On July 13th, the German Shepherd Dog, Bravo (formerly called Honor by the breeder) arrived at 11:24 PM in Pittsburgh, PA, having previously been flown from Salt Lake City, UT

On July 18th it was discovered that this dog was missing three pre molars. The p2 and p3 on
the left side, and the p2 on the right.  This is an animal that was purchased as showable/finishable, and 3 missing teeth are considered, as per the AKC German Shepherd Dog Standard, a serious fault.

I contacted the breeder IMMEDIATELY on the 18th about the teeth. She was incredibly apologetic
about it, said she didn't know, etc etc.

I told her we (my husband and I) wanted to send the dog back and we would like a refund on the dog.  She was agreeable at that time for the most part, but she wanted us to find a new home for the dog "to save on shipping".  We did not want to do that, and simply wanted to return the dog for a full refund.

I had asked her over the phone if she would issue us a full refund, and she grudgingly stated "If I have to."

At that time, we were agreeable on shipping the dog back to Idaho, and we offered to split the costs or let her take it out of our refund for the time being, and she could reimburse us when she sold the dog again.  We stated to her in an e-mail that we wanted it in writing that we were going to be reimbursed for the dog's shipping.

After not hearing for her for a day or two, I posted to her FB wall that I really needed to speak to her about getting the dog returned, and she said that "She'd had some time to think about it, and she'd send me an e-mail".

I received an e-mail that stated she was "very concerned" that I didn't take the puppy to the vet in the 24 hour time frame stated in the contract. I had told her BEFORE THE DOG WAS SHIPPED that no vet was able to see the puppy in that time period. The 18th was the earliest date I could obtain.  She had stated (over the phone) that was fine and that she understood.

She told me that we could have had the dog's mouth x rayed (at our expense, of course). Even if the dog's teeth were impacted in the gums, if they are not showing, the dog will be faulted.

She demanded we return the dog with his registration certificate signing him back over to her. He was to be shipped back to her at our expense.  We told her no. If she wanted the dog back, she would have to pay for his flight, as we were not going to pay for her mistake.

The breeder did offer us two replacements, but by her own admission, they were not properly socialized, and at the ages of 9 and 10 months respectively, we did not want to take on an older animal that was not properly socialized, as the dog we had purchased already displayed poor temperament (constant avoidance, stress panting, etc).

We also told her that Bravo's brother would not be suitable because we wanted to do performance with the dog, and we did not feel Victor (the brother) was capable of doing so.

The other replacement offered was from a litter sired by her stud dog, and it was stated that she would BUY the b***h for us for $1500. 10 months old, and I reiterate that she also "needed socialization".  We declined again, as my husband and I are not/were not interested in taking on another project dog.

I told her we weren't interested in any other litters, and we wanted our money back.

She then sent us a legal document for us to sign that included a non-disclosure agreement and a clause that stated we would not "disparage" her.  She offered back only $1000 of the $1500 we paid for the dog, and stated that she was going above and beyond her contract by doing so."

We offered AGAIN to split shipping with her to get the dog returned, or to return him to her at the German Shepherd Dog national being held in Topeka, Kansas next month (September 26th, 2011-October 2nd, 2011) in exchange for a FULL refund, or for a replacement of equal quality that is properly socialized and with correct temperament.

We told her we would not sign it unless she added a non-disclosure statement for herself, as well as a clause that protected us from disparagement, and not just her.  We also stated that the dog would need to be transferred back into her name at her expense ($20).  She decided not to accept this counter offer.

She will not respond to e-mails or phone calls, refuses to sign off on the dog so we can sell him, and has stated that she feels we no longer have any right to return the dog or receive a refund.

Roxann Labra does NOT stand behind her dogs, and refuses to take them back when they are in need.  She passes the buck and will not take responsibility for the mistakes she has made and the dogs she has bred.
