S.E. Pomerantz, M.D. MRO 2026 False Positive Drug Test Topeka Kansas

Driving Dump Trucks is my career and when I was interviewed for a job I was asked to take a Drug Test ( which is required by law ) since I would be driving on state and federal highways to and from job sites and the quarries.  I submitted my Urine to MENSASS/ substance abuse screening at 1100 SW Wanamaker in Top, KS on May 24th 2013 on May 30th the MRO(medical review officer) called me and asked for my pharmasist to send him a copy of my medications to S.E. Pomerantz M.D. MRO 2026.  I had spoken to my pharmacy and was told that goes against the HEPA laws and said he would not send that information to the MRO for no reason. So I did some investigating on my own and found out that my pharmasits was right.  The MRO should have asked for my doctor to get in touch with him (MRO) and not my pharmacy.  So in the meantime this MRO has contacted my perspective employer and revealed the results to him ( no names mentioned ) therefore I did not get the job.  The company I left my sample at did not have blueing in the toilet and in did not list the Courier Company that transported the samples to the MRO that does the testing.  

I am assuming that the MRO also informed the KS Dept of Transportation, which will cause me not to drive for 6 months.  I called S.E. Pomerantz and asked for a caopy of the test results and his office procedures in which I am entitled to as I am the patient and it is my sample and he said he can't do that, How can he refuse me of my request when it is my sample and my right to know the exact results?????? I don't do drugs and have always in the past passed every drug test taken NOW my HOME, MY CAR and MY CAREER depended on this doctor to follow strict guidelines in doing the test and if found to be a positive result is supposed to do a conformation test on the sample and furthermore supposed to allow me to take my split sample to another lab to have a second test performed at a laborartory of my choice, How can I do that when the MRO is not willing to give me the test results and do a confirmation test required by federal law??????

I was going to be making $12.00 an hour driving for this company and now I can't do anything but look for another job.  It took me 1 1/2 years to land this job after looking for work that long you would think that someone other than hiring an attorney could help me with this I have contacted my doctor and went over all my medications I have been taking and a couple of them could cause a false positive on a drug test .  But because I have never failed one in the past and have no history of drug abuse, what are if any are my options in getting paid for lost time of work.  These people that say they are a certified Drug testing laborartory should have to have a licence hung on the wall just as I have to have a CDL to drive a truck.  It only takes one mistake to ruin a persons LIFE and in my book they should have to be licenced just as I have to be Lic. to drive a truck on federal and state highways.  

I should be working right now instead of writing this report , but because of one so called Doctor and his lab habits I am not working .  I am a hard worker and a very good truck driver I have worked asphalt on the ground and I have hauled asphalt to the laydown machine, I can dump spread as good if not better than most and I really enjoyed my career.  THIS DRUG TESTING ordeal needs to have strict procedures inforced on the companies that claim to be a testing facility.  This So Called Doctor has riuned my life to this point.
