SBCS Debt Collections And Phone Company Ripped me off! Classic example of a ripoff mental anguish I will get paid Not Sure Nationwide

I will get paid for the mistreatment I have suffered! I am taking these jerks to court!

I received a message on my phone from this debt company. They gave me the number and a claim number and told me to call them. They also mentioned that they were a company trying to collect on a debt. I was floored. I never was even able to get credit and now I owe a debt. I didnt even fully understand what a debt was! So I called back the people a few days later because I was suffering from so much mental anguish. I couldnt even go to my job at the bingo hall! I gave them my claim number and they ask me if I was this other person. I told them no, but they were the people who had this phone line before me (I have received a lot of calls from people looking for them). They had the wrong person.

So I am suing the pants off these people for harassment and to be paid for my time off work and to pay for the valium I bought from my daughter to calm down acfter the mental anguish, which I am also suing for. NOT ONLY am I suing this company that must be run by a bunch of people who do not accept christ in their lives (I am a Christian Warrior), but I am suing my phone company too. For reasins that are obvious, I won't name the phone company cuz I want to surprise them ( I already called and told the people who I was and that I was suing them at the debt company, so I don't need to surprise them). I ams uing them because they never should have given this man my phone number! They knew that the line was in my name so I don't get why they would tell the guy my number to get a hold of these people. I called and complained to the operator but she couldnt grasp where the company was wrong and said they havent gived out my number. Ha! There are so many dumb people working in this world! If they didnt gived out my number, how else would not only these crooks get my number, but know that the people who had my number before had my number? I am on to these people! In the name of Christ the Lord, I will get paid for my wrongdoings!

This is a major phone company and will obviously be a large lawsuit. If anyone else wants to get in on it with me, contact me through Rip-off. This is going to be huge so don't be surprised when I show up on the evening news! If any lawyers want to win a large lawsuit and get PAID along with me, they can contact too. I dont want to get too many people in on this because then my share of the money will be less, so I will only accept the first 5 people who writed me. I am sure many others have been scammed by these devil worshippers!

Who is this CA because I want to sue them too. I dont get how people do not think I can sue. I was in turmoil, so stressed out. They havent been harassing me and they havent given me details on anyone but when I think of the mental anguish I suffered, I am going to get them.

Jennifer,

First of all your phone company is most likely not involved and a lawsuit against them would be frivolous, costly, and you would lose.

Second, the only violation here is a FDCPA violation on the part of the collection agency when they disclosed they were debt collectors and divulged information about a debt to a third party [you]. This violation is worth UP TO $1000 plus costs in civil court. Thats it.

The ONLY [ethical]obligation your phone company has is to offer to change your number free of charge. This would just be good business, NOT a legal requirement. It is common practice and perfectly legal to recycle phone numbers. You were just unlucky in getting a number that someone else had who walked away from a bunch of debts.

Did you ask the phone company to change the number for free BEFORE you threatened a lawsuit?

Upon first contact by the collection agency, you should have sent a CEASE COMMUNICATIONS request by certified mail, return reciept requested. Did you send such a letter? If not, the calls are not illegal, and you have no lawsuit.

I suggest you go to the FTC.gov website and read and print out the FDCPA which will inform you of your legal rights. You can also file a complaint against them while there.

And, just so you know, your religous views are totally irrelevant to this situation, and will alienate many people who may have otherwise tried to help you. Religion is a personal matter and should never be brought up in business matters.

I don't see how you can sue....

I don't think you can sue the phone company regardless of how large they are. If the ca asked for another person who used to have the phone number, and you indicated that was true, than they probably had the number on her records. I can't see how the phone company gave them the number.

If you have sent a letter, certified and rrr, telling them to cease all contact for this person, and they continue to call, then you could sue the ca, not the phone company.
