Loan originated in August 2008 with CITI Financial soon the loan was purchased by Santander Consumer USA, I purchased my vehicle with a $10,000.00 down payment, by the time the loan is satisfied I will have paid almost $40,000.00. The term of the loan was for 5 years. Purchased in August 2008, yet maturity date is not until 3/5/14...that is 6 years!!!! Even though we have proven payments they only account for 47 payments in five years. There should be 60 as of 8/24/13. We made a payment in early to mid may, and were told we were up to date. We were a few days late with Junes payment and stayed in contact with Sanatnder regarding my wifes exorbanant life sustaining medication costs of over $11,000.00 per month. We were a half a month behind and after I went to work on June 24th,2013, My family woke to a loud banging on the doors, to  find an ape of a repo man, using scare tactics to intimidate my wife and son.

He had already had the car hanging from the back of the rollback before he even knocked or (banged) on the door. My wife requested he wait one moment while she make a payment with the finance company,( my paycheck was late in the mail and had also just arrived a little too late, and the repo man refused. She requested a moment for my son to get her Wheelchair and medical equiptment out of the trunck, My wife had Multiple Sclerosis and Epilepsy and cannot walk. The Reop man refused, and demanded the keys. He refused to leave any paperwork or show anything to identify himself or the company he worked for, and failed to prove he had any authority to take my vehicle.

They towed the vehicle 3 hours away. We immediatley called Santander to resolve the issue and have our car returned. Santander refused any and all forms of payment we had. When I tried to pay the balance due on the same debit card I use to make monthly payments, they refused the payment stating the card was a credit card and not a debit card, therefor was unacceptable, even though the card had debit written across and down the front of the card. My wife also had used her debit card to make montly payments, and they refused to allow her to make the payment because she was not listed on the loan, authorized to manage my account and make monthly payments, but for some was not permitted to do so now. Within a days time, they informed us the stripped the car of its contents, had a buyer for the car and it was at the auction house in East Hemstead Pa.

My wife had called to find out why the car was reposessed when the representitive for Santander told us we were up to date. They said we were 91 days behind. January and February, she quickly produced bank statements calling the finance company decl;aring that fact only to be told, nevermind you dont need to fax it to us we found those payments, it actually march and april, again she produced proof of payment and they made the same statement and added sorry it actually may and june. She was able to prove May payment, but we had not paid June as of yet. They continued to scramble to find us at fault and just cause for the repossession. My wife contacted thier claims department for the damage the repo man had caused to the house that we rent. He had hit the carport and drug the car down the driveway leaving big, long, deep digs in the blacktop.

The company refused to cooperate, and began hanging up on 95% of the calls we made to them. They would not even disclose the location of the medical equiptment, which we know in fact is illegal for them to take. We actually had to hire people to come and care for and look after my wife, because she had to means to transport herself to required medical treatment, doctors, pharmacies or even around the house. My wife called the towing outfit and the man who answered the phone told her to f%$k herself and get a lawyer and hung. To make a very long arguous, stressfilled story short, Santander accepted payment from the same previously mentioned debit card of mine last Friday July 5, 2013. Monday I received a phone called informing me that a release was received and I could come pick up my car. Today Wednsday 7/11/13 I made arrangements and took off of work to recover the car, only to be told by the Auction house that I was not allowed to. The said they did not know where the tag was or the contents of the car. Eventually we were told that the towing outfit had out possessions, but none of them knew who the repo company was or where.

It was not until I called the police department local to the auction house today, that I was given permission at 2:30pm to pick up the vehicle. I will keep you posted on my progress, because they closed for the night before I could get there.

For anyone who has had to deal with SANTANDER CONSUMER USA  or its affiliates, we have some advice we would like to give you. We contacted the  Pennsylvania Attorney General, The US Federal Trade Comission, and filed a complaint and also the Consumer Financial Protection Bureau ***This contact is important*** Santander is regualated by this Agency. Following is the contact information for the agencies we have filed complaints with. I hope it helps you. We are planning on seeking legal representation, and pressing criminal charges on anyone who broke the law in this situation, and are having their bookeeping and banking practices investigated. This is a publicly traded company, and they need to abide by at least standard banking practices as required by law, and I'm sure expected by thier shareholders.

There are so many complaints similar to ours about this company, everyone really needs to file AT LEAST a class action suit, and put this company out of business, they are predatory lenders! The are the definition of that.

Consumer Financial Protection Bureau ( you can file a complaint online  AT: Consumerfinance.gov) or by calling:(855) 414- CFPB and by mail to: P.O. Box 4503, Iowa City, IA, 52244

Call your states Attorney General.

Respectfully,

Michael and Lisa
