Due to a loss of income, I fell one month behind in my mortgage payments with Saxon Mortgage. I notified them in writing and by phone when I would make my next payment.

The set payment date is on my file with Saxon Mortgage, yet everyday, at least 5 to 7 times a day, I receive phone calls from Saxon Mortgage asking when I will make the late payment plus the current payment & late fees.

At first I would answer the phone calls, then ask them to look at my file in their computer, did it not show that I had already made payment arrangements? They always answer "yes", then I ask, "why are you calling me", and they say, "we will continue to call you everyday until your payment is current and paid". So I then told them that I consider this "Harrassment" and that I would not be accepting any more phone calls from Saxon Mtg.

I made my May 2008 payment June 18th, my June 2008 payment July 17th and Saxon called me on July 17th asking when I was going to make my July payment. I told the representative that I had already scheduled my July payment to August 14th. She then advised me that after the August 14th payment, they would no longer take my payments unless the account was brought current in full. They also always tell you that your payment, when late, may be returned to you.

I have sent Saxon Mortgage documentation to show them that my home is worth $100,000 less than my mortgage balance due to the recession that we are all facing. I have also always ask them, "do you really want my house back? If you don't want my house back, then can't you work with me for a few months until I get myself caught up?"

I tried the Loan Modification department and they offered me the following deal: One month the end of the loan, fixed rate of interest of 7.99%, 3 years fixed which would end up raising my payments nearly $400 per month. I told him if I am having problems paying my current monthly payment, how was this helping me? So I told the loan modification department that this would not work for me. So then they close the file, by stating that they "denied my request".

The Loan Modification department also does not return phone calls, it took me nearly two and 1/2 months to get someone to actually call me back.

The harrassment that Saxon Mortgage passes onto its customers is a violation. Saxon Mortgage is paying hundreds of thousands of wasted money on these customer service representatives to do nothing more than harrass their customers, they never resolve anything, because once you make an arrangement with one of them, they call you again the very next day, as though "nothing" was resolved the day before.

I am not 6 months behind in my mortgage, only 1 month behind and they "do not want to work with me AT ALL!"

When you ask the representative, "do you have a supervisor?", they say, "yes", but she will tell you the same thing I am telling you. So when I finally get the supervisor on the phone, go through the "whole" story again, conveniently I find myself talking to a dead phone, we have been disconnected! This is not an accident. It happens every time I call.

Saxon Mortgage corporate officer's should be ashamed to associate themselves with the reputation that they have, because of how they train their own employees to conduct and operate their business.

Not Harrasment

The fact that you are past due, under the FDCPA gives saxon the right to call to collect on the debt. even though you setup arrengements by your own explaination you are past due one month, there for its not consider harrassment if you are 1 day past due, there is an intent to collect a debt.
