 Contract was in the making for 4 weeks. The Builder (Richard T. Berio) and the owner, myself signed a contract valued at $12,500 which represents labor only to construct (Frame) a single family dwelling.

The contract which was primarily provided by the builder was slightly modified to represent the project. The contract was signed the day the work was agreed to start on May 13th, 2013.

The progress has been slow and/or at a standstill for periods of time. I have written the builder multiple times and have been faced with a multitude of excuses,  delay's and deception. The builder has been paid for work that is still outstanding.


I have been contacted by at least three sub-contractors all hired by R.T. Berio for work performed on my property and none of those three have been paid.

The three contractors all claim that they call R.T. Berio but the phone reports it is out of service. One of the contractors determined through the phone service provider that their phone numbers have been blocked.

The last substantive email was written to R.T. Berio on July11th, 2013. Mr. Berio sent a text assuring he would be onsite the next morning but never showed after several more broken promises he still has not returned.

This is priceless!!!

The only defense you have is to try to discredit me. You were paid for work you never completed which is why I filed complaints with the BBB and the NH Attorney General’s Office along with all the required proof. I know it, and more importantly you know it.

Your actions have turned my families dream into a nightmare. If this is slander then you should file a lawsuit. My guess is that RipOffReport.com is protecting others from your dealings and you are just mad about it. I am not sure how you sleep at night.

The associated complaint with this rebuttle is of course frivalous and unfounded. If not for the potential damage it could do it would be laughable. This report was filed by a Mr Bruce Alleyne of (((REDACTED))) phone (((REDACTED))) and in regard to his property at (((REDACTED))) Louden NH 03302.

Mr Alleyne misrepresented his project as well as his finances to both myself and his mortgager, lying about his assets, the scope of the project and ultimately his abilty to pay. Mr Alleyne repeatedely shielded himself blaming his mortgager for delays in payments. His mortgager ultimateley contacted me after we left the job to attempt to understand where all the money had gone and what had happened..He indicated that Mr Alleyne had somehow consumed 100% of the mortgage amount and was requesting an additional 70% to finish. I indicated it certainely had not gone to me as our contract was minimal and we had not been paid for our work completed. The house was appr. 30% completed at that time and the money was gone. The mortgager without being asked indicated he had been very satisfied with our work and progress. He went on to question the integrity of Mr Alleyne and what happened to all his money and that Mr Alleyne could not thus far account for it. I went on to explain that our portion of the project was minimal and was still unhonored and work completed unpaid. I could offer no explanation for the mortgage being exhausted as I had only been paid 7,500 dollars and his house was only 30% completed. So whos the scam artist here Mr Alleyne ??????

The following is a letter to the attorney general state of NH in regard to this project and Mr Alleynes slanderous posting..

 

 

                       

 RE. Bruce Alleyne case number 2013105594 9/16/2013

In response to the received complaint from Mr Alleyne about his house project, I submit to you the following.

First and foremost, any and all money received from Mr Alleyne relative to his project and our contract was for work performed and COMPLETED as agreed. Contrary to his claim of me being paid somehow in advance and running out on him. In addition, multiple changes and additions were made to the scope of the project as we progressed, some were performed and completed by myself and workers, others were yet to be performed. A variety of these changes and or additions added and or would add substantial labor costs on my part. In any case Mr Alleyne verbally expressed there would be no more money paid other than the agreed upon contract amount and he was at the end of his rope in rising material cost and was not shelling out any more money for anything .However the work as he wished was expected to somehow be miraculously performed by me. In addition, he provided no construction documents other than simple electronic sketches and multiple requests needed to be made to even receive these, they were not in any way construction documents and were not received in a timely manner. In summary as far as costs and money, Mr Alleyne has as I said received all the work completed that he has paid for, and in addition has received additional work that is completed and remains unpaid and some of which has yet to be invoiced.

Secondly, Mr Alleyne was it appeared acting as his own general contractor. In doing so he was responsible for any associated projects and or services necessary to prepare and facilitate the execution of our contract, which was to frame, roof and side his house providing labor only. Given that, sitework and foundation systems and any other measures a general contractor would normally provide to facilitate our contract as well as any other micelaneous duties and or materials would be his responsibility and cost. As late as 75 or so days into a 90 day contract, on what turned out to be my last visit to the property, there was still an open water filled trench several feet deep and several feet wide on one complete side of the house and no concrete foundation systems for the proposed front and rear decks. These two conditions hindered progress from the beginning and should have been completed prior to my arrival or shortly thereafter as they were required for not only efficient working conditions but also an absolute necessity to accomadate construction and execution of our contract .Despite multiple conversations about them getting completed to move ahead, I saw no attempt or progress in that regard. Mr Alleyne even alluded at one point that he expected me to install the concrete foundation systems for the porches, all the while professing no added costs would be accomadated. I have no way of knowing when or if these items have ever been completed.

Third, any outstanding balances due any subcontractor involved in Mr Alleyne,s project on my behalf are directly related to work that has been UNPAID by Mr Alleyne. Any of these amounts are not in any way associated with work for which Mr Alleyne has paid for.

Fourth and final point before I summarize..Mr Alleyne became on multiple occasions even as work was progressing as planned, verbally abusive to the point of yelling, screaming, swearing, demeaning to the workers and at one point told them to not return. I had multiple conversations with him where he was out of control swearing, yelling and for what I could tell was for no apparent reason other than getting what he wanted for nothing. I received text messages that specifically said I was ruining his family. I was threatened with litigation midway through the project for what reason I do not know. He even posted a person on the on the job at one point, who appeared to be under the influence of something, to watch workers to be sure they were working and report back to him if they were not..even though he was not responsible for them nor was he paying by the hour..Work was moving as planned at that point and on schedule, I foundMr Alleynes behavior at times very bizarre.

 As I was arranging with a siding and roofing crew to move into Mr Alleynes project, I was threatened with litigation, had a what I consider a frivolous complaint filed with the Better Business Bureau (for which I have had an A+ rating with since 1993) by Mr Alleyne. I decided to take a step back and review my options..I informed Mr Alleyne of this. I continued to move and finalize my arrangements with another large crew to come with me to the house and complete the project and we agreed to do so.

I was then made aware that Mr Alleyne moved forward and posted a damaging online report accusing me of being a scam artist, a fraud and ripping him off etc….if you google my name or company name etc it come up first and is from what I have learned IMPOSSIBLE to remove and costs tens of thousands of dollars to have surpressed and maintained.

In summary, Mr Alleyne’s bizarre, at times abusive behavior, combined with his unwillingness to pay for what he wanted and expected his lack of performing his responsibilities as a homeowner/general contractor, made it not only undesirable and hostile, but financially and physically impossible to complete our contract and other additional things he wanted done as well.

 I will be moving to collect the money due for the work performed and completed..In addition, and this may or may not be a separate issue but I will also be moving forward to pursue a substantial, yet undetermined amount for suppressing and ongoing maintenance of his online posting as well as substantial yet undetermined claims for damages. I am of the the opinion his actions are slanderous, unfounded, and have begun to damage my reputation and will continue to do so…
