This company was hired by our town house association, without our consent. They were hired to repair the roof of our cluster after hurricane Wilma, even though our house sustained very little damage during the hurricane they had to repair our roof also because its a joint town house. They started the repairs and then forgot to tarp the roof on the night of Nov 10th 2005, which caused our house to be flooded causing $72,000 worth of damage.

The owner of the company promised to pay for the repairs out of pocket if we did not report the damage to our insurance company; I decided to report it because, I thought that was the right thing to do. My insurance did cover most of the damage however our insurance did not cover our furniture, nor the hotel expense we incurred because of this.

I called the company to get their insurance information and they refused to give it to me. Stating that it was not their fault my house was damage when in fact, if they did tarp my house I would not have the damages.

I also found out that they did not even have a permit to be on my roof; the damages occurred on 11/10/05 and they applied for a permit on 11/22/05.

I tried to resolve this via the better business bureau. They sent a letter stating it was not their fault and that my house was condemned by the city, which isnt true and that I needed to take this up with my own insurance company. I then sent the below rebuttal and they refused to respond.

The Better Business Bureau did not provide much help either. I had to keep calling them to find out what was going on for months.

K..Again, the roof of my CLUSTER was damaged during the hurricane (NOT MY UNIT) there was absolutely no damage to my unit after the hurricane occurred. At no point did my roof cave in, even after Rocio caused the damage, the roof still did not cave in. I didnt even need to file a claim with my insurance company for anything in my house to be fixed (ONLY THE ROOF) which we had no choice but to file a claim since the roof was being repaired by our town house association and we had no choice in the matter. Since you cannot repair the roof for one unit, the whole cluster has to be repaired. FEMA was at my house to take pictures one week after the hurricane. I will get the pictures and report from them. My insurance company also came and took pictures, I also have pictures which does not show any damage to our whole entire house. Only minimal leaking in our kitchen and one of our bedrooms (NO OTHER DAMAGE THOUGHOUT THE ENTIRE HOUSE). It also rained several times during the three week period after the hurricane and before Rocio came in and our house never leaked or flooded

Yes, there were issues with the roof; if there wasnt they wouldnt need a roofing company to repair the roofs on the north side that was caved in and repair the roofs of the units on the south end to PREVENT the same damage. My unit is located on the south end of the building. However, instead of preventing damage Rocio created more damage. Instead of us having a $3500 claim we ended up with a $72,000 dollar claim plus the $3500 for the roof.

In regards to our cluster being condemned it was NOT condemned, it was deemed unsafe to occupy since again, there were major damage to the north end of the building where their roofs caved in and they did not want people in the other units just in case the same thing happened. (I have a copy of the sticker from the city) That is why Rocio was brought in. We remained in our unit the whole entire time until Rocio came, stripped our roof and forgot to tarp the roof the night of November 10th 2005. That is the bottom line. If they tarped the roof after striping it, the damage would not have occurred and I would still have my brand new furniture which were only a year old.

The day after the damage occurred a gentleman by the name of James Maghan aka Jim presented him self to my husband and two other neighbors, a police officer and a member of our management company at our neighborhood club house, acknowledging the damages his company caused to our homes. He stated that he is the owner of the company and he will take care of the damage if we dont report it to our insurance company. It sounded good at the time., so my husband agreed to it. All we wanted was our house fixed and our furniture replaced. Mr Maghan immediately hired a restoration company (Tiger Restoration) (1-866-82-tiger) to start the repair on our house as well as our neighbors. When the guys showed up and placed all their equipment in our house, they began telling my husband that he needed to call his insurance company, because they wanted to be sure they would get paid. They didnt trust Mr Maghan. I was at work at the time and didnt feel comfortable about what the guys from Tiger said, so I called my adjuster, who had previously visited our house and assessed the wind damage of the roof before the flooding. He advised me that I needed to file a new claim, because what Mr. Maghan was doing was fraud, he stated that he was doing that because he didnt want his insurance company to know of the damages. So, I went ahead and filed the claim.

The next morning when my adjuster arrived I did not hear my door bell ring because of all the loud equipment that was in our house and we couldnt find a hotel that night. However, my adjuster saw Mr Maghan and asked him about what I had told him they did to our house. Mr Maghan then came banging on my door, I went outside and he verbally attacked me, asking why did I call my insurance company, he told me he would fix my house I told him that he did not know me and he had no right yelling at me because at the time I didnt even know who he was; he spoke with my husband the day before, not me. I was at work. I then called my husband who was at work, he came home immediately and got into a verbal confrontation with Mr Maghan for attacking me. He also got into a verbal confrontation with my other neighbor who he offered the same deal.

Fortunately for us, our adjuster showed up the very next day after the house flooded, while the house was saturated and while Tiger Restoration had all their equipment in our house. (we have pictures of that also). We had to stay in a hotel (which was paid for out or our pockets) because Tiger Restoration had a bunch of really loud fans and equipment that made our house really hot and they recommend that we not stay their since we have two young children the house was dripping wet and their were wires all over the floors. After the house was dried out, Tiger sub-contracted with a contractor who was to perform the repairs. (I have his direct number which I will have to pull phone records to retrieve) After, he came and did the estimate I was not satisfied with what he said he was going to do. In my opinion he was just going to butcher my house and I was not going to let that happen. My neighbor ended up having to call the police on Mr. Maghan for not making good on his promise. The cops told him it was a domestic matter and he had to take him to court. He butchered my neighbors house which my Neighbor then had to get his own contractor to clean up the mess. I was not going to let them do that to my house.

My adjuster advised me that my house was going to be fixed, regardless. My insurance company had paid for our house to be fixed, the repairs are in process while we stay at a hotel and pay out of pocket. I lost money that I would not be reimbursed for, such as the hotel fees, new clothing for my kids, as well as new furniture. I also had to pay an extremely high electric bill for Tiger Restoration having to use my electric to run their equipment for four days straight.

If Rocio did not cause the damage to my house why did he ask us not to report it to our insurance company and that they would fix the house for us. This was a promise he made to us and our neighbor. According to my neighbor, he was paid approximately $8000 by Mr. Maghan not to report him to his insurance company. My neighbor was able to obtain Mr Maghan insurance company information from someone who works for the management company of our town house association. My neighbor told us he was trying to make money off of the whole situation. That was not our intent, all we wanted was our house fixed and our furniture replaced. We are not a bunch of greedy people trying to commit fraud to make a buck. We are hard working individuals that busted our butts at the age of 25 and 26 years old to purchase our house and furnish it with nice furniture so our kids could live comfortably. I woke up the night of November 10th to water splashing in my face from the ceiling fan above my bed. I swept water from about midnight to 6am that morning until it was time for me to go to work. Yes, I still had to go to work; I also slipped and fell down the stairs, because it was so wet in my house. This was all caused by the negligence of Rocios Roofing.

The facts of this matter are as follows:
Rocio Roofing did not have a permit on November 10th when the damage occurred. They should not have been on my roof.

They did not tarp the roof, which is what caused the flooding of our house.

These are the questions I need answered.
Why did they tell us not to call our insurance company?
Why did they offer to fix our house?
Why did they hire a restoration company?
Why did they not tarp the roof on the night of November 10th?
Why are they not responsible to pay for the damages not cover by my insurance?

And for your information, I did file a claim with my insurance company; what I want is the money we had to pay for the hotel, the money for the high electric bill and my furniture replaced or reimbursed. Rocio need to file a claim with their insurance or bonding company for the things that were not paid for by my insurance.
