My family listed our house with Bas Panch and SCV Home Buyer in the fall of 2005. Even though he sold the house in a quick time frame, we deeply regret our decision to list with Bas Paunch and SCV Home buyer.

Our experience with Bas enforces the adage that you get what you pay for. He charged only 4% commission. Shortly after listing, Bas presented us with a dual representation opportunity to sell our home. We ignorantly agreed.

Five months after the close of escrow, the buyer successfully sued our family in California Small Claims Court.

My wife and I apparently failed to declare that three years before escrow closed, the incoming water pipe leaked in the back yard. We fixed the leak three years before lisitng the house with SCV Home Buyer.

My wife and I had zero guidance from Bas Paunch or SCV home buyers to declare every problem we had during our eight year home ownership. Bas handed to me the declaration papers and simply stated that we should declare any problems we currently have with the house.

Bas was not with us advising how to handle the declaration papers. His guidance was worthless and resulted in our vulnerability in a California court.

Additionally, I am still upset that Bas stayed in his car on a cell phone call while the buyer and his contractor walked through our house, un-escorted. Everything my family owned was in that house, with two strangers, while my representation sat on a cell phone call in the driveway.

My wife and I are still irked by a dis-agreement we had with Bas at the end of escrow. We had to bring our garage based water heater up to earthquake code. After advising us that nobody ever nit picks the garage, and dress down our house by placing many items in the garage, Bas was extremely critical of how the earthquake code strapping looked. After a lengthy argument, Bas Finally conceded that the heater was to code, but he did not like the way it looked. Our own representation, who advised us that no one nit picked the garage, was in fact nit picking our garage.

My wife and I relied on SCV Home Buyer to provide professional real estate guidance. Bas failed to advise us how to handle the declarations involved with escrow. SCV Home Buyers did not protect our family from vulnerability, and left my wife and I with liability.

The raw truth

My only goal was to sell the property efficiently, and in way that would not leave me finacially liable for anything.

That was a primary reason to hire a professional.

What did I gain by not disclosing a broken pipe from 3 years back?  I simply had no guidance to declare such s thing.

Clearly it was the leadership in this transaction that failed.

I would like to take this opportunity to express my deepest appreciation for the care and time you took with my short sale. When I was transferred from my job at Lockheed Martin in California to my new position in Texas, I was unsure of how I would be able to get out of my home being “underwater”. The relocation company dictated the move and how you were supposed to handle the short sale. Although, your experience proved invaluable in making this impossible situation happen.

You advised the relocation company that they could not be involved in the short sale due to the fact that they are a third party and a short sale can not involve a third party. The relocation company insisted and you moved forward as instructed, only to have to restart the whole process months later when you were proved correct and they had to be removed from the sale. Then, when the investor of my loan wanted $100k over the fair market value, you yet again, went to bat for me. You wrote letters, made endless phone calls, sent in unending documentation, and even contacted your Washington, D.C. connections to prove your point.

Your determination, relentless, positive, hard work did not go unnoticed by me or others involved in the transaction. You made this happen! And for that, my family and I will be forever grateful. It was a long and bumpy road, but I knew with you and your expertise, that we would cross the finish line victorious.

Thank you hardly seems enough for all you have done. I am eternally grateful for your kindness, selflessness, and professionalism in helping me. To any other perspective sellers, or buyers for that matter, I highly recommend Bas Panch and his highly capable team for handling all your Real Estate needs. He will not only explain fully each step of the process, he will get it done, no matter what obstacles you face! He is loyal, honest, hard working and helpful. Failed Real Estate Guidance

 I will only address the issues that are pointed out here:

 1- I must first note that on the California Listing Agreement; Item 4 Compensation to Broker: Notes: (In bold) the amount of rate of real estate commissions is not fixed by law. They are set by each Broker individually and may be negotiable between Owner and Broker.

Even when I charged 4% commission, I always provide superior service to all of my clients.

 2- By having a seller sign a dual representation, I am being open and honest about how I am conducting business as required by law.

 3- When selling your home, you the seller are required by law to disclose any known issues or problems the property has had or currently has, as clearly stated on the Real Estate Transfer Disclosure Statement. By claiming that a water leak was fixed by the seller is prior knowledge from the seller leaving them open to be sued as was the case here and also left my company open to be sued as well.  Also, by California state law, a Broker is not allowed to advise the seller exactly what to put on the form, as a Broker I always inform a seller to please note anything and everything on the form, as I did in this case. I personally had no previous knowledge of the water leak and I could not inform the seller to disclose what I did not know. To clarify, my company was also named in this law suit.

The reason this matter even came up was because the new owner (buyer in this case) had an issue with plumbing and it just so happened that a neighbor with knowledge of the previous water leak problem informed the new owner of the issue.

4- As for my being on my cell phone for the entire time the buyer’s home inspection took place, this was many years ago and I can’t possibly state how long or if I even took a phone call then. I do remember going to my car to get my cell phone charger. What I can say is that it is not my practice then or now to leave my clients property unattended for any length of time.

 5- In the issue of the water heater strapping, California law states that a water heater needs to have earthquake strapping and what I stated to the seller was that the strapping needed to go around the water heater to ensure bracing, and not just in front of the water heater. As I am not an inspector I can not tell a seller if the water heater is in code. I finally agreed with the seller because it was obvious that the seller was going to do what he wanted and not what I was informing him.

This was not the garage being nit picked, simply the water heater code issue, as I never stated anything about the garage itself.

In conclusion, it is my opinion that this seller was upset with me more so for being sued than the other issues mentioned here, because on 4/24/2006 the judgment entered on this issue in small claims court in Santa Clarita Valley for case # 06S00125 stated: Bas Panch DBA SCV Home Buyer Does Not Owe Plaintiff (buyer) Any Money On Plaintiff’s Claim.

Although I understand why this seller is upset, I must share that when in contracts with someone for anything, please read all of your paperwork thoroughly and completely and never leave it up to someone else because as this case shows, you will be the one solely liable.
