On October 24, 2006, I bought a Chevrolet Blazer from an auto dealership I've used before. Citibank financed my loan. At some point Santander Consumer USA took over the loan from Citibank. I paid-off the Blazer in October 2012 as agreed. Since paying the vehicle off Santander continued billing me. I have no late history on my payments over the life of the loan and never was contacted by Santander to inform me of any problems.

In fact neither Citibank or Santander ever contacted me regarding any problems with this loan. It was only after the maturity date of the loan passed that I contacted Santander and told them they owed me my title to the truck. Santander demanded an additional three payments of $279.13 telling me the loan would be paid off in December. The vague explanation for these additional payments was "unpaid interest on the loan."

So I made all three payments as instructed. The first payment was due to one extension on the loan in 2007. But after paying November and Decembers' payments Santander continued to bill me. I contacted Santander on Jan. 3, 2013 and asked for a manager; his name was Sheldon. Sheldon explained all my payments over the life of the loan were late.

He traced the problem to the second payment on this loan. The original due date was the 24th of every months as that's the day I purchased my truck on. After the first payment I contacted Citibank to request a new due date on my payments, since I get paid once a month on the 3rd. To allow time for USPS mail to get delivered to Citibank I requested my due date changed to the 10th. This would allow one week for transit / holidays, etc. I was told I could only do this once over the life of the loan.

Citibank's phone rep told me she had changed the due date as requested. Faithfully every payment has been made on the 3rd or 4th of each month since then. As a result my payment history with Santander should be excellent.

But today Sheldon informs me my due date was changed from the 24th to the 3rd not the 10th as I requested. Clearly the phone rep heard me say I was paid on the 3rd and that's what she entered in the computer, not the 10th. I understand no one's perfect and I'm sure it was an unintentional error made by the Citibank employee.

After the loan was paid-in-full with two additional over-payments Santander is still demanding monthly payments. Though my loan is "under review" according to Sheldon, I have stopped any more payments going to Santander, whose position is to BLACKMAIL me threatening repossession if I don't pay them. Santander added an additional $1675 to my loan which they claim is all for late payments. This is fraud.

I advise you not to deal with Santander if you're looking for a loan. According to Ripoff Reports 84 complains have already been filed against Santander, and after reading several it appears its a regular thing for Santander to extend people's loans without notifying them, or explaining why these extensions have been added to the account. I'm not the only one here that Santander has run this scam on.

Thanks for the good advice. That's exactly what I'm doing now. Santander claims the truck will be paid off in April. So I'll play their game, but I have filed to complaints with the state, and have had my name included in two class-action suits against them.

Right now you have a dispute with Santander. It sounds like a legitimate dispute to me based on your post. However, if you stop making the payments now, Santander can repo your vehicle under the terms of your note. I haven't read your specific car note, but every loan has default terms.

You might want to pay Santander off and get your title first. Protect yourself by sending the payment "Paid under protest, funds not owed" or something similar. Contact a consumer attorney to help you. If you lose your car now, it will destroy your credit and hurt you much more than it will hurt Santander. Hopefully you have your documentation for all of your payments plus the conversations you had with the original lender too to prove up your side in court. I would think that you would be able to collect enough from Santander to make you whole and maybe even damages. I am not an attorney though, so get a good one. Good luck.
