These people called my home claiming to be the new owner of my car loan but they asked for the wrong person and the monthly payment amount they stated was owed was incorrect as well, since we have not received any notification from Triad Financial that they had sold our loan and they gave me incorrect information I told them that would not do business with them until I received written notice from Triad Financial that my loan was now with Santander.  The women said she understood and that I should receive conformation of the loan transfer in about 7 business days and we hung up.

20 minutes later (and I mean 20 minutes later) they called again.  This time it was a guy on the phone, I repeated to him exactly what I told the previous caller.  He began to get nasty and talk to me like I was a moron, so then I said You are no longer permitted to call my home number which is my right under the Fair Debt Collection Act.  I have 30 days to send you a letter stating that you are no longer permitted to call my home number, within that 30 days you are not permitted to contact me at that number, if you do continue to call it is breaking the law and harrasement and I can and will file charges, if I do not send the letter within the 30 day period at the end of that 30 days you may resume calling.  I stated again to him that the company is no longer permitted to call my home number and if there was another call I would have the call traced thru my phone company's harrasing call division, file a report with the FTC, Attorney Generals Office and the Bank Of Commission for my state.

Guess who called 2 hours later, so I went thru everything again remembering to remain calm and restate all my rights under the Fair Debt Collection Act and restate that they no longer are permitted to contact my home phone and if they continue I will turn it over to the proper authorities and I hung up and I did just that turned it over.

Guess who called 2 hours later so this time I asked to speak with a supervisor and went thru it all over again as of right now (2 hours later from the last call) I have not received a call.

 

I want in on any class action law suite any law suite against this company they are horrible and they seem to think that they can break the law and there is no consquences I want to show them they are wrong.  I am not the kind of person to allow someone to push me around especially when I have done nothing wrong.
