Back in February 2009, my husband and I opted to request a loan modification with Saxon Mortgage to lower our payments while I am completing my college education. Our loan modification request was approved, and we completed the documents sent to us as instructed, had the documents notarized and sent them back to Saxon well before the deadline with a certified check for $379 to cover the cost of processing.

Our payment for March was deferred because of the loan modification, and they confirmed to us that the only funds due to Saxon for the month of March 2009 was the $379 check to cover the cost of processing the loan modification and that our next payment at the lower rate of interest and lower payment was due April 2009.

So I sent them my mortgage payment for April. On April 6, 2009 I received a call from a Saxon employee named Cynthia Nares (Teller ID# 19905). Ms. Nares explained to me that there had been an error on Saxon's part, and the loan modification documents were improperly processed. As a result, their system still showed the higher interest rate and now showed us late for March's payment. She assured me that we were not at fault (and in fact I have had many people at Saxon acknowledge we are not at fault in this issue..they are..) and she told me that I needed to sign a new set of loan modification documents which would be sent to us via FedEx to correct the error in their system and clear the notation of a missed payment and also clear the late fees.

Those documents were ordered by Ms. Nares on April 7, 2009 .. and have never arrived.

In the meantime, I am regularly harassed by Saxon employee's claiming I am in default, that I have not made my March, April and now May payments.. even though I have canceled checks from my bank indicating that in truth, Saxon received my April and May payments on time and cashed the checks.

On April 27, 2009 I called Saxon at 3 p.m. and spoke to "Mary Jane" teller ID# 19154 and was told that my April payment is there, but that it is noted in the account as on hold for interest to be applied with loan modification documents. (I.E. The payment is on hold not applied to account as yet.)

She also told that the first loan modification shows as model not completed by Saxon on time, thus the error on their part and the need for the second modification to be completed.

Also on April 27, 2009 I received 3 letters dated 4/20 4/23 advising us of Pre-Acceleration Warning and Notice Pursuant to Virginia Code SS 55-59.1:1 and that if we did not send them $2385.01 they would begin foreclosure proceedings on our home, even though this criminal corporation has my money for my house payment and has in fact had it all along.

Now here it is, May 12, 2009 and STILL this issue is not resolved. I was informed by a very rude Saxon employee last night that we are now late for May's payment as well. I sent May's payment using delivery confirmation through the post office, and I know it was received. I also know from my bank statement and the copy of the canceled check, that Saxon does in fact have my May payment now and did cash the check.

I can get no where with the incompetents who answer their customer service line, and a message left with Cynthia Nares' voice mail has gone unanswered. Promises that management level employee's will call me back are never kept..

And I have engaged a lawyer to protect my family and my home from these incompetent, criminal idiots.

After months of stress, arguing and headaches..

And the hiring of a lawyer to get involved on my behalf..

Saxon Mortgage has FINALLY fixed their error and my mortgage is straight.

I just wish I hadn't had to deal with hiring a lawyer but hey, it's finally resolved.

Miracles do happen.. I think I might go buy a lotto ticket tomorrow..
