local charities and have moved to Florida from Ohio 3 years ago. I was one of Schlotzsky' Deli's largest Area Developers. ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)) destroyed my marriage of 27 years, and caused me a bankruptcy after working over 15 years to build a successful chain of stores in ten states.  As long as I'm on this earth, I'm happy to let prospective clients, those in the franchise industry and anyone else understand who they are dealing with in my opinion and personal experience. In my opinion, Mr. Zarco and his firm should be your LAST choice of attorney's to represent  you if you are seeking legal representation. It is not my practice to tear into anyone, however, this is one person (and firm) that had an excellent case they should have dominated easily, and yet at the time, convinced me to mediate as they felt it would be more productive, it wasn't.

If you have a franchise case to bring forward, my recommendation is go hire a different firm as there are lots to choose from, and go all the way to a jury trial unless you can quickly settle and get a truly fair settlement. If you're an existing franchisee, keep in mind while Franchisors generally have deep pockets, you can prevail if you find yourself an honest lawyer and firm. 

The law firm that is the subject of this post hereby requests that the author reveal his/her true and complete identity.  In the event the author fails to do so, the law firm that is the subject of this post will take appropriate action to uncover the true identity of the author.

I believe “False report" was written by none other than Robert Zarco himself. Now that so much of Robert Zarco’s past alleged activities have made it onto the internet, he has been on a rampage to remove the many negative comments about himself, his partner Alejandro Brito and their law firm Zarco Einhorn Salkowski & Brito, P.A.  For the past several months, he has been engaged in a behind the scenes attack campaign geared at removing legitimate—opinionated comments that are critical of his actions, professional performance and ethical behavior, among other things, as well as those of his partner Alejandro Brito and their law firm Zarco Einhorn Salkowski & Brito, P.A.

It is clear to me that this ripoffreport.com comment: "Robert Zarco, Attorney In my experience Mr Zarco was ((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)).. Miami, Florida"; was written by an impassioned and experienced businessman who has dealt with Zarco and his firm in the past.  Just as I have, he has come away totally dissatisfied with Robert Zarco and his firm’s professional and ethical standards.

That is plenty of evidence throughout the internet that confirms his and my experience in dealing with Robert Zarco.  Numerous highly respected Federal Judges have discussed Robert Zarco’s and his firm’s poor professional performance.  As if that’s not enough, the United States Trustee’s Office has filed official papers against Robert Zarco, Alejandro Brito and the law firm of Zarco Einhorn Salkowski & Brito, P.A. which highlights their alleged involvement in a multi-million dollar fraud scheme.  Those official papers also accuse Robert Zarco, Alejandro Brito and their law firm Zarco Einhorn Salkowski & Brito, P.A. of “Professional Malpractice”, “Breach of Fiduciary Duty”, “Unjust Enrichment” and numerous Florida Bar violations.  The United States Trustee’s Office is seeking the return of nearly $300,000 that Robert Zarco, Alejandro Brito and their law firm Zarco Einhorn Salkowski & Brito, P.A. received related to the alleged fraud scheme. 

There is plenty of evidence of client dissatisfaction, criticism from multiple distinguished Federal Judges, the United States Trustee’s Office official complaint, alleged Florida Bar violations and other matters related to Robert Zarco, Alejandro Brito and the law firm of Zarco Einhorn Salkowski & Brito, P.A. available on the internet and at www.robertzarcofacts.org.

Robert Zarco, Alejandro Brito and the law firm of Zarco Einhorn Salkowski & Brito, P.A. are by far the worse law firm I’ve ever dealt with. I believe they are unethical, incompetent, unprofessional, and dishonest.  I wouldn’t deal with them again if they were the last law firm on earth.  I think they only care about how they can use their clients to generate as much money as possible to support Robert Zarco’s extravagant lifestyle as opposed to doing the right thing among franchise owners who have been wronged by their franchising company and often have little if any resources to fight with.  After all, it takes a lot of money to support a $23 million—18,500 square foot mansion with a $5 million yacht collection out back.  I don’t think Robert Zarco cares one bit about recovering money damages for his clients and passing that money along to his clients who suffered financial losses.  In looking at the internet complaints and legal complaints against Zarco and his law firm, obviously others agree.

These allegations are outrageous and meant to be scandalous without any actual factual basis.  It is clearly an attempt by a competitor to fabricate such statements in order to damage the great reputation of Mr. Zarco and his firm in an attempt to gain an unfair business advantage. Mr. Zarco’s business reputation, character, integrity and legal success are evidenced by the many great successes which he has achieved for his clients over nearly 30 years of practice. Just call Mr. Zarco yourself and you will learn how these anonymous postings are merely designed to disrupt his practice.

I am a present day client of the Firm; Zarco, Einhorn, Salkowski and Brito P.A., and after reading this defaming and falsified text I felt the need to defend the firms name, as well as Robert Zarco himself. Robert Zarco the primary partner of this firm has constantly proven his promptness and diligence in the field of law. He is 10 minutes early to every meeting, extremely prepared for every deposition, and when it comes down to negotiating his retainer he is nothing but fair. It's people like Zarco who give lawyers a good name. In the article preceding this one, slandering Zarco’s reputation, the supposed franchise area developer says Zarco is a kitten and backs down against opposing attorneys. From my personal experience I can vouch for Zarco and say this is false, in fact it is quite the opposite. When Zarco steps in to a room, opposing lawyers are quick to back down.
