This company is nothing but a sham. I refied my loan away from DriveTime's incredibly high APR and payments to get a 72 month loan on my Grand Prix, which I only owed about half on.

Multiple times I have been late and corrected the problem with the lender. That was until about August. I hit a financial downturn and they knew about it then, and agreed and took a partial payment. Yet thier records have been showing since that I owe a $400 payment that was never due. My payments were 272.05 a month. now, because of same downturn and banking issues with HSBC, I have been a few months late.

I was preparing to make a payment within the next two days to catch up the account. I was harassed multiple times in december and January via telephone, of which records santander wont let you into your account to do anything without. They were notified in DECEMBER of my intent to file CH7 bankruptcy.

I have had some atty snafus and had to file myself. They got served last week of INTENT TO PAY and RETAIN vehicle.The paperwork has reached the courthouse for my CH7. Yesterday, while I wasnt looking my car got repoed, the police have it on file. I knew people around here were shady, but.....

I am counter suing for 30K in damages, if I need to start a class action with the head company in MEXICO, which was notified as well via fax about my situation, I WILL SUE THEM AS WELL. since I have them on file with my CH7, all I have to do is ammend the notice to include suit and check a class action box.

Im at rjasmin if you need my name. I own the domain. Legal aide is helping me, but I dont know how much they can do. I will have a lawyer for damages. The car keys are STILL IN MY possession.The car was STOLEN during CH7 bankruptcy filing as far as Im concerned, which is illegal in MULTIPLE states.

First of all there are no laws that protect you when you have an "intent" to file Bankruptcy.  Until you actually file the BK you are not protected under any of the Bankruptcy provisions.  I know why you did it, you like many people probably felt that they would much rather take some money than no money if you file for BK.  They(and I mean just about any finance company) hears this on a daily basis and could care less.  Then as you found out this is often not the case.  In fact your notifiying them of your "intent" was probably at least an indirect cause of your car being reposessed.


So the main question is did you actually FILE your Bankruptcy petition before they Reposessed the car.  That does not mean just getting the paperwork together.  That does not mean just thinking about it. That means filling out all of the declarations and filing it with the Bankruptcy Courts, paying your fee and getting a case number.


The next question is if you did file before it was reposessed.  How much time between the time you filed and when it was reposessed passed before it was reposessed.


Normally this is a question that should not need to be asked, but since you did file Pro Se.  Did you actually include them in your declaration as a creditor, so that they could be properly notified.

This happened to me as well.  Almost exactly.

If you are really interested in getting involved with a class action type suit I am more thatn willing to join you.  I am still fighting with this company.  This is the worst company you can ever deal with, you are better off dealing with a "buy here/ pay here".
