Sears uses deceptive fraudlent credit practices.

They billed me of a "Non Usage" of my card and NEVER sent me a bill. The non usage fees accumulated and were sent to a collection agency - which is the first I have ever heard of the charges.

They only way I could find out what the charges were was from the new "owner" of the "debt". Every attempt made to contact Sears was met with rude nasty people that absolutley REFUSED to identify the charges.

Sears has violated my billing rights which include the right to know what I am being billed for. In addition they are obligated to send a bill each billing period for any amount owed that exceeds $1.00.

I have filed a complaint with the Federal Trade Commission and with Equifax. My credit rating is now "poor". Sears will rue the day they ever decided to use their deceptive illegal practices on me.

The Collection Agency is now looking for $400.00 for a card I never charged on!

Final Update

I contacted a lawyer and he told me that until LVNV took me to court on the bad Sears "Debt" I could do nothing. My final resort was contacting the attorney general in the State of South Carolina. The attorney General sent them a letter requesting that they comply with the law and send me information on the "debt" 45 days later LVNV funding sent a letter to the attorney general stating there was no longer a debt and they would contact the credit reporting agencies to have the information removed.

You MUST fight these people. Take my advice and go directly to the attorney general. They are the ONLY people that responded and helped.

These people are legally stealing from American citizens and holding innocent parties' credit ratings hostage.

Don't give up. Don't be their victim. You can win.

It is amazing how many people have a mysterious $200 charge from Sears that Sears never bills, sends to collection agencies, and will not vaildate.

They are crooked. Remember get rid of your Sears card. Call cancel, send certified letters. Even if you do not use the card they can still ruin your credit and it will take some time to recover from their attack.

Update on this situation (I had to create a new login as I could not access for some reason

I am still in a battle with Sears/ LVNV Funding over these mysterious charges. The first time I ever heard of them was when the collection agency sent me a letter. There were no attempts from Sears, or the collection agency to collect any money from me prior to reporting the delinquent activity to the credit agencies.

My credit is still ruined. I have sent certified letters to Sears (no responses are ever given) to the collection agencies, to the credit reporting agencies and have gotten nowhere. The Collection agency claims they are only the third party and do not have to give detailed info on the original purchase. The credit reporting agencies will do NOTHING. All they do is verify that the charges were reported correctly. Not that the charges are correct but that the company has followed whatever the criteria is of the reporting policy.

The attorney LVNV funding hired has sent me a letter that they will not pursue the debt however the agency itself refuses to remove from my credit report and resolve.

My latest attempt was to contact the Sate Attorney General in SC where the collection agency is based out of to force them to produce the details of the debt

I am waiting for the Attorney General to complete their investigation.

My next step will be to apply for a huge home equity loan. I will not get a decent rate and this way I will be able to sue for damages in the higher interest rate that I will be forced to pay.

The consumer is at the mercy of crooked credit agencies, collection agencies, credit-reporting agencies and the Federal Govt. does little to help the consumer. My credit rating is in the garbage but this bill will NEVER be paid.
